Abstract

There are statements in the sacred book of Islam on description of God?s substance, His attributes and deeds. This study addresses these issues as found in Islamic classical books, written by Muslim philosophers and the mutakallims. Ibn Rushd, a Muslim philosopher, made his criticisms to the Mutakallims on these theological issues, which he saw that they misunderstood the Quran and Hadith, for they failed to understand the meaning of the religious propositions as if they ignored the tawhîd.This study discusses the problems of God?s existence and position, God?s deeds, God?s will and human?s choice, God?s words, and the creation of the universe. These issues are considered to have a point of contact between God and humans. These problems have been subject of debates among Muslim philosophers and Mutakallims since classical era, represented by Ibn Rushd among the Muslim philosophers, Mu?tazilites and Ash?arites among the Mutakallims. The emergence of debates on the issues is due to the statements in Islamic sources concerning the problem of uniqueness of God which triggers the emergence of interpretations with diverse views. In the view of millennial generation, the study of the divine anthropomorphism pursued through integration of theological arguments and logical propositions.

Abstract

As a poet, philosopher, and reformer of modern Islamic education, Sir MuhammadIqbal actually never specifically wrote about the concept of Islamic education. Is K.G. Saiyidain, in his book Iqbal's Educational Philosophy, which has explained the 8 basic principles of Islamic education in Iqbal's thinking, namely: individual concepts(invide), individual growth, physical and spiritual balance, individual connection with society, individual creativity, intellectual role and intuition , character education, and social education. This article tries to explore further on the first principle, that education must be able to foster the characteristics of 'individuality' (ego / me) of human beings to become a Perfect Man (Insan Kamil). In Iqbal's view, a perfect human being is a human who manifests divine attributes within him, behaves like God. These traits are absorbed and united totally into human beings. Iqbal then used khudi keywords to explain the idea.

Abstract

Islam is often considered discriminatory against women with the concept of polygamy, thalak, inheritance and women's testimony, the concept of mahram for women if they want to leave and even the concept of hijab is considered as symbols of restraint on women's freedom in the Islamic world. Where women in the family are considered not to have the same gender role as men. Here gender discourse cannot be separated from theological studies, because the position of women in religious thought is indeed placed as the second being, especially about the origin and function of the existence of both. The perpetuation of gender inequality widely in religion originates from the nature of religion itself or is derived from the understanding, interpretation and thought of religion which is not impossible to be influenced by patriarchal traditions and culture or other views. Therefore an understanding is needed to place the real role of women in the family according to the guidance of the teachings of Islam. The purpose of this study is to find out how Islamic teachings place the role and position of women in the family. This research is a descriptive analytical research design using conflict and feminist theory approaches, with the hope that there will be a deeper analysis of gender issues in the Islamic family more deeply.

Abstract

This article discusses about the regulation of state authorities for the interfaith marriage in Indonesia; the recognition of state authorities for the interfaith marriages are carried out by citizen abroad; and what is the meaning of state recognition for them. This is a law research that takes an anthropological pattern. Indonesia as a modern nation state has authority to regulate the marriage of citizen. The state also gives authority to the religion for the recognition of the validity of marriage, as Section 2 (1) of Act No. 1 of 1974 on the marriage Marriage. Relating to interfaith marriage is also based on that article, so that the religious authorities determine its validity. It?s difficult to be conducted in Indonesia.Regulation of Indonesian State authority for citizen marriage overseas is in Article 56 (1) and (2). According to the article, the state of Indonesia also has authority over the marriage of its citizens abroad, both in the implementation of the marriage (that must follow the local law and Indonesian law) and authority to record after the citizens returned to Indonesia. In the practice, State authorities in the marriage registration is only administratively population recording, without regarding the validity of the marriage. This registration is also for the interfaith marriage abroad. Therefore, the State authorities can also recognize interfaith marriages of Indonesian citizens abroad upon arrival in Indonesia, while it?s difficult to be implemented in Indonesia. They also get a marriage certificate for their marriage abroad as a symbol of recognition from an authority. With the certificate, they fully get their rights as well as the marriages performed in Indonesia which are recognized by the authority of the Indonesian State. Among those rights are the rights to survival and the consequences of legal marriage and the right to offspring.

Abstract

The two reasons of this study were the scanty prior studies concerning segregation at pondok pesantren and the fact that during my dissertation research I found that different pondok pesantrens applied segregation differently. The previous studies suggested that a leader employed segregation in accordance with the type of his educational background. By contrast, in this study I argued that the segregation implemented was the opposite type of their previous education as a sort of reflection. The objectives of the study were to explore the leaders? views at pondok pesantrens in Kota Banjarmasin on segregation; to discover the arguments of the leaders? views; and to describe the segregation implemented. This study employed a qualitative case study by employing interview, observation, and documentation methods to triangulate the data which was analyzed through content analysis. The leaders, the ustadzs, the ustadzahs, and the santris at three pondok pesantrens were involved in this study. This study found that the leaders were in different views; two viewed that the santris should be segregated while the other viewed the opposite. The argument of first view was the Qur?anic verses and hadith. The implementation was in the line with the leaders? views. The two leaders in the first view segregated their santris; the first segregated the santri completely in all aspects of teaching and learning process, while the other segregated in teaching and learning process in class only. The leader in the second view did not segregate his santris, except in the activity of Zuhur prayer for the lack of space.

Abstract

The statement of Rocky Gerung (RG), a popular thinker in Indonesia, that "If I use the definition that fiction activates imagination, the holy book is fiction" at the Indonesia Lawyers Club (ILC), Tuesday (04/10/2018) has caused controversy both in lay circles and philosophy lecturers in Indonesia. Even reported to the Police of the Republic of Indonesia as a statement that blasphemed religion. To be fair in this matter, this paper uses Husserl's phenomenological approach by putting in epoché all beliefs about the scriptures, especially those adopted by the author, to understand the "Holy Book is Fiction" in the conception of Rocky Gerung (RG). This approach allows the author to understand the concept of RG without being disturbed by initial perceptions, religious beliefs and the author's point of view. Then, the author moves to put the concept of RG in the discussion of contemporary logic that develops in analytic philosophy, namely modal logic, to analyze the possibility of the truth that "Holy Book is Fiction." Furthermore, the author identifies an epistemological position that enables one to view eschatological knowledge in the scriptures as something fictional not real and factual. It is hoped that this paper will unravel the confusion surrounding this controversy.

Abstract

This study aimed to find out the views of the Meranaw, Tausog and Maguindanaon who are Ulama and professionals in the enactment of expanded Islamic code of the Muslim Personal Law in the Bangsamoro Autonomous Region in Muslim Mindanao. The study was done through survey method by distributing questionnaire to 300 respondents. To determine the number of participants, purposive sampling technique was used in collecting the samples, and random sampling in selecting the number of respondents involved in the study. The major findings of the study showed that most of the respondents claimed that because of the absence of some of the Islamic laws in PD1083, it is hard for them to incorporate the true teachings of Islam in their field of work and expertise in relations to some of the issues and facts in PD 1083 which are un-Islamic. Being religious leaders, they have heavy burden of guilt as they think of the sin it is coupled in some of the provisions in the Code which have to be amended. In fact, the secular law is still the main basis and the law being used which is opposite to the penal law. Also, an emphasis on the need to incorporate in the enactment of expanded Islamic Code of the Muslim Personal Law in the BARMM the possible Islamic laws such as in the aspects of Islamic Criminal law, Islamic Judicial System and Islamic Finance. Findings further denote on the considerations of all the possible problems that will be encountered in the enactment of expanded Islamic Code of the Muslim Personal Law in the BARMM. Thus, it is hereby recommended that in the critical review on Muslim Code in the enactment of the expanded Islamic code of the Muslim Personal Law in the Bangsamoro Autonomous Region in Muslim Mindanao, that the Congress has its own role, say and participation as to the approval on the total enactment of the said expanded Islamic Code, and there approval should be in the affirmative side. Also, an emphasis that the enactment is applicable only to Muslims without prejudice to Non-Muslims, and this has to reach the National Level assuring all the Islamic laws to be incorporated. Also, it is recommended to integrate Islamic Criminal Law on Hudud and Qisas like death penalty for those crimes fall on this punishment, the same with the cutting of hands to those proven thieves beyond reasonable doubt, and not only Ta?zir punishment. Also, it is recommended for the need of Judicial System in the BARMM and in the High Court and District Court. Additional recommendation is for the Supreme Court to have representatives who are truly knowledgeable in the Qur?an and Sunnah of the Prophet Muhammad (S.A.W.), and in English or Secular law, those who are both cognizant in the areas of learning and teaching in both fields. Moreover, an emphasis on the establishment of Islamic Windows, Islamic Banking, Islamic Insurance, Islamic Cooperatives, Islamic Pawnshop and others in the recommendation of the incorporation of Islamic Finance in expanded Code. Finally, a rationale on the passage of the recognized revision is far recommended, and the full support of its people in its realization.
