Abstract

Basically,  Islamic law is the law of all things, human and divine. It means that the source of Islamic law, actually, comes from the devine of God, and ?in other hand- the creation of human being through his reason. But, after falling of Islamic civilization, Islamic law becomes marginal law that just has been aplicated for a part of human life aspect, for example family law. Further, Islamic law becomes weak, because of his inability to answer modern problems. Thus, it needs an empowerment. Many of experts assume that for Islamic law empowerment, the most important to be improved is methodological aspect, that is Islamic legal theory called as ushul fikih. It needs improving in order to be able to guide the development of social change from the law perspective. What has been given by the former ushuliyyun, especially four Islamic law schools, in the form of methodological Islamic law isn?t enough to cover the problems of law. Then, Asy-Syatibi came and offered the new method of Islamic legal theory. His method offers the new perspective in understanding the sources of Islamic law. It is, comonly,called as istiqra? ma?nawi. This paper will describe and explain about it.

Abstract

Al-J?bir??s hermeneutics and its implications for Islamic law is topic of this article. Framework thinking of al-J?bir??s hermeneutics was constructed on the basis of two principles, al-fa?l and al-wa?l. Al-fa?l principle was applied by using three approaches; structural analysis, historical criticism, and ideological criticism, while the principle of al-wa?l using mathematical-intuition approach. He had applied that methodological construction in the interpretation of the Qur?an, as the source of all sources of Islamic law. The implication is reconstruction, and even deconstruction, of various theories and themes of Islamic law. Theoretically, one of which is about nasakh. For him, no nasakh in the Qur?an, except human?s understanding about law is changed. While thematically, one of which is mut?ah. As a consequence of the absence nasakh in the Qur'an, for him mut?ah remain in force if the condition and the situation requires.

Abstract

This topic examines concept ?syura? (conference; negoisation) and how to implement ?syura? to the context of constitutional state right now. Including the offending with rechstaat/ rule of law. Syura is defined as the main principle for solving the social, politic, and government problems. Syura is the way to give the opprtunity to the society who has an ablity to participate for making a decision which binds as well as in the law regulation and politic policy. But the implementation of syura althought the institutionalization of syura, no nash of Al-Qur?an that decribes about it. Prophed Muhammad SAW?that instituted and cultured syura?did not leave the specific pattern and the form. Beause of that,  the moslems right now and to te next, the partern and the form of  that implementation, are free to initiative. So it can be appropriated with the condition and the reality. Including that relevance with the parliamentary democratie concept or the exixtence of legislative instiution, especially Indonesia.

Abstract

The style of Islamic studies at the Islamic higher education, namely: a varietyof Islamic studies is no longer bound or tend to side with one particularmadhhab; patterned Majlisi, the privilege of this orientation is a priorityto uniformity and stability of the people; patterned campus, characteristicfeature of this orientation is the campus life characterized by the dominanceof independent thinking; campus pattern to be developed in the Islamichigher education so that students can be more active in expressing theiropinion; Islamic studies at the Islamic College coupled with the introductionof modern sciences, both social sciences and natural sciences.Character of Islamic studies at the Islamic higher education is more orientedtoward mastery of the material substance and possession of the treasures ofIslamic scholarship, which will then be followed by practice of the teachingsof Islam which has learned. While the nature of Islamic studies in the West ismore oriented to Islam as a social reality or fenmena only. The methodologyused in the study of Islam at Islamic higher education, among others, byusing a normative approach, sociological, historical, philosophical, andempirical.

Abstract

Two factors determine the productivity of work so the teacher is the abilityand willingness to teach, skills related to competence resulting from thelevel of education while teaching a willingness to do with motivation.Work productivity associated with the ratio between output and inputsused to produce outputs. An organization of educational institutions bothgovernment and private sector in issuing its products always require inputin the form of raw materials, capital, energy, technology, human resources(HR), and so forth. But the most urgent input is itself a human resource forsophisticated and complete as any other input if human resources are notworking then all the input there would be no meaning. The quality of humanresources is determined from the level of education the longer time spenton education, the higher ability or competence in doing the work, so thehigher the productivity of its work. In addition to educational level of laborproductivity is also determined by the motivation is strong encouragementfrom the man to conduct their activities in order to achieve the goal, it issaid that 90% of success is determined by the motivation of a person?s lifewhile 10% is determined by intelligence.

Abstract

In fact, islamic education came by efforting to answer moslem?s issues,especially for this era and for the next without skipping the reference toguiding Al-Qur?an nad Sunnah. This case is being the main topic of thisstudy. On islam, an education is a derivation from the texts of Al-qur?anand rasul?s Sunnah. So Islamic Education does not only for the secularorientation, but also implements the useful education (ilm nafi?) in realizinghuman character as khalifatulah. Abstract

Cooperation skills are needed in society today and in the future. Cooperation skill are also crucial to the success of social relations, especially in the society. Therefore, it is very important for students to learn these skills because these skills are not possessed child since birth, but the skills to be tought and given opportunities to practice. Cooperation skills is an important thing in life and superior democratic culture in addition to the attitude of responsibility, concern for others, open-mindedness, and creativity. In an effort to improve the skills students will require cooperation on the selection and application of learning strategies that enable students to learn directly in practicing these skills. Strategies that allow students to practice skills learned directly or in cooperation is a group of cooperative learning strategies, where the students sat with other students in a heterogeneous group with a common goal.

The head master need to understand TMQ as a philosophy, method, techniqve and strategy of managent to improve school quality because the way of school organization work is always assessed by communites howdays TMQ in education aspect plees the students as cliens so that students idea must be included in every strategy dieision making school organization. Besides,the head master is not the main mass in improving the quality, but every one given responsibility is a manager and having a right to take a decision in every their responsibility

Abstract

Education is often measured by changes in external human being, physical and matrial which is to increase the satisfaction of human needs. Therefore, today's educational products trying to make an intelligent and skillful human being, but do not have a soul awareness and a sense of other human beings. This was caused the implementation of education contrary to to the pragmatic measures that have been contaminated by Western ideas of education. In the context of Islam, the function of education will not be achieved when education being offered only human being capable of creating a master of science and technology. Therefore, education should be oriented to the worldly and eternity so that education can create a generation of quality that has IMTAQ and master science and technology.
