Abstract

The objectives ofthis research aretoknow what theIndonesian government havedonetocreatethe harmonization oflaw in trade toward the establisment ofthe ASEAN Economic Community and toknow whatthe obstacles are facedby the Indonesian government to achieve the harmonization of lawin trade toward theestablishment theASEAN Economic Community. The result ofthis research concludes that the endeavors ofthe Indonesian government tocreate the harmonization oflaw in trade are undertaken trough harmonizing the tariffnomenclature; harmonizing the most-favoured nation tariff andharmonizing custom procedures. The obstacles faced by the Indonesiangovernment to achieve the harmonization oflawin tradeare overlapping between the local rule and the national rule; high economic cost candecrease thecompetitiveness ofexport products, theweakness of network system andnational distribution, the decreasing ofinvestment andinfrastructure quality.

Abstract

This paper aims to examine how the principle of retaliation in the case of a trade war between the United States and China is now happening. The General Agreement on Tariff and Trade (GATT) in the World Trade Organization (WTO) has regulated acts of retaliation in the context of international trade. Even though there are different conceptions of retaliation in the two international legal frameworks, they both recognize the retaliation action. The results of the study shows that the economic policies carried out by the United States are called trade remedies in the form of protestionism which aimed to minimize the negative impact of imports on domestic products. Furthermore, actions taken by China are one example of the remedial actions in the form of retaliation. WTO has a remedy mechanism which is divided into three types, namely: (a) the plaintiff withdraws or changes actions that are not in accordance with the WTO; (b) compensation; and (c) delaying concessions or commonly called retaliation.

Abstract

Rahasia dagang merupakan ‘jantungnya’ keberlangsungan sebuah bisnis. Oleh karena rahasia dagang  mempunyai posisi yang sangat vital, pelaku usaha berusaha melakukan proteksi sangat ketat. Pelanggaran rahasia dagang di Indonesia sebagian besar dilakukan oleh karyawan, dikarenakan lemahnya kesadaran karyawan untuk memenuhi kewajibannya dan akibat lemahnya perlindungan hukum. Dibutuhkan kontrak kerja yang mengikat Karyawan dan Pemilik Rahasia dagang untuk memberi batasan hak dan kewajiban serta sanksi sebagai bentuk perlindungan hukum rahasia dagang. Untuk mencapai tujuan itu digunakan metode penelitian hukum normatif untuk mengkaji urgensi kontrak kerja yang berkeadilan sebagai upaya perlindungan hukum rahasia dagang. Hasil penelitian ini menunjukkan bahwa dengan adanya kontrak kerja yang adil dapat menjadi alternatif upaya perlindungan hukum rahasia dagang; dikarenakan  hak dan kewajiban karyawan yang diatur secara mutual   menjadikan rahasia dagang dapat dilindungi secara optimal.

Abstract

The research problems are: first, implementation of open sky policy in the frame of flight service trade liberalization based on Act No. 1 of 2009 on Flight; second, the implication of enactment of open sky policy for Indonesia in the frame of flight service trade.This research is empirical legal research. The data used is primary and secondary data which are analyzed using editing analysis style technique later.This is caused by many factors which are: the government’s lack of preparation in protecting domestic flight industry by not providing clear regulation in determining tariff, the operator’s lack of preparation in conducting flight service, the lack of facility in pursuing open sky. There is economical, social, defense and security implication from the application of open sky policy for Indonesia. However, the most significant implication from these impacts is economy defense, and security implication.

Abstract

The aim of this study is to provide an academic framing of the philosophical foundation of the Most-favored-nation principle (MFN) in international investment law. The MFN principle is one of the most important principles in international law. In international investment law, MFN principle serves as a mechanism to create conditions in which foreign investors from many countries have equal opportunities to compete fairly in host country.

Abstract

AbstractThe purpose of the article are to analyze the development of the meaning of the principle of secret balance confidentiality of HIV / AIDS patients and analyze the ideal construction of its application in Indonesia. It is normative research.  Confidentiality does not change as Hippocrates Oath, including HIV/AIDS confidentiality. Application of the HIV/AIDS confidentiality develops in conformity with the development of values in society and medicine. The obligation to keep this secret is not an absolute obligation but a prima facie, until there is a greater obligation to be undertaken such as to protect the sexual partner or to protect the public interest. This principle of balancing is a generally principle. The Balance of Medical Confidentiality is a certainty of protection for humans, in this case health workers /doctors and PLWHA and also must be able to restore the balance of disturbed community order in the original state. The development of the meaning of the balancing of Medical Confidentiality in HIV/AIDS sufferers has taken place in the effort of combating HIV/AIDS embodied in the principles that include Councelling, Consent, Confidentiality, diagnosis Correct Test with the consequence to Conect to health service to Care Support and Teratment (5C). The ideal construction of the balancing HIV confidentiality is an effort to overcome the still-sensitive issues of high stigma and discrimination against PLHIV and the key population which is an obstacle to the decline in HIV / AIDS rates. The existence of punitive and criminal regulations causes barriers to test in health services. Its should be reviewed or deleted in order to reduce the barriers to the reach of health services in HIV/AIDS cases.Keywords: Balancing:, Confidentiality: HIVAbstrak Tujuan dari artikel ini adalah untuk menganalisa perkembangan makna prinsip keseimbangan  pasien HIV / AIDS dan menganalisa konstruksi ideal di Indonesia. Penelitian bersifat normatif. Kerahasiaan tidak berubah seperti Sumpah Hippocrates, termasuk kerahasiaan HIV / AIDS. Penerapan kerahasiaan HIV / AIDS berkembang sesuai dengan perkembangan nilai-nilai dalam masyarakat dan kedokteran. Kewajiban menjaga rahasia ini bukanlah kewajiban mutlak tapi bersifat prima facie, sampai ada kewajiban yang lebih besar untuk dilakukan seperti melindungi pasangan seksual atau untuk melindungi kepentingan umum. Prinsip keseimbangan ini adalah prinsip umum. Keseimbangan Kerahasiaan Kedokteran merupakan kepastian perlindungan bagi manusia, dalam hal ini petugas kesehatan / dokter dan ODHA dan juga harus mampu mengembalikan keseimbangan ketertiban masyarakat yang terganggu. Perkembangan makna keseimbangan rahasia kedokteran pada penderita HIV / AIDS telah terlaksana dalam upaya pemberantasan HIV / AIDS yang tercakup dalam asas yang mencakup Konseling (Councelling), persetujuan (Consent), kerahasiaan (Confidentiality), test yang benar (Correct Test) dengan konsekuensi dihubungkan ke layanan , dukungan dan terapi (Conect to health service to Care and Treatment). Pembangunan yang ideal untuk menyeimbangkan kerahasiaan HIV adalah upaya untuk mengatasi isu-isu stigma dan diskriminasi terhadap ODHA dan populasi kunci yang merupakan hambatan bagi penurunan tingkat HIV / AIDS. Adanya peraturan hukum yang bersifat punitif dan kriminal menyebabkan hambatan dalam melakukan tes kesehatan. Ini harus ditinjau atau dihapus untuk mengurangi hambatan terhadap jangkauan layanan kesehatan dalam kasus HIV / AIDS.Kata kunci: Menyeimbangkan; Kerahasiaan; HIV

Abstract

AbstractThis paper purposes to analize the idea for establishing ASEAN cross border insolvency regulation as a solution of cross-border insolvency problem in ASEAN. It is a legal research viewed from descriptive analytic. The result of this paper indicates that the absence of uniformity or harmonization of insolvency law in ASEAN region will inflict some problems which are relating to the procedure of recognition and enforcement of a foreign insolvency. The regulation as a solution of cross-border insolvency in the ASEAN region is expected to become a facilitator for resolving problems and reducing uncertainty in cross-border insolvency cases. Jenis penelitian hukum ini adalah penelitian hukum normatif yang bersifat deskriptif. Hasil penelitian ini menunjukkan bahwa tidak adanya keseragaman atau harmonisasi hukum kepailitan di kawasan ASEAN menimbulkan permasalahan yang berkaitan dengan prosedur pengakuan dan pelaksanaan putusan kepailitan asing. Kehadiran sebuah pengaturan hukum sebagai solusi dari permasalahan kepailitan lintas batas di kawasan ASEAN sangat diharapkan untuk dapat menjadi fasilitator dalam menyelesaikan permasalahan dan dapat mengurangi ketidakpastian dalam perkara kepailitan lintas batas. Abstract

In Indonesia, the Corporation is already recognized as one of the perpetrators of criminal acts in a variety of specific criminal acts and regulations, including in the Fisheries Act. Article 1 paragraph (14) Act No. 31 of the year 2004 jo Act No. 45 of the year 2009 about fisheries States that every person is a person, the individual or Corporation. This research is normative juridical research. The approach used is statute approach.The results showed that in the theory of criminal law, there is some form of the position of the Corporation as the perpetrator of a criminal offence may be subject to iability. The purpose of this study is to examine how the legal position of the Corporation as the perpetrator of the criminal offence of fishing in Indonesia. This research is the normative legal research. The data used are secondary data, while data collection is done through the study of the literature. Abstract

AbstractRules of origin is used to determine the origin of products in order to receive preferential tariff facility. It means that only the products which are from certain countries or certain region that have been bound the preferential trade agreements which entitled on the preferential tariff. Moreover, rules of origin also plays the role to prevent trade deflection. In this context, it becomes the mechanism to preclude import products that do not originate from a particular countries or region through the state which applies the lowest external tariff. Therefore, regulating rules of origin in each country bound the preferential trade agreement is needed. This research examined how Indonesia regulated rules of origin in its national legal order and the legal problems arose from its regulation. Indonesian rules of origin defined limited to technical rule. As a result, Indonesia has the potential to be harmed in international trade traffic. In addition, institutional problem is also a matter of concern. Because Indonesia does not have a special agency dealing with rules of origin, thus it creates difficulty for many parties, not just the perpetrators of international trade, but also the government.Keywords: rules of origin, regulation, legal problems, IndonesiaAbstrakRules of origin adalah mekanisme yang digunakan untuk menentukan asal produk dalam rangka mendapatkan fasilitas tarif preferensial. Hanya produk-produk yang berasal dari negara tertentu yang telah terikat pada satu perjanjian preferensial saja yang dapat menikmati tarif preferensial. Selain itu, rules of origin juga berfungsi untuk mencegah defleksi perdagangan. Dalam konteks ini, rules of origin menjadi mekanisme pencegahan masuknya produk-produk yang bukan berasal dari kawasan tertentu melalui negara yang menerapkan tarif eksternal paling rendah. Oleh sebab itu, pengaturan rules of origin di setiap negara yang terlibat dalam perjanjian perdagangan preferensial sangat diperlukan. Penelitian ini bertujuan untuk mengetahui pengaturan rules of origin di Indonesia dan masalah-masalah hukum yang ditimbulkan dari pengaturan tersebut. Hasil penelitian menunjukkan bahwa Indonesia belum memiliki aturan rules of origin yang bersifat komprehensif. Aturan mengenai rules of origin di Indonesia masih dimaknai sebatas aturan teknis saja. Akibatnya, Indonesia berpotensi untuk dirugikan dalam lalu lintas perdagangan internasional. Selain itu, masalah kelembagaan juga menjadi hal yang perlu diperhatikan. Indonesia belum memiliki lembaga yang khusus menangani rules of origin, sehingga hal ini menyulitkan banyak pihak, tidak saja pihak pelaku perdagangan internasional, tapi juga pihak pemerintah.Kata kunci: rules of origin, pengaturan, masalah hukum, Indonesia.
