Abstract

AbstrakAnak merupakan aset bangsa, sebagai bagian dari generasi muda anak berperan sangat strategis sebagai successor suatu bangsa. Namun ketika anak berhadapan dengan hukum sebagai seorang pelaku tindak pidana, Negara wajib melaksanakan penegakan hukum yang khusus bagi anak pelak tindak pidana melalui instansi penegak hukum di Indonesia. Pelaksanaan penegakan hukum terhadap tindak pidana anak sebagai pelaku dalam sistem peradilan pidana anak dimana menjadi dua proses yaitu dalam proses peradilan dan di luar proses peradilan yang mana dalam kasus anak sebagai pelaku tindak pidana, diutamakan untuk melalui proses diluar peradilan yang disebut diversi yang bertujuan untuk melindungi hak-hak anak yang telah tercantum dalam UUD NRI Tahun 1945 dan perundang-undangan terkait anak. Dalam hal ini Polres Tegal berupaya mengatasi hambatan-hambatan yang terjadi baik hambatan eksternal maupun internal dengan berbagai solusi yang bertujuan untuk melancarkan pelaksanaan yang seimbang antara penegakan hukum dan perlindungan anak yang menjadi acuan keberhasilan bagi Polres Tegal di masa datang dalam menangani kasus anak sebagai pelaku tindak pidana.Keywords: Penegakan Hukum, Pelaku Tindak Pidana, Sistem Peradilan Pidana Anak. AbstractChildren are an asset of the nation, as part of the young generation of children plays a very strategic role as a successor of a nation. However, when the child is dealing with the law as a criminal offender, the State must enforce special law enforcement for child prostitution through law enforcement agencies in Indonesia. The implementation of law enforcement on child crime as perpetrator in the criminal justice system where the child becomes two processes that is in the process of justice and outside the judicial process which in the case of children as perpetrators of criminal acts, preferably to go beyond the process of judiciary called diversi which aims to protect the rights of children already laid down in the 1945 constitution of the Indonesian republic and the legislation relating to children. in this case Tegal Police try to overcome obstacles that happened both external and internal obstacle with various solution which aim to launch balanced implementation between law enforcement and child protection as a reference for the future success of Tegal Polres in handling child cases as perpetrators of crime.Keywords: Law Enforcement, Criminal Actors, Child Criminal Justice System.

Abstract

This Research results that : a) The implementation of law enforcement in the field of food related to formalin noodles conducted by Central Java Police, based on the Law of the Republic of Indonesia Number 18 Year 2012 on Food, set forth in Article 132, Chapter XIV, on Investigation is described as follows: (1) In addition to the police officers of the Republic of Indonesia, certain civil servant officials whose scope of duties and responsibilities in the field of Food are given special powers as investigators to conduct investigations in criminal offenses in the field of Food in accordance with the provisions of laws and regulations in the field of Criminal Procedure Law. (2) The civil servant investigator (3) The civil servant investigator as referred to in paragraph (1) shall inform the commencement of investigation to the police investigator officer of the Republic of Indonesia. (4) If the exercise of authority referred to in paragraph (2) requires arrest and detention measures, civil servant investigators shall coordinate with the police investigating officers of the Republic of Indonesia in accordance with the provisions of legislation. (5) The civil servant investigator as referred to in paragraph (1) shall submit the results of the investigation to the prosecutor through the police investigating officer of the Republic of Indonesia. (6) The appointment of civil servant investigation officers and procedures and investigation processes shall be carried out in accordance with the provisions of laws and regulations. b) Obstacles from Witnesses: People who know about criminal events often avoid being made witnesses. Witnesses often ignore / evade an investigator's call for questioning. Thus from some of these constraints, especially in the investigation process conducted by Police Investigator of Central Java, the Investigator can handle it as follows: c) Perform performance professionally. ABSTRAKDalam penelitian ini permasalahan yang akan dibahas yaitu: Mengapa terjadi disparitas pidana antara Putusan No.130/Pid.Sus-Anak/2016/PN Dmk dan Studi Putusan No.136/Pid.Sus-Anak/2017/PN dengan Putusan Pengadilan Negeri Demak Nomor: No.139/Pid.Sus-Anak/2017/PN. Demak dan Apakah akibat disparitas pidana terhadap anak pelaku tindak pidana pencabulan dengan kekerasan antara Putusan No.130/Pid.Sus-Anak/2016/PN Dmk dan Studi Putusan No.136/Pid.Sus-Anak/2017/PN dengan Putusan Pengadilan Negeri Demak Nomor: No.139/Pid.Sus-Anak/2017/PN. Demak terhadap pelaku dan korban yang masih anak.Pendekatan yang akan digunakan adalah pendekatan yang bersifat Yuridis Sosiologis. Adapaun sumber dan jenis data dalam penelitian ini adalah data primer yang diperoleh dari studi lapangan dengan wawancara . Dan data sekunder diperoleh dari studi kepustakaan.Kesimpulan dari penilitian ini adalah Peranan Terdakwa dalam melakukan tindak pidana persetubuhan dan atau pencabulan apakah direncanakan terlebih dahulu, dengan kekerasan yang menakibatkan anak korana tidak bisa berdaya sehingga tidak pidana terjadi atau sebelunya dalam melakukan tindak pidana dengan cara berpacaran terlebih dahulu; Korban Berpengaruh terhadap mental atau psikis anak korban itu sendiri, dengan putusan yang berbeda-beda, sehingga korban akan timbul merasa kekecewaan terhadap putusan yang dijatuhkan oleh hakim yang berdasarkan peraturan dan hukum yang ditegakan oleh aparatur penegak hukum yang dalam pertimbangan putusannya belum bisa memberi rasa keadialan bagi korban.Kata Kunci : Disparitas, Pidana, Perkara Anak ABSTRACTIn this study, the problems that will be discussed are: Why there is a criminal disparity between Decision No.130 / Pid.Sus-Anak / 2016 / PN Dmk and Study Decision No.136 / Pid.Sus-Anak / 2017 / PN with Decision of Demak District Court Number: No.139 / Pid.Sus / 2017 / PN. Abstract

ABSTRAKPenelitian ini berjudul Analisa Kebijakan Formulasi Hukum Pidana Dalam Penanggulangan Tindak Pidana Korupsi. Tujuan Penelitian ini : 1) Untuk mengetahui dan menganalisis kebijakan formulasi tindak pidana korupsi dalam perundang-undangan yang berlaku saat ini. 2) Untuk mengetahui dan menganalisis kebijakan formulasi tindak pidana korupsi yang akan datang.Hasil Penelitian : a) Kebijakan formulasi hukum pidana khususnya mengenai formulasi tindak pidana korupsi saat ini, memiliki sejumlah kelemahan yang mendasar, sebagi berikut: 1) Kebijakan hukum pidana dalam hal tindak pidana korupsi yang berlaku saat ini, tindak mencantumkan kualifikasi delik apakah sebagai ?pelanggaran? atau ?kejahatan?. Kebijakan Hukum pidana dalam hal tindak pidana korupsi saat ini tidak memberikan pengertian atau batasan-batasan yuridis mengenai ?permufakatan jahat?, ?tindak pidana dalam hal pembantuan atau pembatu? (medeplichtige) dan ?pengulangan tindak pidana?(recidive). 2) Kebijakan hukum pidana dalam hal pemberantasan tidak pidana korupsi, masih tersebar di beberapa perundang-undangan dan menggunakan sanksi berdasarkan undang-undang yang berbeda, hal ini dapat menimbulkan persoalan terutama dalam aspek keadilan. b) Mencermati kelemahan yang terdapat dalam kebijakan hukum pidana mengenai tindak pidana korupsi saat ini, serta kelemahan-kelemahan yang terdapat dalam RUU Tentang Pemberantasan Tindak Pidana Korupsi yang disusun oleh pemerintah (Naskah bulan Agustus 2008), maka sebaiknya dilakukan pembaharuan terhadap kebijakan hukum pidana mengenai tindak pidana korupsi untuk yang akan datang, dengan memperhatikan hal-hal sebagai berikut: 1) Rumusan tindak pidana korupsi tetap menekankan pada unsur ?merugikan keuangan atau perekonomian negara?. memberikan pengertian yuridis mengenai ?Permufakatan jahat?, serta ?pengulangan tindak pidana? (recedive). 2) Mencantumkan pemberatan pidana atau pemidanaan untuk tindak pidana korupsi khususnya pada lingkup ?suap? dan ?pemerasan dalam jabatan? yang dilakukan oleh penegak hukum terhadap perkara-perkara hukum yang sedang diperiksa.Kata Kunci : Analisa Kebijakan, Hukum Pidana, Tindak Pidana Korupsi ABSTRACT  This research entitled Policy Analysis of Criminal Law Formulation in Countering Corruption Crime. The purpose of this study: 1) To know and analyze the formulation policy of corruption in the current legislation. 2) To know and analyze the formulation policy of corruption crime that will come.Result of research: a) Formulation policy of criminal law especially concerning formulation of corruption crime at this time, has some fundamental weakness, as follows: 1) Criminal law policy in case of corruption crime in effect now, "Or" crime ". The criminal law policy in the case of corruption currently does not provide juridical definition or constraints on "malicious conspiracy", "meditlichtige and recidive". 2) Criminal law policy in the case of non-criminal corruption eradication, still scattered in several legislation and using sanctions based on different laws, this can cause problems especially in the aspect of justice. b) Paying close attention to the weaknesses contained in the criminal law policy regarding the current corruption crime, and the weaknesses contained in the Draft Law on Corruption Eradication made by the government (Manuscript of August 2008), it is advisable to update the criminal law policy regarding criminal corruption for the future, taking into account the following matters: 1) The formulation of criminal corruption still emphasizes the element of "harming the finance or economy of the country". provide a juridical understanding of "conspiracy", and "recedive". 2) Include a criminal or criminal penalty for corruption, particularly in the sphere of "bribery" and "extortion in office" committed by law enforcers against the legal cases being examined. Abstract

Kegiatan ini bertujuan untuk melatih Mitra membuat dua kolam terpal masing-masing kelompok mitra dengan panjang 400 cm, lebar 300 cm dan tinggi 100 cm. Kemudian panjang 200 cm, lembar 150 cm dan tinggi 100 cm.  Metode kegiatan yang diterapkan adalah pelatihan dalam bentuk diskusi yang terarah dan disertai dengan demontrasi atau praktek secara langsung dalam pembuatan kolam  terpal. Kegiatan ini melibatkan 3 (tiga) kelompok Mitra secara aktif mulai dari kegiatan persiapan alat dan bahan, pemotongan bahan, pembuatan rangka, pembentukan terpal, dan perakitan kolam terpal. Melalui kegiatan tersebut, kelompok Mitra berhasil membuat dua unit kolam terpal masing-masing kelompok yang siap digunakan untuk produksi usaha budidaya ikan air tawar.implementation of PKM activities is good communication and smoothly between PKM team and partners.

Abstract

Provisions concerning Notary regulated in Act No. 2 of 2014 on the Amendment of Act No. 30 of 2004 concerning Notary (hereinafter referred UUJN).[1] In Article 16 paragraph (1) letter (e) states that a Notary UUJN must preserve the confidentiality of all information obtained for a deed in accordance with their oath of office. In facing legal issues, Notary need an organization that can accommodate the aspirations and the problems it faces, so precisely that the Indonesian Notary Association (INI) into an organization that has continuity in carrying out the supervision, guidance and legal protection for a notary.The research objective is to analyze the legal protection of a notary is used as a suspect in the running of their office, to analyze problems and solutions of legal protection against notaries who serve as a suspect in carrying out his duties.The method used in this research is juridical empirical method is a method of legal research that attempts to view the law in terms of real or can be said to see, examine how the workings of the legal community.The results of this study finally provides an answer that before a notary dragged to criminal law to the case of giving false testimony, the investigator must know what the principal case of the case. Due to lack of caution can make  Notary as a suspect. Notaries in carrying out its duties merely formal and only constantire wishes of the parties and then poured into deed. Because there is one of the aggrieved party in the matter and notary asked by investigators to show the deed and is of public interest and obtain permission from MKN, then Article 16 (1) f and Article 54 UUJN about keeping positions can be ruled out because there are interests higher should notary testified that noataris released from his oath of office according to the rules applicable legislation. MKN legal protection given to the Notary ie if it will initiate an investigation or calling to the Notary must ask permission first terelebih to MKN, must coordinate with the IT organization or the competent senior Notary.Keywords: Legal Protection; Suspect; Notary.

Abstract

ABSTRAKPenelitian ini berjudul Impelementasi Peraturan Mahkamah Agung Nomor 2 Tahun 2012 Tentang Penyesuaian Batasan Tindak Pidana Ringan dan Jumlah Denda Dalam KUHP di Kepolisian Resor Rembang (Studi Kasus Pada Tindak Pidana Pencurian Ringan). Tujuan Penelitian ini : 1) Untuk mengetahui Implementasi Perma Nomor 2 Tahun 2012 yang berdasar  tindak pidana ringan dalam KUHP di Polres Rembang. 2) Untuk mengetahui dan menganalisa kelemahan dan solusi Implementasi Perma Nomor 2 Tahun 2012 tentang batasan tindak pidana ringan dalam KUHP di Polres Rembang.Hasil Penelitian : a) Selain unsur-unsur pokok perihal pembuktian dengan mengumpulkan alat bukti dalam hukum materiil, maka hakim turut juga berpedoman pada surat dakwaan yang dirumuskan oleh Jaksa Penuntut Umum (JPU). Akan tetapi, pada jenis tindak pidana ringan terdapat beberapa unsur khusus yang membedakan antara sistem acara cepat pada perkara tipiring dengan sistem acara pidana lainnya. Pada perkara tipiring yang menerapkan sistem pemeriksaan acara cepat tidak diperlukan surat dakwaan dalam pelimpahan perkara pidana ke pengadilan untuk proses persidangannya. b). Perbedaan antara Perma tentang Penyesuaian Batasan Tindak Pidana Ringan dan Jumlah Denda dalam KUHP yang dikeluarkan oleh MA, dengan KUHAP tentang Tipiring itu sendiri yaitu dengan adanya batasan nilai uang dengan jumlah Rp. 2.500.000,00 sedangkan di dalam KUHAP menekankan Tipiring pada jumlah kurungan paling lama 3 bulan atau denda sebanyak-banyaknya Rp. 7.500,00. Hal ini menjadi polemik sebab Perma dikeluarkan sepihak oleh Mahkamah Agung yang berimplikasi dalam penegakan hukum yang bersifat parsial. Oleh sebab itu, diperlukan koordinasi lebih jauh antara Mahkamah Agung, Kepolisian, dan juga Kejaksaan agar ada sinkronisasi dan kesepahaman antara penegak hukum lainnya terkait Tipring serta sanksi yang harus diberikan terhadap pelakunya.Kata Kunci : Tindak Pidana Ringan, Pencurian, Implementasi ABSTRACT This research is titled Impelementasi Supreme Court Regulation Number 2 Year 2012 About Adjustment Limitation of Criminal Act and Number of Penalties in Criminal Code at Resort Police Rembang (Case Study On Crime Of Theft). The purpose of this research: 1) To know Implementation of Perma Number 2 Year 2012 based on minor criminal act in Criminal Code at Polres Rembang. 2) To know and analyze weaknesses and solutions Implementation of Perma Number 2 Year 2012 on the limitation of minor criminal offenses in the Criminal Code in Rembang Polres.Research Result: a) In addition to the basic elements of proof by collecting evidence in the material law, the judge shall also be guided by the indictment formulated by the Public Prosecutor (JPU). However, in the type of minor crime there are some special elements that distinguish between the system of fast events on tipping cases with other criminal procedure systems. In case of tipiring applying a fast-checking system, no indictment is required in the transfer of criminal cases to the court for the proceedings. b). The difference between the Perma on Adjustment of Limitation of Criminal Crime and the Amount of Penalty in the Criminal Code issued by the Supreme Court, with the Criminal Code concerning Tipiring itself that is with the limit of the value of money by the amount of Rp. 2.500.000,00 whereas in KUHAP emphasizes Tipiring on the number of confinement for a maximum of 3 months or a fine of up to Rp. 7,500.00. This becomes a polemic because Perma is issued unilaterally by the Supreme Court which has implications in partial law enforcement. Therefore, further coordination between the Supreme Court, the Police and the Attorney Office is required in order to have synchronization and understanding between other law enforcers related to Tipring and the sanctions to be given to the perpetrators.Keywords: Mild Crime, Theft, Implementation

Abstract

In this study the issues to be discussed in are: Mining Investment Legal Certainty According to provisions of Act No. 4 of 2009 on Mineral and Coal and Act No. 25 of 2007 on Investment. Based on the results of this study are Legality exploitation of minerals statutory number number 4 Legality exploitation of minerals statutory number number 4 of 2009 substantially only in a form that permit, in contrast to the legality of the concession at the time of the enactment of Act No. 1, 1967, consists of a wide variety of forms namely mining Authority (KP) contract of work (COW), mineral and agreements coal mining works (PKP2B) and SIPDs for extractive industry and artisanal mining licenses for artisanal mining. Various legality at the time of the enactment of Act No. 11 of 1967, led to the coordination, supervision and control of less than the maximum, because every legality issued to a mining business activity carried out not in a good coordination. Prior to the issuance of Act No. 25 of 2007 is still a very significant difference between foreign investors and domestic investors. This is evident from the provisions of legislation. Foreign investment is regulated in Act No. 1 of 1967 concerning Foreign Investment whereas domestic investment stipulated in Act No. 6 of 1968 on Domestic Investment.Keywords: Rule of Law; Mining; Investment.

Abstract

Research by title of Model -Model Implementation Restorative Justice (Criminal Justice) With Case Crime Against Child Actors Child Rights Impact (Case To Handling Crime Cases With Child Abusers In Police Resort Big City Semarang). In tackling Restorative Justice with a child suspect. Based on the description in this Thesis, the issues that will be examined are: 1) Is the implementation of restorative justice in handling cases of crimes committed by the child can provide the fulfillment of the rights of the child? 2) What has been done by the Semarang City Police Force in the implementation of restorative justice and what is its impact on the fulfillment of children's rights?The results of the study concluded that: 1) Restorative justice programs can encourage children to be responsible for their actions, providing opportunities for children to replace mistakes made by doing good for the victim, providing opportunities for the victim to participate in the process, providing opportunities for children to be able to maintain relationships with families, to provide opportunities for reconciliation and healing in communities harmed by criminal acts. 2) Semarang City Police Department in carrying out restorative justice is by mediating the criminal case of child, implementation implementation is by diversion effort, that is settlement of child case from criminal justice process to process of justice outside of criminal court. The way to do this is to mediate between the perpetrator and the victim by involving lawyers, court parties and community leaders. Keywords: Implementation Of Restorative Justice, With Child Actors And Fulfillment Of The Rights Of The Child.

Abstract

Notary in performing his duties acting as public servant in the affairs of making the deed of agreement which is the will of the parties who want to make it. In order to improve notary services as much as possible one of them is with the notarys office itself. Notary obligation in implementing good corporate public notary principles must be consistent with Law Number 30 Year 2004 juncto Law Number 2 Year 2014 regarding Notary Position and referring to the Notary Code of Ethics, as well as from inventory office, employees, documentation and services to clients. The constraints often faced in carrying out the principles of office governance is arising from the notary itself and from employees, where the notary is involved in a criminal case that causes punishment and employees who act dishonestly in carrying out their work, thus causing harm to office management itself and become disorganized in its management.Keywords: notary, office
