Abstract

The strength of the evidence of Electronic Media (teleconference) in the process of proving a criminal case according to the Criminal, specify a limited manner valid evidence and procedures for the use of that evidence thus have legal power of proof. Proof via electronic media (teleconference) regulates the judge / magistrate constitutional obligation to seek and find the truth so that the material taken into consideration for the judges in deciding a case. Implementation of evidence through electronic media in a criminal act, should the judge may use the priority when it will use the values ​​of the basic purpose of the law (justice, expediency and certainty) to accommodate the evidence through electronic media in examining the crime of existing.

Abstract

Selection for commission member of Central Indonesian Broadcasting is administered by house of representative; nonetheless, the implementation is managed by the selection committee formed by the ministry of Communication and Information. The house of representative will conduct proper test to selection committee in order to examine the element of community and academic capacity within broadcasting field. Indonesian Ministry of Communication and information as the official has unjustly determined lists of Central Indonesian Broadcasting Commission Member candidates that has passed proper test selection by the house of representative. As a result, it harms those who do not qualify. The non-transparent determination violates the applicable laws and general principles of good governance so that it has harmed the rights and interests of some prospective members of the Central Indonesian Broadcasting Commission who have spent their energy, thoughts and time, as well as costs to participate in the selection

Abstract

Proof via electronic media in criminal trials, still based on the provisions contained in the Code of Criminal Procedure, namely with reference to the theory of proof under the law negatively, but in practice there is still a criminal trial the pros and cons. However, in fact the truth of the witness examination teleconference remain equal value, with a witness who was not present at the trial because the witness has been sworn in. Keywords: Electronic Media in the criminal justice system.   Abstrak Pembuktian melalui media elektronik dalam persidangan pidana, masih didasarkan pada ketentuan yang terdapat dalam Kitab Undang-Undang Hukum Acara Pidana, yaitu dengan mengacu pada teori pembuktian berdasarkan hukum secara negatif, tetapi dalam praktiknya masih ada persidangan pidana pro dan kontra. Namun, sebenarnya kebenaran teleconference dari pemeriksaan saksi tetap bernilai sama, dengan saksi yang tidak hadir di persidangan karena telah saksi telah ditetapkan. Kata kunci: media elektronik; sistem; peradilan pidana
