Abstract

This paper departs from the concern that states? policy towards refugees and asylum seekers around theworld has not necessarily encouraged a true meaning of refugee protection. Instead, the policy related to their situation has been founded on the basis of states? rights to accept asylum. In consequence, there have been always cases of refugees living in limbo, denied from protection or even deported to their home countries. The fact however needs to be not taken for granted, to be acknowledged as result of construction by wide range of actors; states, intergovernmental states, international non-governmental organizations, individuals, etc. This paper is particularly interested in the ways that state through their actions-or inactions-establish a certain rhetoric about refugee rights. More specifically, this paper discusses the way ASEAN-referring to the regional organization and the individual states-shapes the rhetoric about refugee rights in their response to the Rohingya crisis. This paper collects and gather information regarding ASEAN meetings and policies as well as states? initiatives and policies which directly or indirectly address the problems of Rohingya refugees. In order to understand how these policies form the way refugees rights is understood, this paper applies critical discourse analysis by revealing the direction to which the region and its individual states bring the overall discourse on refugee rights.

Abstract

Islamic Criminal Law explains criminal offence and the punishments based on Islamic Law. The aim of Islamic criminal law is to maintain peace in the societies, whether for Muslim and non-Muslim, and reform the offenders. Running the Islamic criminal law is the right of every Muslim. The Indonesian Constitution guarantees the citizen?s freedom to run their own religion. In this context, running Islamic criminal law is part of Islamic religion. The objective of this paper is to know theopportunities of the application of Islamic criminal law according to Indonesian Constitution. This qualitative study will analyze the library data by referring to the books, the regulation in Indonesia and other sources that support this issue. Thus this paper is expected to generate the information about the possibility of the application of Islamic criminal law in Indonesia according to the IndonesianConstitution which is the highest law in Indonesia.

Abstract

In the modern era, many person forget how to be a true Muslim. When modernization comes, Western people use their logic to influence Muslim to follow what they want. It?s about Fun, Food, and Fashion. Many Muslims have followed it, and sometimes make them be a consumptive person. Not just it. It is still many effects on it. Muslim start to leave the science of Al-Qur?an and hadith. They want a happy and enjoy life. This is one of effect also if current teenagers loss a moral and good character. So, Muslim must be resuscitated to be true Muslim by Role of Religion. How to make Muslim for love Alquran and Hadith. It is for guidelines and principle.

Abstract

Marriage is considered to be sacred in some cultures. In recent years the issue of interfaith marriage has become an issue that is being discussed again, especially since the case of Article 2 paragraph (1) of the Marriage Law No. 1 of 1974 in the Constitutional Court with Case Number 68/PUU-XII/2014 which, according to the plaintiff it is as if Article 2 paragraph (1) is considered to prohibit interfaith marriages in Indonesia. The question that will arise regarding this matter is whether it is true that interfaith marriage is prohibited in Indonesia? Then what about the legitimacy of interfaith marriage practices that had occurred? Which jurisdiction of the judiciary has the authority to hear related to interfaith marriage disputes? This paper tries to analyze and answer these questions in the context of the marriage law that applies in Indonesia and contemporary judicial practices in Indonesia

Abstract

Bali sebagai destinasi pariwisata favorit di Indonesia memiliki potensi pasar yang besar dalam sektor kuliner. Hal ini ditunjukkan dengan 6.320.000 jiwa wisatawan asing dan 6.392.000 jiwa wisatawan domestic pada tahun 2014. Peluang untuk memasuki sektor kuliner halal di Bali pun besar mengingat sebagian besar kuliner yang tersedia di Bali belum terjamin kehalalannya karena warga asli Bali dan wisatawan asing sebagian besar adalah non Muslim. Oleh karena itu, kami menggagas Ubud Islamic Food Addict sebagai pusat kuliner halal di Bali. Pengelolaan, pembiayaan, dan proses manajerial pusat kuliner halal ini  dijalankan berdasarkan akad syariah dan sesuai dengan prinsip syariah. Pusat kuliner halal ini akan melibatkan UMKM yang ada di Bali dan peran serta dari Bank Syariah. Dengan gagasan ini, diharapkan pembiayaan mikro yang diberikan kepada Pusat Kuliner dan UMKM akan membantu perkembangan kuliner halal di Bali dan turut menggerakkan roda  perekonomian di Bali.

Abstract

Studi ini dilakukan untuk memformulasikan alasan yang membenarkan intervensi negara, terhadap kelembagaan sertifikasi halal. Sehingga konsumen Muslim terlindungi dalam arti yang sesungguhnya berdasarkan pengaturan kelembagaan tersebut. Metode yang dipergunakan adalah yuridis normatif, serta disandarkan pada gagasan public interests theory, untuk mengantisipasi dan mengkoreksi market failure yang disebabkan oleh information asymmetries, dalam hal ini yaitu tentang halal information. Peran dan intervensi negara atas kelembagaan sertifikasi halal sangat dibutuhkan pada massive and credential products, sebagai control of misleading information terhadap produk halal. Peran negara atas kelembagaan sertifikasi halal berfungsi untuk menjamin terciptanya symmetric information dan meminimalisir risiko terjadinya information asymmetries. Tanpa adanya lembaga sertifikasi halal, konsumen Muslim tidak mampu menunaikan kewajibannya mengkonsumsi makanan halal, karena tidak mampu memvalidasi kehalalan massive and credential products.

Abstract

Social environment is changing rapidly coincide with rapid change of humanthinking in solving any problems. The thinking is underlying human activity intheir life, so that it needs a guidance of thinking in facing every change in the life. Padjadjaran University (Unpad) as part of educational state has a guidance to support national development which is presented in principal scientific pattern (PSP) consisted of strengthen law and environmental issue. The rise opinions to restore Islamic religious values in the social order such as growing of Islamic banking system have proven its superiority at any challenges of finance problem. Therefore this paper tries to illustrate the superiority of Islamic values that are integrally introduced into PSP of Unpad?s vision and mission. One of Islamic religious value has been listed in maqasid sharia is to maintaining human mind (Hifz Al Aql) in thinking and behavior and also to maintaining harmonious environment for good living. Hopefully, all of activities in the academic community of Unpad could be able to rely on Islamic PSP as a guidance in every academic activities, moreover to bring Islamblessings and prosperity for all (rahmatan lilalamiin) at the Unpad.

Abstract

Itsbat of marriage reserved for marriage have not been recorded and the case before Law No. 1 of 1974 (Marriage Law). The problem arises when many marriages that have been performed and are not listed that under the Act including marriage under hand, confirmed that happened after MarriageLaw, then how is marriage legitimacy? Statement of problems is how is Judge Consideration in the Religious Court Judgment No. 0011/Pdt.P/2016/PA.Mkd granted that itsbat marriage happened after enactment of Law No. 1 of 1974? This study uses normative legal research, critical and analytical and many library research. The data collection method data carried out in the documentationand analyzed qualitatively. Discussion is composed of two sub, the decision analysis, and offer legal alternatives. Conclusion of Religious Court (Pengadilan Agama/PA) Mungkid which granted itsbat of marriage to the marriage after Marriage Law enacted was recognized as ijtihad by maslahah mursalahmethod. This method used to give a benefit for child with the deviations of Art. 7 (d) Islamic Law Compilation. But, this judgment still have not enough legal considerations, so that should be added other legal considerations such as the Child Protection Law, Regulations on Citizenship Administration, and also the stressing on understanding of Art. 2 (1) of Marriage Law. The condition ofacceptance (itsbat) of marriage which occurred in Judgment No. 11/pdt/2016/Mkd submitted by the husband and wife, can be categorized as the application of voluntair, that the products is designation.

Abstract

Being a party in the 1951 Convention on the Status Relating to Refugees and its 1967 Protocol is not an exclusive solution to legal protection of asylum seekers and refugees in Indonesia. Although the Government of Indonesia has not ratified both instruments, it has acknowledge the protection of asylum seekers and refugees under the People Consultative Assembly (MPR) Decree Number XVII Year 1998 and Law Number 37 year 1999 regarding Foreign Relations. A 2016 United Nations High Commissioner for Refugees reported that Indonesia has become a transit destination for more than 13,000 asylum seekers and refugees, including nearly 1,000 Rohingya asylum seekers. Asylum seekers suffers the most in Indonesia?s legal imbroglio. Despite the existing laws, the government of Indonesia has been identifying asylum seekers as illegal migrants under Immigration Law and kept them inside Immigration Detention Centres (IDCs), with common reports on ill-treatment and rampant violence. As a transit country, Indonesia carries the moral and legal responsibility to protect refugees during their transit with the ultimate purpose to prepare them to be resettled in countries that have signed the 1951 Convention. During this commonly lengthy and uncertain period or transit where the United Nations High Commissioner for Refugees or International Organization of Migrants will issue their refugees application result, protection should not be absent. Instead of suggesting Indonesia to ratify the 1951 Convention on the Status Relating to Refugees and its 1967 Protocol, this paper argues that Indonesian existing laws and regulations have provides it with national and international obligations to protect asylum seekers in transit, including to refrain from refoulement action. Thus, rendering the claim of an absence legal basis an irrelevant excuse.

Abstract

Salah satu karakteristik agama Islam pada masa awal adalah kejayaan dalam bidang politik. Kejayaan tersebut terus berlanjut hingga masa kekhalifahan terakhir, yakni Turki Utsmani. Namun demikian, dibalik kejayaan tersebut juga terdapat permasalahan dalam mekanisme pemilihan pemimpin negara. Rasulullah tidak memberikan contoh bagaimana mekanisme pemilihan pemimpin negara dan juga kriteria pemimpin seperti apa yang harus dipilih. Oleh karena itu, secara garis besar terdapat dua model sistem pemilihan, yakni melalui musyawarah oleh ahlul halli wal ?aqdidan penunjukkan oleh pemimpin sebelumnya. Dalam hal ini, beberapa ulama seperti Imam Al Mawardi, Said Hawwa, dan lainnya juga memberikan pendapatnya terkait kriteria pemimpin, yakni adil, faqih, berwawasan, sehat inderawi, tidak cacat, berani, dan bernasab. Pada konteks Indonesia, akan sedikit sulit menerapkan sistem pemilihan Islam untuk memilih kepala negara, tetapi dapat digunakan beberapa kriteria pemimpin dalam Islam untuk memilih kepala negara. Dalam hal ini, yang terpenting adalah bagaimana menerapkan nilai Islam di dalam sistem ketatanegaraan di Indonesia.
