Abstract

Pasca tambang, pariwisata merupakan salah satu bidang yang sedang dikembangkan oleh hampir seluruh pemerintah daerah yang ada di Provinsi Kepulauan Bangka Belitung, termasuk Kabupaten Bangka Selatan. Salah satu daerah yang menjadi gudang destinasi berupa pantai di wilayah ini adalah Desa Pasirputih, Kecamatan Tukak Sadai. Berbagai upaya yang dilakukan oleh masyarakat dan pemuda desa setempat selama ini ternyata belum cukup mampu mendatangkan minat wisatawan untuk datang berulang kali ke destinasi wisata yang ada di sana, utamanya wisatawan yang berasal dari luar Pulau Bangka. Oleh sebab itu, penting untuk melakukan sosialisasi, mobilisasi & pendampingan Desa Pasirputih dengan menggarap model destinasi wisata berbasis kearifan lokal potensi bahari & sustainable green tourism. Sebagai upaya lanjut untuk menggali potensi kearifan lokal yang dimiliki, diadakan workshop dan focus group discussion (FGD). Setelahnya, dicanangkan Pasirputih sebagai desa wisata berbasis kearifan lokal, potensi bahari, dan sustainable green tourism. Melalui beberapa kegiatan yang sudah dilakukan, tercipta beberapa hal, seperti semobayan Pasirputih Berseri (Berbudaya, Religius, Santun, Elok, Ramah dan Indah), komitmen untuk penguatan identitas Melayu di kawasan wisata, formulasi atraksi wisata, dan pembuatan website desa wisata

Abstract

As a financial institution which as intermediating function, bank has to re-distribute credits relied on collected funding from the people, thus the funding circle works properly. Article 2 Banking Law decrees that in applying duties Indonesian banking as based on Pancasila and Constitution of Republic of Indonesia 1945 of years by using orudent principal. Ignorance of prudential banking in credit distributional process contained in 5C principle and other well-known principles lead to the danger in the existence of banking industries

Abstract

Mining is one of the sectors that becomes an economic country’s support until now. Environmental issues is kind of difficult things and can’t even be separated from mining activities. Belitung island is as part of the largest tin-producing province in Indonesia that has been exploited since the 18 century. It also has experienced the environmental crisis as well as other mining areas has in Indonesia. This research is conducted as an effort to discover and unravel the problematic implementation of reclamation on the ex-tin mine’s land in Belitung Island by using a conceptual approach and legislative approach. Based on the observation’s result, it shows that the reclamation’s result in Belitung Island has not been successful. Data from PT Timah (Persero) Tbk about the reclamation in Belitung Island also shows that the realization is far from the plan. There is no target that achieved successfully every year, also there is no reclamation that reaches 50 percent, the maximum is only 25 percent in 2016. th

Abstract

Most People around this country must have their own ways and mechanism for land issues before the form of written legislation is being publicized including people in Bangka Island. For example, the plantation land in Pasirputih Village, Tukak Sadai District, South Bangka Regency is arranged orderly. There are several requirements that must be obey in order to open the plantation land, such as they must be ‘herenteng’ (equal) between one plantation land and others. Besides, there are several prohibitions when opening the plantation land that shouldn’t be break by the people, those are ‘apit’ and ‘kaet’. These prohibitions are not written, but still being obeyed by the people. Something that is still maintained in this area is interesting to examine from the perspective of law number 5 of 1960 that is concerning the Basic Regulations of Agrarian (UUPA).

Abstract

Putusan Mahkamah Konstitusi Nomor 97/PUU-XIV/2016 tentang Pengujian terhadap Undang-Undang Administrasi Kependudukan merupakan suatu bentuk regulasi yang dimunculkan untuk memberikan pengakuan dan perlindungan dalam kebebasan untuk memilih dan memeluk agama yang diyakini, termasuk bagi Orang Lom di Kepulauan Bangka Belitung. Tulisan ini dimaksudkan untuk mengkaji implementasi Putusan Mahkamah Konstitusi tersebut serta persoalan yang mempengaruhinya. Hasil penelitian membuktikan: pertama, Putusan Mahkamah Konstitusi tersebut tidak dapat diimplementasi dalam pengisian kolom agama bagi Orang Lom dalam pembuatan Kartu Tanda Penduduk elektronik (KTP-el); kedua, terdapat berbagai faktor penyebab Putusan Mahkamah Konstitusi tersebut tidak dapat diimplementasi, mulai dari persoalan regulasi turunan sebagai peraturan teknis, tidak dilakukannya sosialisasi, sistem aplikasi perekaman KTP-el, sampai pada persoalan budaya dan masyarakat. Oleh sebab itu, diperlukan suatu bentuk langkah konkret dan nyata yang dilakukan untuk mengakomodir persoalan pencantuman “penghayat kepercayaan” pada KTP-el bagi Orang Lom.The Constitutional Court Decision Number 97/PUU-XIV/2016 is a form of regulation that is raised to provide recognition and protection in the freedom to choose and embrace the religion that is believed, including for Orang Lom in Bangka Belitung. this paper is intended to examine the implementation of that Constitutional Court Decision and it’s legal problems. This research proved that: first, the Constitutional Court Decision cannot be implemented in filling out the religious column on the making electronic ID Card for Orang Lom. Second, there are various factors causing the implementation of the Constitutional Court Decision, starting from the issue of derivative regulation as a technical regulation, the absence of sosialization, application systems, culture and society factors. Therefore, needed the concrete efforts to accommodate the issue of inclusion of trustees in the making of the electronic ID Card for Orang Lom.
