Abstract

The obscurity of the ideal age for a marriage in classical fiqh reference requires the existence of ijtihad among contemporary jurists to determine the ideal age limit for a marriage. The result of the ijtihad is the formulation of a Compilation of Islamic Law which among one of the articles discusses the minimum limit for someone who will hold a marriage (article 15 KHI) which is 21 years. Including the phenomenon that is rife in Indonesia is the rise of early marriage. Early marriage is defined as a marriage that takes place before maturity is reached both physically and psychologically. In an ideal setting, a marriage continues until death approaches one married couple as exemplified by Rasulullah SAW. But now, divorce occurs in many areas. Divorce occurs because of conflict between husband and wife, or the lack of compatibility between both husband and wife to continue the household. This article is the result of a research linking the occurrence of early marriage and divorce rates in Semarang. The object of this research is the decisions in PA Ambarawa ruling relating to divorce and marriage dispensation requests. In the end, the rise of cases of early marriage in Semarang Regency is due to the rise of free association between teenagers. The results of this study concluded that some divorce decisions in PA Ambarawa in 2014 occurred against the background of early marriage.

Abstract

The adoption of children in Indonesia is a long standing tradition with varied motives and goals depending on the customs of the people of a region or those who adopt children. Due to the large number of child adoptions, the government has issued several regulations relating to child adoption in the form of law, government regulation and Ministerial regulation. This study wants to examine the extent to which these regulations have accommodated the rights of adopted children in the family. This research is included in the study of normative law with the aim of analyzing the rules of adoption of children in Indonesia through a human rights approach or in Islam known as maqashid al-shariah.

Abstract

One reason why the Marriage Law (UUP) is not obeyed is related to the status of compliance. According to the majority of Muslims, the status of obeying the contents of the UUP is related to and is a matter of the State, not related to the legality of religion, not related to the validity of marriage. Instead Muhammad 'Abduh is a thinker who believes that obeying the UUP is part of an obedient obligation to the government (uli al-amr), the same status as being obliged to obey Allah and His messengers, as required in al-Nisa' (4): 59 and 83. Thus, obeying the UUP is part of implementing compliance with the government. So obeying UUP is an obligation for every Muslim. Likewise, the UUP as a decision of people's representatives is an expression of the agreement of all the people. The people are represented by people who are elected by the people (people's representatives), because to gather all the people, at present, is impossible. So the decision of the people's representatives is positioned as the decision of all the people. The decision of the people's representatives for now becomes ijmâ ?, the third source of Islamic law after the Qur'an and the Sunnah of the Prophet Muhammad SAW. The final basis stipulates the obligation to obey the Marriage Law, compared to fiqh, fatwa, interpretation, and jurisprudence, as a product of Islamic legal thinking, the UUP occupies the most authoritative and comprehensive position, because the UUP is the result of the minds of many scholars and expertise. This paper tries to explain the concept of ?Abduh.

Abstract

The construction of the Islamic Jurisprudence School contained in the Compilation of Islamic Law, and the Marriage Law collides with the era, especially at the age of marriage. Post the Constitution Court Verdict Number 22/ PUU-XV/ 2017 requires the state to immediately revise where the ideal age limit for male and female marriages becomes 18 years or 19 years. On the other hand, there are still many marital dispensations caused by legitimate extramarital pregnancy. This is homework for the state. The term b?'ah or is?i?a?ah in fiqh must be by the era, especially in the era of Industry 4.0, where the country that cannot adapt will be increasingly left behind. The concept of seriousness in the theory of Us?u?l al-Fiqh must be developed by seeing living law in Indonesian society in the framework of family law reform in Indonesia to build humanity as a whole for the creation of a great nation as the ideals of the nation?s founding father without having to harm the essence of Syariah itself.

Abstract

The Marriage Law in Indonesia (UUP) is a positive legal rule in building a family. The UUP for example states that the purpose of marriage is to form a happy family, while the obligations of a husband and wife are to love, respect, respect and be loyal. Happiness, love, respect and loyalty are part of the psychological domain that cannot be achieved by merely reading normative juridical rules. Therefore a psychology study is needed to study the UUP. In addition to the psychological aspects, it is also important to study the UUP with a normative approach to see whether the UUP elaborates the normative values ??of the Qur'an as a source of Islamic teachings. The background of this paper is compiled with the aim of explaining the manifestations of psychological aspects formulated in the UUP so that it can be a reference for implementation in building families and analyzing the normative values ??of the Qur'an absorbed by the UUP. Therefore this UUP study was conducted with an integrated approach to normative and psychological juridical. This study also aims to develop family law with an integrative juridical psychological approach. The primary data sources used are the book of the Qur'aan by Quraysh Shihab, UUP and the book Motivation and Personality which examines happy psychology by Abraham H. Maslow and Triagular Theori of Love which discusses the theory of love in psychological perspective by Robert. J Steinberg as well as secondary sources related to research. The results of this study indicate that forming a happy family as a marriage goal is in harmony with Q.S. ar-Rum (30): 21. While in a psychological perspective marital happiness can be achieved by a husband and wife can achieve if fulfilled the five basic human needs (hierarchy of needs) in humanistic psychology namely: physiological, security, social, appreciation and self-actualization needs. While husband and wife love is manifested in three aspects, namely attachment, caring and intimacy.

Abstract

Marriage is anyone's right as long as the marriage is in accordance with the Shari'a, women who are no longer menstruating are called menopause and in this phase women experience various changes, with this change the groom is expected to understand the problematics of marrying menopause women for the sake of continuing family integrity, to give an idea to a bride, especially a man who wants to marry a menopausal woman (who is no longer reproducible), this study aims to find out the problems and motivations of marrying a menopausal woman (not to be reproduced) and to know the review of Law No. 1 of 1974 and Islamic Law concerning marrying women manouse, this research is a qualitative research with an empirical normative sociological approach by using the interview method, with the technical writer asking the spouse directly as a respondent and from the results of the interview the writer is the data. The results of this study can be concluded First Problematics marrying menopausal women are: not getting offspring, changes in intimate partner relationships. and social impact in the community Second Motivation to marry menopausal women as follows: because they really want to get married, earn a living, undergo worship, have friends in old age and friends.

Abstract

setiap masyarakat adat mengatur cara peralihan harta dari pewaris kepada ahli waris, sebab terkait dengan kebutuhan primer dalam memenuhi hajat hidup, bahkan berhubungan juga dengan martabat suatu keluarga dalam komunitasadatnya. Sebagai masyarakat yang menghitung garis kekerabatan dari pihak laki-laki, maka menurut adat Batak di Tapanuli Selatan harta juga hanya diwariskaan kepada kerabat laki-laki terutama anak laki-laki yang dipandang sebagai penerusmarga dan kebanggaan keluarga. System ini menempatkan anak perempuan sebagai pihak yang kebutuhan hidupnya sepenuhnya menjadi tanggungan suaminya sehingga tidak berstatus sebagai ahli waris. Sekalipun demikian ada instrument lain yang memberi ruang bagi anak perempuan untuk turut menerima porsi bagian tertentu dari harta yang ditinggalkan oleh orang tuanya. Anak perempuan bias menerima olong ate, pemberian kasih sayang yang mengandalhan kerelaan pihak anak laki-laki untuk melepas sebagian haknya agar anak perempuan dapat tersantuni. Saat ini olong ate mendapat pemaknaan baru, jika pada awalnya berhantung kepada keinginan baik anak laki-laki yang pada umumnya justru tidak menunjukkan kepedualiannya dan sama sekali tidak menyisakan sedikitpun harta, saat ini olonh ate menjadi suatu keharusan bagi anak laki-laki untuk memberi bagian yang layak kepada anak perempuan sekaipun tidak setara dengan bagian anak laki-laki.

Abstract

Pernikahan usia dini pada masyarakat suku Semendo, Muara Enim Sumatera Selatan  cukup Tinggi, bagi perempuan yang memegang status tunggu tubang, menurut hukum Negara dan agama dilarang. Data statistik tahun 2017 penduduk suku semendo yang terdiri dari 3 kecamatam berjumlah 41.261 jiwa dan 100% beragama Islam. Tunggu tubag adalah istilah adat untuk menyebutkan anak perempuan tertua dalam keluarga yang akan mewarisi harta kekayaan secara turun temurun dari nenek moyang mereka, memang harta tunggu tubang (harta tua) berupah rumah, sawah dan kebun tidak dibagi, menjadi hak penguasaan anak perempuan tertua. Hasil penelitian terjadinya pernikahan dini, dikarenakan beberapa faktor antara lain: orang tua wanita ingin lebih cepat mewariskan harta tunggu tubang, agar ada yang membantu dalam pekerjaan fisik pengurusan harta warisan, wanita yang memegang status tunggu tubang sengaja sekolahnya dibatasi hanya tamat SD/MI, karena kalau  sekolah cukup tinggi orang tuanya takut anaknya tidak akan mau mewarisi harta tunggu tubang seperti orang tua mereka. Oleh karena itu pada masyarakat suku Semendo masih berlaku kebiasaan untuk menjodohkan anak perempuan mereka. Uniknya pada masyarakat ini walaupun banyak perkawinan usia dini, jarang terjadi perceraian. Tulisan ini juga menunjukan bahwa praktik pernikahan usia dini yang dianggap akan banyak menimbulkan masalah seperti kekerasan, atau eksploitasi anak dan perempuan tidak terjadi.  orang tua yang menikahkan anaknya yang masih berusia muda khususnya yang berstatus tunggu tubang akan merasa terhormat. Penelitian ini menyarankan kepada Pemerinta untuk mengadakan intervensi agar regulasi perkawinan dan perlindungan anak dan perempuan dilaksanakan dengan melibatkan tokoh agama dan tokoh masyarakat

Abstract

Madura region with diverse cultural backgrounds which become its specialty always ignores the attention of researchers to uncover, as it has become unique on most of Madura Island, especially Pamekasan at the time of engagement, a man who has been engaged in carrying out the tradition of carrying out traditions in the form of metrae and nyalene. Metrae and nyalene are usually done by the community in the last 10 months of Ramadan, together with the obligation to issue zakat fitrah for Muslims and end before the Eid Al-Fitr prayers. The submission of pertra and salenan is usually done by the parents of the male fiance, but there is a small portion of the men who are engaged to visit the residence of the female fiance with petra and salenan. Petra and salenan in the form of rice or money worth the petra and the salenan, sometimes in the form of a piece of cloth, a set of clothes or enough money to buy clothes. The tradition of metrae and nyalene is carried out, because it is driven by the desire to help each other and help reduce the burden of the female fiancee, to strengthen the bond of friendship between the two, the love that is being knitted can be bound until the time to hold a marriage contract. By submitting petra and salenan mean to imply that engagement prepared forwarded. Abstract

Rapuhnya hubungan ayah atau keluarga ayah dengan anak gadis adalah salah satu sebab wali adhal. Menurut tokoh masyarakat putusan wali adhal itu membingungkan, karena mengabaikan wali nasab dalam pernikahan, di sisi lain putusan hakim mengizinkan wali adhal demi maslahat agar terhindar dari zina. Perkara wali adhol di Kabupaten Pasuruan pada tahun 2016 termasuk perkara yang sering terjadi hampir tiap bulan. Adanya perbedaan pandangan antara hakim dan tokoh masyarakat Kabupaten Pasuruan tentang wali adhal perlu dianalisis secara mendalam, agar dapat menjadi bahan pertimbangan tentang wali adhal guna mengurangi kasus wali adhal di Pasuruan. Jenis penelitian yang digunakan adalah yuridis empiris dan kualitatif deskriptif, data hasil wawancara dan dokumentasi dianalisis dengan teori pluralisme hukum. Hasil penelitian menjelaskan bahwa perkara wali adhal jika ditinjau dari teori pluralisme hukum akan muncul tiga dimensi yaitu pertama, jika seorang wali nasab tidak ada atau meninggal maka hakim dengan bukti yang ada berhak mengambilalih kekuasaan wali nasab dan memindahkannya kepada pihak yang berwenang. Kedua, jika wali nasab masih ada pernikahan itu harus dilaksanakan dengan persetujuan wali nasab. Ketika wali nasab enggan atau tidak hadir maka niat untuk menikah hendaknya dibatalkan. Ketiga, jika wali adhol masih ada, namun karena alasan yang tidak dibenarkan hukum enggan untuk menikahkan anaknya, maka hakim dapat mengizinkan wali adhal untuk menghindari zina dan mewujudkan keadilan bagi anak perempuan yang telah dikucilkan.
