Abstract

Abstract: Based on the action of al-Shafi’i that the Fatwa differs by the change of the [geographical] location. It was [even] said that this new Madh’hab [and Methodology] even started taking form just before he left Iraq to Mecca, others said [that it started to take form] before leaving Mecca, but what is definite though is that he wrote it and set its foundations in Egypt. Thus it has nothing to do with it being in Egypt or in Iraq. The consequence of this concept is that certain rules of Islam, would not apply, due to the new environment they live in, and that we live in a new time and age. So rules regarding riba, marriage, social interaction, international law, ruling systems, would need to be updated, according to the said principle. The proponents of this understanding use the example of Imam Shafi’i to legitimise their viewpoint.

Abstract

Today boarding schools (Pesantrens) are faced with issues of orthodoxy and liberation in religious thought. The thought of orthodoxy in boarding schools appears on attitude to literalism, dogmatism, normativism, sacrifaction, and etc. This can be seen from the dogma that “believed” by the pesantren community that what is on the yellow holy books is something that must be followed and believed. Yellow holy Book is considered sacred and should not be criticized. In addition, boarding schools are also faced with the challenge of the Liberal Islam, by bringing forward ratios and interpret religious texts in context. Doing the reading strategies of the religious text itself for continuity to make the production of new meanings that are relevant to contemporary conditions. From the womb of liberal Islamic thought is then born the terms of Islamic rational, Islam is an inclusive, pluralist Islam, Islam is tolerant and such. Here, there are two things that can be used as a portrait of a way of thinking students in developing their religious thought. First, the empowerment of reason in developing a religious paradigm. Reason, which, according to Mohammed al-Jabiri Abied as a means of growth and development of the Contemporary Arab civilization, as well as Islam. This method is more advanced logic in the view of religious issues. Second, accepting differences of opinion in matters that are Furu ‘(branch). This attitude is not a new thing, because Islamic scholars (scholars) used to the differences of opinion and polemic between them. Even Imam Shafi ’i admitted that his opinions are believed to be true, did not rule contain an error. Likewise, other people’s opinions, did not rule contains the truth. Abstract

The productive endowment based on its definition and concept, contains any provisions on the economy, because by doing productive endowment means transferring the wealth from the effort of consumption towards production and investment in a productive capital which can produce something that can be consumed in next times, either by individuals and groups. Thus, the productive endowment is saving and investing activities simultaneously. It includes any activities that may hold the property which can be utilized by waqif directly or after changing into consumer goods. Therefore, the waqf is an activity that contains many elements of future investments and develops the productive assets for future generations in accordance with the charitable purpose, in the form of benefits, services and utilization of the results. The depth review of the productive endowment was written by Monzer Kahf in his book, Al-Waqf al- Islami; Tathawwuruhu, Idaratuhu, Tanmiyyatuhu. He discussed about the definition of waqf, its history and jurisprudence waqf, the method of management of productive endowment, and its role in improving the welfare of the people and developing the Islamic institutions.

Abstract

All economic activity originated from human physical needs in orderto survive in this world. All purposes to survive desperately sought his own will,but if the needs to survive cannot be met by himself, so he has to take the socialinteraction in fulfilling his needs of life. This interaction represents the economic interactions including of demand and supply, consumption and production. Islamexplained that the earth and everything in it is the mandate of God to human inorder to be used as well as possible for the prosperity and welfare. Islam alsoteaches human to apply the economic activities in order to gain the pleasure ofAllah in its function as the caliph in this world.

Abstract

Terorisme kembali lagi datang mengancam bangsa Indonesia setelah terjadinya ledakan bom di Hotel JW Marriott, Ritz Carlton dan bom Bali beberapa tahun lalu. Dari peristiwa peledakan ini, dapat dianalisis bahwa serangan sengaja dilakukan di tempat-tempat umum dengan target yang jelas. Inilah sesungguhnya tipikal aksi terorisme yang terjadi di berbagai belahan dunia. Serangan 11 September terhadap WTC dan gedung Pentagon di Amerika Serikat, peledakan bom Bali, ledakan bom JW Marriott 1, peledakan bom di Hotel Marriott 2 dan Ritz Carlton memberikan bukti yang jelas bahwa terorisme membidik sasaran di tempat keramaian. Hal ini menandakan betapa aksi kekerasan yang terjadi sudah mulai mengarah pada aksi yang menimbulkan dampak massif dengan dilakukan oleh para pelaku yang terorganisir. Fenomena inilah yang mendorong penulis untuk membahas teroris, dalam perspektif normatif dan mengkomparasikan dengan konsep jihad. Selama ini para orientalis menganggap bahwa banyaknya terorisme yang terjadi karena seorang Muslim mempunyai konsep jihad. Jihad yang sebenarnya dalam konteks sekarang tidak mesti dilakukan dalam bentuk perang. Islam menolak semua pembenaran untuk perang duniawi, seperti kolonialisme, rasisme, ketamakan, dan ekspansi ekonomi. Di bawah pemerintahan Islam semua orang akan bekerja bersama-sama sebagai satu keluarga besar, menjadikan semua makhluk sebagai satu kesatuan tanpa tujuan- tujuan yang saling bertentangan. Abstract

The endowments as a mainstream of establishment of social justice and moslems welfare need to be empowered by exploring a number of economic potention and its supporting facilities, and developing the productive endowments assets. While the agency of endowments (waqf) which is spearheading of the waqf management has contributed greatly to achieve a just and prosperous society, through empowerment of productive endowments. This means making productive endowments as a medium to create economic justice, reducing poverty, developing the social of security system, providing health services, and developing educational facilities. Therefore, the waqf is a religious institution that has a direct functional linkage with the effort to solve the social and human problem. This phenomenon which makes the discussion of productive endowments is very urgent, especially if it is associated with the development of education. Amalan wakaf mencakup kegiatan menahan harta yang mungkin dimanfaatkan oleh wakif baik secara langsung maupun setelah berubah menjadi barang konsumsi sehingga tidak dikonsumsi saat ini, dan pada saat yang bersamaan ia telah mengubah pengelolaan harta menjadi investasi yang bertujuan untuk meningkatkan jumlah harta produktif. Karena itu, wakaf merupakan kegiatan yang mengandung unsur investasi masa depan dan mengembangkan harta produktif untuk generasi yang akan datang sesuai dengan tujuan wakaf baik berupa manfaat, pelayanan dan pemanfaatan hasilnya. Kajian mendalam tentang wakaf produktif, baik secara konsep maupun manajemen pengelolaannya dilakukan oleh Monzer Kahf dalam bukunya Al-Waqf al-Islami; Tathawwuruh, Idaratuh, Tanmiyyatuh. Buku ini membahas tentang definisi, sejarah dan fiqih wakaf, juga membahas tentang metode pengelolaan dan manajemen wakaf produktif, peran wakaf produktif dalam meningkatkan kesejahteraan umat dan dalam mengembangkan lembaga Islam, baik yayasan sosial maupun lembaga pendidikan.  Buku  ini  juga  membahas  tentang  reformasi  fikih Islam  dalam menyikapi perkembangan wakaf kontemporer, wakaf dalam aplikasi Undang- undang konvensional, dimensi ekonomi wakaf, metode pendanaan wakaf dengan cara menggalang bantuan dana publik, dan eksperimen terkini dalam memanaj wakaf produktif.

Abstract

This article examines the Islamic dialectics socio-culturallywhich inspires the establishment of Islam Nusantara. The method used in this research is qualitative with historical approach and included in the category of contemporary history. The step taken in this research is to reconstruct the tradition of IslamNusantara along with its cultural roots that lies behind it. The results show that: first, Islam has become the religion of most of the Indonesian people and has played many important roles in various social, political, economic, and cultural backgrounds. Secondly, Islam Nusantara is a typical Indonesian-Islamicstyle, which is a combination between Islamic theological teachings with the values of local traditions, cultures, and customs in this country. Third, the characters of Islam Nusantara show the existence of local wisdom in Indonesia that does not violate the teachings of Islam, instead they synergize the teachings of Islam with local customs scattered in Indonesia. Fourthly, Islam Nusantara is an Islamic practice in the country as a result of dialectics between shari'a text with local realities and culture. Therefore, Islam Nusantara comes not to change the doctrines of Islam, but to find ways how to embed Islamic values in the context of diverse cultural society.

Abstract

Artikel ini mengkaji tentang potensi filantropi kaum perempuan untuk membangun kemandirian dan pemberdayaan perempuan Indonesia. Metode yang digunakan adalah kualitatif dengan pendekatan fenomenologi. Data dalam penelitian ini diperoleh dengan menggunakan teknik observasi dan wawancara, yakni menggali way of life pelaku filantropi kaum perempuan dengan metode doing fieldwork. Hasil penelitian menunjukkan bahwa kedermawanan perempuan Indonesia mengalami perkembangan yang signifikan. Kedermawanan ini melibatkan banyak aspek sebagai resource dalam pengejawantahan kegiatan filantropi kaum perempuan. Dengan mengerahkan semua potensi yang ada, para pelaku filantropi perempuan menunjukkan kepada masyarakat bahwa perhatian terhadap orang-orang yang kekurangan dan membutuhkan bantuan sangat penting. Kaum perempuan dengan beragam potensi yang dimilikinya bisa digerakkan untuk menjadi donatur, volunteer, campaigner, atau bahkan fundraiser bagi lembaga-lembaga sosial di masyarakat. Aktivitas filantropi untuk kemandirian perempuan sangat berpotensi dengan menggerakkan potensi kaum perempuan sendiri sebagai donatur dan pendukung program tersebut. Bahkan filantropi kaum perempuan menjadi kontribusi yang signifikan baik secara ekonomi maupun sosial, yang menunjukkan peran perempuan sebagai agen perubahan sosial.
