Abstract

Abstract: Residuary heirs are groups that are not specified portion size. The impact of this provision, there is no residuary get the final after being given to the heirs ashab furudh. Case ‘aul accords to Ibn Abbas because when there is no shortage of treasures then ashab furudh impure group that will be shared at the end. Ashabul impure furudh this is a group that on other occasions either be a residuary. This article wants to know the position of the case of a residuary aul according to Ibn Abbas and investigated the reasons of the opinion of him.ملخص: ورثة تكميلي هي المجموعات التي لا يتم تحديد حجم الجزء. تأثير هذا الحكم، وليس هناك تكميلي الحصول نهائي بعد أن تقدم لبقية الورثة الأشهب. القضية وفقا لابن عباس لأنه عندما لا يكون هناك نقص في الكنوز ثم المجموعة الأشهب نجس بقية من شأنها أن تكون مشتركة في نهاية المطاف. الصحابة من بقية هذه ليست مجموعة نقية في أوقات أخرى يكون راحة جيدة تكميلي ريث دون أصدقاء وبقية هناك أصدقاء. الكتابة هي معرفة موقف في حالة تكميلي المتبقية وفقا لابن عباس والتحقيق في أسباب رأي ابن عباس.Kata Kunci: Ashabah, ‘Aul

Abstract

Rukun Islam yang kedua yaitu sholat, salah satu syarat sahnya sholat adalah menghadap ke arah kiblat. Bagi orang-orang berada di Mekah dan sekitarnya perintah yang demikian ini tidak menjadi suatu permasalahan karena dengan mudah dapat melaksanakan perintah tersebut, namun bagi orang-orang yang jauh dari Mekah tentu timbul permasalahan tersendiri. Arah kiblat yang menyimpang beberapa derajat saja, maka akan berakibat melenceng secara signifikan arah kiblat dari yang seharusnya tepat menuju Mekah (Ka’bah) menjadi ke arah lain yang bukan Mekah (Ka’bah). Hal ini tentu akan mengurangi kemantapan dalam melaksanakan ibadah, utamanya adalah keyakinan akan sah atau tidaknya salat yang dikerjakan. Observasi awal kami mengenai arah kiblat di Masjid Istiqlal Desa Ibul Besar III Pemulutan ogan ilir ini mengalami penyimpangan beberapa derajat ketika di Uji dengan Kompas Biasa, oleh karena itu peneliti tertarik untuk meneliti bagaimana Riwayat Penentuan arah Kiblat di Masjid Istiqlal Desa Ibul Besar III, Kecamatan Pemulutan, Kabupaten Ogan Ilir? bagaimana ketepatan arah kiblatMasjid Istiqlal Desa Ibul Besar III, Kecamatan Pemulutan, Kabupaten Ogan Ilir.

Abstract

This research examines the provision of Waqf Land in Indonesia and its implementation in Palembang City. The aim is to identify obstacles in its implementation while finding solutions so that the management of waqf land can be more productive by the desires of the Waqif (Waqf Doer).The results of the study find out that the Regulation made by the Directorate General of Islamic Community Guidance Number 75/1978, which regulates the Format and Content of Endowments Pledge, contains weaknesses that may hinder the productivity of waqfland. This is indicated by the format of the W2 and W3 form models which limit the uses of the WaqfLand, giving an interpretation that the Nazir (Waqfmanager) may not add the Waqf object to other uses. In the future, the format and the substance of AIW, which become the basis for Nazirin managing the Waqf, must be made in such a way that Nazhir has the freedom to develop the use of Waqfland more productively by the wishes of the waqif and the WaqfAct. Apart from the weaknesses above, the implementation of the Ikrar Tanah WaqfAct in Palembang, especially for the Mosque waqf, have been running well and productively.

Abstract

The causes of Islamic inheritance relationship are relationship nasab, marital relations, wala 'and the same religion relationship. Furthermore, the relationship causes a barrier of inheritance is for murder, different religions and slavery. From the above explanation if there are reasons the above relationship, it will cause a person entitled to be heirs and vice versa if there are causes obstructions inheritance, it will be blocked to inherit each other. If the heirs  is not Moeslem and during heirs lifetime, and then heir embrace Islam, Mualaf. after He or She died while the inheritance is not devided yet. In this case there is a opinion of Imam mashab, which is the opinion of Imam Ahmad who argue are not blocked and the right to become heir. Based on the purpose of this research was conducted to know hikmahtut tasyri, Mualaf after the heir dies become heir. The Type of This research is a library (library research) by reviewing the current literature sources as data sources, which are analyzed descriptively qualitative. From results of this research, we concluded that hikmah tut tasyri Expected increase the confidence and faith of Islam heirs Mualaf, so strengthening his or her Islam. This is in keeping with religion. Adding and strengthen kinship between the heir to the heir who had died because there are two relationships that the same religion relationship and incest. These conditions will maintain the benefit of ancestry, making tranquility of life and love among the heirs.
