Abstract

Human life is full of risks. There is a risk of loss, accident and even the risk of death. To prepare for these risks, a sense of security is needed through coverage. These coverage is through Islamic insurance. Sharia Insurance (Ta'min, Takaful or Tadhamun) is an effort to protect and help one another among a number of people / parties through investments in the form of assets and / or tabarru 'which provide a pattern of return to face certain risks through an appropriate contract (agreement) with sharia. The contracts that are attached to Islamic insurance are the contract of contract and tabarru 'contract, while the contract that follows the contract of tijarah and the tabarru contract is the Mudharabah Musytarakah agreement, Mudharabah agreement and Wakalah bil Ujrah agreement.

Abstract

Competition of financial institutions is so tight, however the development of sharia banking the longer shows that the positive trend cann’t be separated from the role of account officers who are important marketing figures in providing information and education to the society. Banks as financial institutions that produce financial services desperately need account officers to introduce the advantages of Sharia Banks such as mudhorobah financing, salam, Istishna'and other products such as wadi'ah, ijarah, wakalah, kafalah, hawalah, rahn, as-sharf and qard.The interpersonal ability of the communication account officer is a necessity that must always be improved considering that the spearhead of banking is in the hands of the account officer. An Account Officer (AO) must be able to attract prospective customers by optimizing interpersonal communication skills with good so that customers are interested in using Sharia Bankproducts. By optimizing the interpersonal communication capabilities possessed by account officers, of course, it will be able to influence customers and create demand to for Shariah Bank products.

Abstract

Companies that want to survive must be able to adapt and respond to changes in the business environment, whether it's internal and external environment. Companies that are not able to adapt to changing environment then it will fail in his efforts. One of the changes that are happening at the moment is the marketing system with a system of dropship. On the other hand being debated dropship marketing system for the leaders of religion in Indonesia. There are some religious leaders denounce as there are elements of gharar and partly justifies. Islam is the perfect religion. Most of the religious leaders gave an answer that is clearly selling dropship allowed in Islam with a record must meet the Islamic jurisprudence. The solution is through the Covenant of samirah, wakalah and salam. Thus the law of selling dropship system is allowed, as long as there are no prohibited items.

Abstract

The meaning of "ethos" comes from Greek (ethos) which means character or character. Overall, the notion of ethos includes characteristics and attitudes, habits and beliefs, and so on, which are specific about an individual or group of people. From the words "ethos" will appear the words "ethics" and "ethical" which refer to the meaning of "morality / behavior" or are "morality", namely the essential quality of a person or a group, including a group of nations. It is also said that "ethos" means the distinctive soul of a group of people, which from that distinctive soul will develop the nation's view of good and bad, that is, its ethics.Ahmad Janan Asifudin, citing In the Hand Book of Term Psycology stated that ethos is interpreted as a distinctive view of a social group, a value system that lies behind the customs and procedures of a community. Whereas, Taufiq Abdullah defines it as an evaluative aspect which is a self-assessment of work originating from self-identity which is a sacred value that is the religious spiritual reality that he believes.Whereas the difference between ethos and ethics. The term ethics, theoretically can be divided into two senses. First, ethics comes from the Greek word ethos which means custom (character). In this sense, ethics is related to good life habits, both in oneself and in a society or community group that is passed on from one person to another or from one generation to another.The definition of work, as in the Big Dictionary of Indonesian Language is interpreted as an activity of doing something. El-Qussy as quoted by Ahmad Janan Asifuddin argues that human activities or actions are of two types. First, actions that are related to mental activities, and both actions are done accidentally. The first type has a characteristic of interest, namely to achieve the purpose or realize certain goals. While the second type is a random movement as seen in small baby movements that appear irregular, reflection movements and other movements that occur without the will of the will or thought process.Tata tasmara in his work ethic of a Muslim has an ethos formulation as follows In the form of axioms, Toto summarizes them in the form of a formula: KHI = T, US (M, A, R, A), KHI = Islamic Quality of Life, T = Tawhid, US = Charity piety, M = Motivation, A = Direction of Goals (Aim and Goal / Objectives), R = Taste and Ratio (Thinking and Recitation), A = Action, Actualization.

Abstract

Marketing strategy is a statement (both implicit and explicit) about how a brand or product line reaches its goal. Meanwhile, Tull and Kahle (1990) defined a fundamental tool strategy planned to achieve company goals by developing sustainable competitive advantages through the market entered and marketing programs used to serve the target market. In each step, marketing activities and activities must always be based on Islamic shari'a. Sharia marketing believes that these divine laws are the most ideal, the most perfect, most appropriate for all forms of goodness and most can prevent all forms of damage. A Shari'ah marketer even though he is not able to see God, he will always feel that God is always watching him. So that he will be able to avoid all kinds of actions that cause other people to be deceived.

Abstract

Fiscal policy is a policy pursued by the government in managing state income and expenditure. The state of Medina which was led by Muhammad SAW also had a unique fiscal policy system in his day. The implementation of fiscal policy at the time of the Prophet Muhammad and Abu Bakr was almost the same, because there were not many problems that emerged along with the expansion of the territory of the Islamic Caliphate. Sources of state revenues in the early days of Islam included the zakat, khums, jizyah, fai, ‘usyūr and other sources of income. One of the state revenues in the early days of Islam was ‘usyūr and jizyah. The discussion of 'usyur revolves around the definition, who is obliged to pay ‘usyūr, the item affected by‘ usyūr, the time of collection ‘usyūr, and the amount of levies. As for jizyah, the discussion revolves around the definition, the jizyah payer, the large number of levies, the termination of jizyah, the rights and obligations of Ahlu Zhimmah, the use of jizyah, orientalist criticism of jizyah, and then analyzing both. The policies exemplified by the Prophet Muhammad both legal, political and economic issues became guidelines for the Khulafa ar-Rashidin, his tireless friends always accompanied him. Among the policies relating to the economy are the collection of usyūr and jizyah. ‘Usyūr and jizyah are one of the sources of income at the beginning of Islam which is quite important for state finance. This policy is also used by followers in managing the economic life of the country.

Abstract

Financing based on Islamic principles actually to increase employment opportunities and economic prosperity in accordance with the Islamic values. The existence of BMT run financing based on Islamic principles not only for profits and enliven the financing business in Indonesia, but also to create a safe business environment with Islamic principles that do not burden the debtor. One of the financing with the principles of Syariah is financing with the murabahah system. Murabahah financing is a type of purchase contract item with the acquisition price and profit (margin) as agreed by the seller and the buyer where the refund loans by the customer can be done in the form of a mortgage or loan. Loans granted certainly has risk so required ability and effectiveness in managing credit risk and minimize the potential losses. Experienced credit risk is a breakdown of murabahah financing so that need to design a settlement in such financing.

Abstract

The role of law graduates in Indonesia is very important in overcoming problems that exist in society when working as an advocate. But sometimes the profession sometimes gets a slanted view in the middle of society. This is due to the lack of literacy from the general public. Important advocates need to be considered because in addition to providing legal advice by defending the rights of suspects in criminal and civil cases. In criminal cases, the client's interests are subjectively separated from the law, even though the suspect realizes that he made a mistake. Almost never heard of a voluntary criminal willing to be convicted. So the role of advocates in upholding economic law in Indonesia is really needed. Without the role of an advocate, law enforcement, especially those relating to economic law will not be enforced.

Abstract

This research aims to explain the concept of online peer-to-peer lending based on sharia rules. This research uses a literature study. The findings are, first, online peer-to-peer lending allowed in Islamic law that free from prohibited transactions, using sharia contracts, transparent, and in good manner. Second, there are 6 online peer-to-peer lending models that can be done according to Fatwa DSN-MUI: 1) financing for factoring, 2) financing for procurement ordered good, 3) financing for online seller, 4) financing for online seller through payment gateway, 5) financing for employee, 5) financing for community-based.

Abstract

Justice of inheritance distribution between men and women still became actual and sustainable discussion. Various clasical views that say the distribution of inheritance between men and women is final because it is written in surat an-Nisa’ verse 11 and changing these provisions is deemed deviated from sharia, besides that, contamporary people see this as a rule that is contextualized according to the times. Progressive thinking about the distribution of inheritance was pioneered by gender activists who saw the fiqh of Mawaris still gender biased. Aim of this research was to find out the application of inheritance distribution in accordance with the conditions of Indonesian society by using a gender theory approach. The methodology used in this research is descriptive analytical by focusing on the issue of inheritance distribution 1:2 for men and women. Data analysis is carried out by reviewing the arguments about inheritance with a socio-historical approach. The results obtained from this study are the distribution of inheritance of Classical Islam 1: 2 is not something final, but can change 1: 1 or 2: 1 according to changing conditions of society. The conclusion of this research shows that to find out the purpose of Islamic law, the reader of the text of the postulate must be done contextually to get a law that is just in accordance with the objectives of Islam.
