Abstract

Islamic banking in Indonesia has experienced significant growth, including assets, financing provided and the number of customers. Islamic bank financing 70-80% is given to the community by using the contract of murābahah, in the form of consumptive and productive. Islamic bank operations must be guided by Fatwa of the National Sharia Council in order to carry out its optimal function economically and to run the Shari'a comprehensively. Therefore, this article will explain about the concept of murābahah conceptually and application in Islamic Bank in Indonesia. The purpose of writing this article so that the implementation of Murābahah contract in Islamic Bank in Indonesia can be in accordance with the principles of Shari'a that put forward the principle of justice and no party is harmed

Abstract

Islamic Financing Products have started to grow rapidly in the current banking and financial industry at this time. This situation can be seen through the increase of Islamic banking assets for several years, in addition to the inclusion of more institutions offering Islamic products. Sharia Gold Pawn Products is the delivery of marhun (collateral goods) from the rahin (customers using mortgage financing) to the bank as a guarantee of part or all of the debt. This research is field (field research) with data collection method through observation, interview and documentation study in data collection. The author concludes that the application of Rahn's contract on Sharia gold mortgage financing at Bank BRI Syariah has been in accordance with the National Sharia Board Fatwa and there are several things that must be improved so as not to conflict with Sharia principles

Abstract

This article is the writer’s team thinking result about the importance (urgency) of Islamic law or sharia sources Madasir al-Ahkam al-Mukhtalaf Fiha (ijtihad postulates which are disputed) which focused on Istishab, Sadd al-Dzari’a, and Qaul al-Sahabi. Nowadays, there are still many of Indonesian who are not understand well yet or even not understand at all about these Islamic law sources. This article uses data collection method by observation and library data which then analysed by using inductive, deductive, and comparative method. This article purposes to give knowledge to the readers about Istishab, Sadd al-Dzari’a, and Qaul al-Sahabi, which then can be applied in living their life as a Moslem.

Abstract

Bay‘ al-‘īnah is a buying and selling contract that becamethe debate of classical and contemporary scholars interms of law and its implementation. Therefore, it isnecessary to have an article describing the concept ofbay‘ al-‘īnah to determine the law of the bay‘ al-‘īnah. Inthis article the author will explain the concepts, laws andapplications of bay‘ al-‘īnah according to contemporaryschools and scholars by stating their reasons forchoosing strong opinions. The fuqaha agree to forbidthe bay‘ al-‘īnah if there is a condition that ma‘qud ‘alayhmust be resold to the seller of origin. Likewise, if thereis a hint of the existence of ḥīlah do the usury then thelaw also is void. What is fuqaha debate is that if there isno such requirement and no referent. In this case theauthors hold that the bay‘ al-‘īnah contract is haram if theintention of doing usury is not stated in contract.However, the status of the contract is valid or not voidas long as there is no requirement of mabī‘ to be resoldto the original seller and the absence between the twoparties who intend to do usury. This is because with theintention, although outside the contract then theintention of usury has been declared and can cancel thecontract.Keywords: Murābaḥah, Instrumen Pembiayaan, KeuanganIslam Modern

Abstract

Islam as a comprehensive religion has regulated the Shari'a for the conduct of all human actions which the Shari'a is universal and its use is not limited by the times. There are four main sources in the determination of law in Islam, namely Alquran, Sunnah, Ijma and Qiyas. Apart from the source of the law, there are several methods used by ulul Usul Fiqh to determine the law on a new problem. The issue in this research is whether the methods of ijtihad such as Istihsan, Maslahah Mursalah, Urf, and Syar'u man qablana can be accepted and allowed by the Ulema Ushul fiqh in determining a law? What is the success in Islamic law? And how is it applied in human life and activity? The method used in this paper is the library study method. The results of the research obtained that Istihsan, Maslahah Mursalah, ?Urf, and Syar?u man qablana are part of Islamic Shari'a. Despite the differences of opinion among the scholars regarding the ability to use the ijtihad methods. There are those who directly allow, some also give certain conditions in the process of determining the law. Described the arguments that strengthen the opinions of the scholars in issuing their fatwa. There are also examples of the implementation and application of the ijtihad method both at the time of the Prophet's best friend and in the present in accordance with the true Islamic Shari'a

Abstract

Islamic economics is a science that combines economics with the principle of Sharia. The development of Islamic economic thought has begun from the time of the Prophet Muhammad. In writing this article aims to find out the economic scholars of  Islam and their contribution in its development. The author distributes Islamic economic scholars in two categories Classical and Contemporary. In the classical Islamic economic scholars include; Zayd ibn ‘AlÄ«, AbÅ« ḤanÄ«fa, AbÅ« YÅ«suf, al-GhazālÄ«, Ibn Taimiyah, Ibn Khladun, Ibn Qayyim, Shah Wali Allāh al-NaḍwÄ«, Muhammad Abduh and Muhammad Iqbal. When Contemporary Islamic economic scholars are distributed in 3 categories, Iqtiṣādunā (Baqir al-Sadr), Mainstream (Muhammad Abdul Mannan, Nejatullah Siddiqi, Syed Nawab Heider Naqvi and Monzer Kahf), and Alternative (Timur Kuran). Abstrak: Ekonomi Islam merupakan ilmu pengetahuan yang menggabungkan antara ilmu ekonomi dengan prinsip ajaran Syariah. Perkembangan pemikiran dan ilmu ekonomi Islam sudah bermula dari zaman Rasulullah SAW, Sahabat sampai saat ini. Dalam penulisan artikel ini bertujuan untuk mengetahui tokoh ekonomi Islam dan kontribusi mereka dalam pengembangannya. Penulis membagikan tokoh ekonomi Islam dalam dua kategori Klasik dan Kontemporer. Dalam tokoh ekonomi Islam Klasik, yaitu Zaid bin Ê»AlÄ«, AbÅ« ḤanÄ«fah, AbÅ« YÅ«suf, al-GhazālÄ«, Ibn Taimiyah, Ibn Khladun dan Ibn Qayyim, Shah Wali Allāh al-NaḍwÄ«, Muhammad Abduh dan Muhammad Iqbal. Abstract

Belief system that can be received well by humans, either worldly (secular) and the hereafter (hereafter oriented) has two specific characteristics. These characteristics are: first, the belief system is flexible to adapt to different places and times, but still able to maintain the value of its authenticity. If not, the belief system will be destroyed or can be fused with other systems. The second characteristic, the system is ideal, sometimes even Utopian (fantasy), and is also able to set the imperfections of human and can be applied in human life, such as politics and economics. So we will have a better view on a system that originated from medieval times to survive and advance rapidly in the global economy. This article will discuss the history and evolution of religion, encompass about the mechanisms of Islam that is able to adapt to changing times, and the adaptation of Islam to the modern financial and economic system.

Abstract

Ada beberapa definisi dari perbankan syariah dalam arti sempit yaitu bebas bunga. meskipun melawan perintah riba adalah landasan keuangan Islam tapi perdebatan tentang kata "Riba" justru masih terus-menerus. sejak awal kedatangan Islam, mayoritas ulama telah mengadopsi definisi yang ketat dari riba, bahwa semua bentuk bunga dapat dikatakan riba. tetapi perdebatan terus berlangsung hingga sekarang. beberapa pendapat (termasuk tokoh seperti Mufti Mesir, Muhammad Sayyid Tantawi Atiyya) menolak definisi ini dan berpendapat bahwa Islam mentolerir tingkat bunga yang wajar. Oleh karena itu, artikel ini akan menjelaskan tentang riba dan signifikansi. kemudian akan menjelaskan tentang gharar (larangan riba yang mirip dengan masyarakat yang tidak diketahui juga, serta pendekatan agama dan sekelur pada isu-isu ini. Abstract

Sistem kepercayaan yang bisa diterima baik oleh manusia, baik duniawi (sekuler) dan akhirat (selanjutnya berorientasi) memiliki dua ciri khas. Ciri-ciri ini adalah: pertama, sistem kepercayaan fleksibel untuk beradaptasi dengan berbagai tempat dan waktu, namun tetap bisa menjaga nilai keasliannya. Jika tidak, sistem kepercayaan akan hancur atau bisa menyatu dengan sistem lain. Karakteristik kedua, sistem ini ideal, kadangkala bahkan Utopian (fantasi), dan juga mampu mengatur ketidaksempurnaan manusia dan bisa diterapkan dalam kehidupan manusia, seperti politik dan ekonomi. Jadi kita akan memiliki pandangan yang lebih baik mengenai sistem yang berasal dari abad pertengahan untuk bertahan dan maju dengan cepat dalam ekonomi global. Artikel ini akan membahas sejarah dan evolusi agama, Islam dan adaptasi Islam terhadap sistem keuangan dan ekonomi modern.

Abstract

Islamic financing products have been growing rapidly in the banking and financial industry recently. This situation can be seen through the growing number of Islamic banking assets only in several years. Besides, there is also significant growing number of institutions that offer products according to Islamic systems. Murabahah financing products according to Ibn al-Humam is a contract of delivery of goods owned and sold by a person, based on the original price stated in the first contract that increase the profits and declared to the buyer. This study aims to determine the application of working capital financing murabahah bi al-wakalah Bank Muamalat Indonesia Branch Sungkono Surabaya according to Fatwa DSN No. 04 / DSN-MUI / IV / 2000 and Bank Indonesia regulation no. 7/46 / PBI / 2005. In this research the author employed several methods to collect the data including observation, interview and documentation. The author concludes that the implementation of working capital financing murabaha bi al-wakalah at Bank Muamalat Indonesia Branch Sungkono Surabaya is in accordance with the Fatwa DSN No. 04 / DSN-MUI / IV / 2000 and Bank Indonesia regulation no. 7/46 / PBI / 2005.
