Abstract

This article tries to explain several points of 'Audah 's thoughts on kalam, syari'ah, qanun, and khawarij. 'Abd al-Qadir 'Audah is categorized as a great reformer who has revolutionary-minded. Along with his friends succeed to resurrect the Islamic doctrines in Egyptian society through the religious purification movement by using the slogan 'returning to the Qur'an and Sunnah'. Besides as great 'ulama’, he also deserved well for his country by overthrowing Faraouk, the tyrant king of Egypt, through the revolutionary action of 1952 in Egypt. Hence, it is logic if he was well-known as a great ulama and a revolutionary reformer of the twentieth century.

Abstract

Almost every human needs wealth because it becomes a supporting tool for human life in the World. Besides, it also becomes both the help and the load for its owners in the hereafter. Nobody does not need wealth. Indeed, one ungrudgingfy goes early and comes in the dark time to earn the money. Ructions and losing of soul sometimes happened because of fighting over the wealth. Wealth is a tryout (slander) for human (Q.S. at-Tagabun: 15). Because of wealth one may enter into either the heaven or the hell. This article tries to discuss on the wealth based on the Qur'an. Based on the Quranic perspective, wealth is not merely a tool for satisfying for human needs, but it becomes a medium God mates for human in which it may become either comfort or curse for human being. Wealth, according to the Qur'an, has several functions. Firstly, it becomes a tryout (slander) for human, whether one will be grateful or vice versa. Secondly, it may also become mata' al-hayat ad-dunya (wordly fixings). Thirdly, it becomes wasilat al-jihad (means for jihad) for the owners. Abstract

Islam gives human freedoom to profess a religion without any coercion. This freedom principle includes when one want to convert from his previous religion into another one. In Islam, it is called riddah, leaving Islam to convert into another religion consciously. The performers of riddah are called the apostates.The action of Riddah is fulminated by the Qur'an; however, the Qur'an does not clearly determine the punishment far the apostates. The majority of Islamic law scholars classify riddah as Jarimah (an injustice deed) that must be under pain of death as stated in hadits. Such a classification breaks the rights of the liberty of conscience supported by several verses of the Qur'an.The death penalty that is applied to the Jarimah performers, as a matter of fact, does not spontaneously apply when the action of Jarimah is known, but there is resuscitation process by persuading the apostates to reconvert into Islam. Moreover, the ulamas have different opinions in determining the criteria of Jarimah riddah (the criminal law of apostasy) that causing the death penalty. In this case, there is contradiction between the Qur'an and hadits. Therefore, the decision of the death penalty far the apostates should be reviewed. Abstract

This paper will examine the rise of perda syari'ah (syari'ah regional regulations) in contemporary Indonesia. Since the fall of Soeharto, the muslim politics has reemerged in the national politics constellation. From 1999 to 2002 three Islamic political parties (PPP, PBB, and PK) insisted on proposing to reinsert the seven words of the Jakarta Charter into the amendment of 1945 Constitution. They intensively strived for them through the inside of parliament. In the same time, their efforts were also fully supported by the Islamic radicalism organization from the outside building such as HTI (Liberation Party) and MMI (Council of Indonesian Jihad Fighters). lf they previously insisted to implement syari'ah in state level, now they attempted to have it from a local region. This can be witnessed from the application of syari'ah regional regulation (perda syari'ah) in some Muslim-majority districts such as Bulukumba, Gowa, Maros, Lombok, Pamekasan, Cianjur, Indramayu, Tasikmalaya, Padang, Banjarmasin, and Nanggro Aceh Darussalam. This study tries to compare two Muslim majority provinces (South Sulawesi and West Java) which have applied perda syari'ah since 2001.

Abstract

Ketinggian nilai sastra bukan hanya terdapat dalam Al-Qur'an saja, melainkan juga dalam hadits-hadits Nabi. Sebagaimana halnya AlQur'an, hadits-hadits Nabi dinilai terbebas dari kecacatan dan pertentangan kebahasaan, baik dari segi keserasian huruf-hurufnya atau kalimat-kalimatnya. Hal inilah yang mendorong derajat ketinggian sastra dalam hadits. Rasulullah saw bersabda, 'Aku dianugerahi sesuatu yang belum dianugerahkan kepada siapapun sebelumku. Di antara anugerah itu adalah jawami' al-kalam.'Tulisan ini memaparkan beberapa sisi kesusasteraan yang terdapat dalam hadits Nabi, terutama dalam tinjauan ilmu Badi’, sebagai salah satu cabang ilmu sastra Arab, ilmu Badi' memfokuskan kajian pada keindahan­keindahan lafadz dan keindahan makna. Dari lima buah hadits yang dijadikan objek kajian, penulis menemukan setidaknya delapan segi ilmu Badi' yaitu : jinas naqsih muthlaq, jinas isytiqaq, sihhatut taqsim, thibaq ijab, thibaq salb, uslubul hakim, raddul 'ajzi ila ash-shadril iqtibas, dan saja'al mutharraf. Kata Kunci : Balaghah, Badi', Hadits Nabi

Abstract

After the ruin o the New Order era in 1998, the struggle to implement syarrah in Indonesia came into a new historical phase. During this period, several Radical Islamic movements were established both as a respond to the collapse of the New Order regime which trammels their activities and as a respond to several horizontal conflicts triggered by religious issues which were frequently occurred the fall of the Suharto's regime. In the pipe line, the discourse of the implementation of Islamic syari'ah occurred not only in national level, but also in local level. The Banten province established in 2000 was one of the important regions in the map of Islamic movements in fighting out the implementation of Islamic syariah. In this regard, the Majelis Ulama Indonesia of Banten province played a great role, especially in mediating various interests involved in this discourse fight in local level Even though Muslims failed in bringing the regional regulations into realiry to make Banten Province as Aceh which has implemented Islamic syari'ah, the emergence of several local regulations in several municipalities shows that this discourse is still alive up to the present

Abstract

It is ordinary that riwāyah (oral transmission) has been the main media in transmitting knowledge. Indeed, for the Arabs, the transmission system was used not only in transmitting hadits, but also in transmitting the history. In terms of the transmission of traditions, the transmitters were very strict in applying the rules of transmission. Hence, such an isnād system has a very important value in the history. Muslims in the past gave much attention to such an isnād system.The transmissions of poetry had been emerged before the transmissions did. Every poetry has the transmitters. They keep and guarantee the continuity of the poetry transmission. The relation between the poetry transmitters and their poetries is not different from that of the transmitters of hadits and their hadits. Key words: hadits, isnād, Jahiliyah poetry, oral transmission.

Abstract

This study tries to analyze several results of law decisions of Bahtsul Masa'il NU (BMNU) decided by using ilhaq method. It is one of the methods in law establishment used by BMNU. The way it works is similar to qiyas; however, conducting qiyas used by BMNU does not refers directly to the Qur'an or hadits, but it refers to the 'ulama's views available in the classical Arab texts. It is an atypical method in ushul al-fiqh studies, but it is, as a matter of fact, used by NU 'ulama'. This method, by all means, causes many strictures and questions from some of the ushul 'ulama’. Therefore, this study is based on two basic questions as fallow: 1) how is the process of ilhaq method in BMNU?; 2) how is this method viewed based on ushul al-fiqh perspective?. The result of this study shows that ilhaq conducted by BMNU is methodologically crumbly, but the products of its laws are not contradiction with the Qur’an and hadits as well as maqashid asy-syar’iyyah (the oqjectives of law).
