Abstract

Tujuan penelitian ini adalah untuk mengetahui apakah sistem pemidanaan undang-undang informasi dan transaksi elektronik dalam menanggulangi cyberbullying di sosial media telah berjalan efektif dan efisien karena dengan merujuk pada prinsip maksimalisasi, keseimbangan dan efisiensi? Penelitian ini menggunakan pendekatan yuridis doktrinal. Hasil penelitian menjelaskan bahwa Pasal 27 Jo Pasal 45 dirumuskan tidak melalui pengkajian dengan pendekatan analisa ekonomi mikro sehingga penegakan hukumnya tidak efektif dan efisien karena dengan merujuk pada prinsip maksimalisasi, keseimbangan dan efisiensi dan tidak mencerminkan falsafah bangsa dan negara Indonesia yakni Pancasila.

Abstract

Kejahatan Human Trafficking merupakan permasalahan baik bersifat nasional maupun global, karena modus operandi yang terus berkembang dan bersifat transnasional. Indonesia dan Negara ASEAN lainnya juga tidak luput dari kejahatan Human Trafficking. Tujuan Artikel ini adalah memberikan penjelasan Instrumen hukum dalam menanggulangi Kejahatan Human Trafficking di kawasan ASEAN telah Harmoni dan jika belum bagaimana solusinya. Rumusan masalah dalam artikel ini yakni apa ada upaya harmonisasi instrument hukum dalam menanggulangi kejahatan Human Trafficking di kawasan ASEAN? Penelitian ini menggunakan metodelogi yang digunakan adalah Yuridis Doctrinal. Dalam Pembahasan saat ini ditemukan problematika upaya harmonisasi intrumen hukum dalam menanggulangi kejahatan Human Trafficking adalah sistem hukum yang berbeda, daya berlaku hukum suatu Negara hanya berlaku secara territorial Negara tersebut sehingga tidak dapat menjerat pelaku kejahatan Human Trafficking yang dilakukan di Negara lain yang mana dampak atau korbannya meliputi warga Negara lain, selain itu diantara Negara-negara di ASEAN belum semuanya memiliki perjanjian extradisi antara satu dengan lainnya. Selain itu, ditemukan perlunya dibentuk regulasi bersifat unifikasi dan harmonisasi hukum yang mengikat semua Negara Anggota ASEAN. Perlunya di Bantuk Badan Penyelesaian Sengketa Dalam Memutus Kompetensi Mengadili Pelaku Kejahatan Human Trafficking jika merugikan atau melibatkan korban lintas Negara ASEAN. Guna menjamin dipatuhinya regulasi yang bersifat unifikasi dan harmonisasi sebagai upaya menanggulangi kejahatan Human Trafficking perlu di bentuk Dewan ASEAN baik bidang eksekutif, legislatif serta Yudikatif seperti Lembaga Regional UNI EROPA. Abstract

Tujuan Penelitian ini adalah untuk mengetahui apakah tindakan pemerintahan (bestuurshandeling) berdasarkan diskresi dapat dikategorikan telah melakukan tindak pidana korupsi ataukah tidak. Penelitian ini menggunakan pendekatan yuridis doktrinal. Hasil penelitian menjelaskan bahwa ditinjau baik secara legal formal yang berupa UU PTUN, UU ASN, UU Administrasi Pemerintahan, doktrin-doktrin hukum serta adanya Putusan judicial review Mahkamah Konstitusi RI Nomor: 25/PUU-XIV/2016, Pertanggungjawaban tindakan pemerintahan (bestuurshandeling) yang bersumber dari diskresi (Freies ermessen) yang mengandung unsur penyalahgunaan wewenang berakibat pada kerugian negara tetapi tidak terdapat unsur korupsi seperti gratifikasi, suap, maka dapat dipertanggungjawabkan dengan sanksi administrasi sesuai dengan ketentuan UU Administrasi Pemerintah Pasal 20 ayat (6) dan Pasal 80 ayat (1) Jo Pasal 81 ayat (3) secara seimbang dan kasuistik. Apabila terdapat unsur penyalahgunaan wewenang yang berakibat pada kerugian negara serta terdapat unsur korupsi seperti gratifikasi, suap, maka dipertanggungjawabkan secara hukum pidana khususnya tindak pidana korupsi.The purpose of this research was to whether the actions of government (bestuurshandeling) based on its discretion can be classified as a criminal act of corruption or not. The Methodology of this research used juridical doctrinal. The result showed that based on legal frame such as Law of The Administrative Court, Law of ASN, Law of Government Administration and legal doctrines as well as the Decision of the judicial review of the Constitutional Court Number: 25 / PUU-XIV / 2016 responsibility of governmental actions (bestuurshandeling), which comes from discretionary (Freies ermessen) containing elements of abuse of authority resulting state loss but there is no element of corruption such as gratifications, bribe, then it can be accounted for by the administrative sanctions under the Law of Government administration Article 20 (6) and Article 80 paragraph (1) Jo Article 81 paragraph (3) in a balanced and case by case. If there is an element of abuse of authority that resulted in state loss and there are elements of corruption such as gratifications, bribe, then accounted for under the criminal law, especially corruption.

Abstract

This article aimed to observe the criminal provisions both in the Formulation of the EIT ACT 2008 along with the verdict of the judicial review of the Constitutional Court Number 50/PUU-VI/2008 as well as the EIT ACT  2016 especially in strictly contained in article 27 along with the norm of the criminal sanctions contained in Article 45 can still be said to be a ”Rubber Articles”, so it requires linguist and religious leaders in order to get a description or explanation of a remark or action in conflict with religious values and modesty as well as decency in public life. The Guarantee Of Freedom Of Speech. Then when viewed from the highest norm of the 1945 Constitution to the level of the law that is Article "Number 9 of 1998 and Article Number 39 of 1999 there is a harmony of norms and limits of freedom of speech that is the norms and values of religion, morality, public order, public interest and the integrity of the State, the concept of punishment against the actions of cyberbullying in social media in the future require an integral approach and the concept approach is criminal on parole and penal mediation with the terms limitedly and imperative.

Abstract

The purpose of this research was to whether the actions of government (bestuurshandeling) based on its discretion can be classified as a criminal act of corruption or not. The Methodology of this research used juridical doctrinal. The result showed that based on legal frame such as Law of The Administrative Court, Law of ASN, Law of Government Administration and legal doctrines as well as the Decision of the judicial review of the Constitutional Court Number: 25 / PUU-XIV / 2016 responsibility of governmental actions (bestuurshandeling), which comes from discretionary (Freies ermessen) containing elements of abuse of authority resulting state loss but there is no element of corruption such as gratifications, bribe, then it can be accounted for by the administrative sanctions under the Law of Government administration Article 20 (6) and Article 80 paragraph (1) Jo Article 81 paragraph (3) in a balanced and case by case. Abstract

According to the constitution, the state concept in constitutional practice can be divided into two opposite poles, namely welfare and liberal state. They have different characteristics in which the first concept (welfare state) requires a strong and extensive state functions to regulate an economic justice, on the contrary the second concept (liberal state) relies on the free market economy which state’s role should be marginalized. Sosio-legal research is used in this article. Based on the Article 33 of Indonesian post constitutional amendment of 1945, Indonesia embraced the concept of welfare state. Yet, the practice sociologically tends to embrace a liberal state that is not suitable with the welfare of the people. There are challenges, in the context of liberal state, faced by Indonesia, such as applying the capitalist economic system. We may fight the capitalist economic system by two legal policy, namely: first one, we may re-create the role of state functions as a controller and regulator of the economy. The second one, we may increase the state income through taxes along with the higher social spending to achieve the social welfare and economic justice.Keywords: welfare state, the constitution of 1945, legal policy

Abstract

The purpose of this study is to determine whether there are implications of expanding the authority of the pretrial post-verdict judicial review of Constitutional Court in deciding whether it is a valid determination of the suspect against law enforcement and the protection of the rights of the suspect. This research belongs to normative research. The results of this study explain that the interpretation method used in pretrial decision  No:04/Pid.Prap/2015/PN.Jak.Sel is the method of discovery of analogy interpretation law (argumentum per analogiam) is wrong, while the legal interpretation method used in the judicial review judgment of the Constitutional Court of the Republic of Indonesia Number 21 / PUU-XII / 2014 is the historical interpretation method (historiche intepretatie) the problem namely, the Constitutional Court has exceeded its original function that is negative legislator became positive legislators form or add a new norm. So that raises the problem that is contrary to the principles of the criminal justice system that is the principle of quick and simple and low budget justice and the principle of litis finiri oportet also inhibits the process of law enforcement settlement.

Abstract

Abstract           The liberalism principles have influenced the whole life aspects of the nation and the state of Indonesia. On the political aspect, the principles influence the elections in Indonesia from the lowest (village head election) to the highest (presidential election) levels. The liberal principles are not in accordance with the principles of Pancasila as the national philosophy and the source of law (staatsfundamental norm) of Indonesia.  The liberal democratic principles cause high cost democracy. They create the conditions of ?free fight? and ?homo homini lupus?, as well as many potential corruption practices in villages. In addition, it can lead to the most worrying issue ?the damage of values of Pancasila.Implikasi Pengaruh Globalisasi atas Diseminasi Prinsip-Prinsip Demokrasi Liberalisme terhadap Prinsip-Prinsip Demokrasi Lokal (Desa) berdasarkan Pancasila di Indonesia AbstrakPengaruh prinsip-prinsip liberalisme telah mempengaruhi seluruh bidang kehidupan bangsa dan negara Indonesia. Pengaruh dalam bidang politik dapat ditemukan pada pemilihan umum yang dilakukan secara voting baik tingkat pemilihan presiden hingga tingkat pemilihan kepala desa di Indonesia, tentunya hal tersebut tidak sesuai dengan Prinsip Pancasila yang merupakan falsafah bangsa dan sumber hukum (staatsfundamentalnorm) di Indonesia. Dampak diseminasi prinsip demokrasi liberalisme melalui voting menyebabkan demokrasi dengan biaya tinggi (high cost) menciptakan kondisi free fight dan homo homini lupus serta banyaknya potensi praktik korupsi di desa dan hal yang paling mengkhawatirkan adalah terjadinya pengikisan nilai-nilai yang terkandung dalam Pancasila.Kata Kunci: Globalisasi, Pancasila, Prinsip Demokrasi LiberalDOI: https://doi.org/10.22304/pjih.v6n2.a8
