Abstract

Notaris Dr. Henry Sinaga, SH, MKnIn exercising their authorities, Notaries are frequently reported by concerned parties concerning authentic deeds to the Regional Supervisory Council of Notaries of North Sumatera. The cases are caused by the authentic deeds produced by the notaries themselves. There are at least 4 (four) potential problems to make the notaries entangled with administrative sanctions ordered by the Regional Supervisory Council of Notaries of North Sumatera, namely: when the deed is being prepared by concerned parties, there is apparently another party who feels injured e.g. by a third party; notaries? negligence/ carelessness in preparing authentic deeds; notaries? intention in preparing authentic deeds to benefit only one party or that the notary is includeded as one of the concerned parties that results in turning the deeds into underhanded deeds; and that persons appearing provide false information/data in the preparation of authentic deeds.Keywords: Notary, the Regional Supervisory Council of Notaries of North Sumatera, Notarial Deed

Abstract

Dr. Dedi Harianto, SH, MHumThe candidates of umrah pilgrims (Islamic pilgrimage to Mecca, Saudi Arabia) who had registered and made full payment for umrah promo in 2017 through letter of PT. First Anugerah Karya Wisata should have left in June, 2017, but it was unilaterally postponed and they were offered options to take another schedule or to get refund. The research employs normative legal research method which studies library collections or secondary data consisting of primary, secondary and tertiary legal materials. The data are collected from analyzing documents and scientific books to gain theoretical basis such as positive law in accordance with the research object. The instrument used to collect the data is document. The analysis is made by applying qualitative technique. The results demonstrate that having the debtor with PKPU requested for reconciliation plan in a proposal such as rescheduling, debt acknowledgment for the unverified and unpaid past due debt by the creditor with PKPU is the form of the legal protection for the creditor with PKPU.Keywords: Legal Protection, Umrah Pilgrims, a Suspension of Debt Payment Obligation, PT. Abstract

Law No 11/2008 on Electronic Information and Transaction (UUITE) gives anopportunity for the realization the concept of making Deeds by using technology withconference video. The research problems were how about legal certainty of a Notary?sauthority in making a deed through conference video, how about the validity of the personsappearing in the process of making a notarial deed through conference video, and howabout legal remedy in the implementation of making a deed deed through conference video.The research used juridical normative using secondary data and supported by interviews.Making adeed by using technlogy with conferencevideo is difficult to be implemented sincesome of these regulations are contrary to UUJN (Notarial Act) and the clauses in the UUKNrequire the persons appearing and the signing of the deeds. The exception is the Minutes ofRUPS which uses conference video stipulated in Article 77, paragraph 1 of UUPT and itsimplementation process is supported by UUITE. Meanwhile, there is no clear regulation onthe making of authentic deeds by technology. However, the validity of the persons appearingin the making deeds through conference video is possible viewed from Article 5 of UUITEwhich recognizes the validity of electronic information and electronic documents throughconference video. The legal force of the persons appearing in making deeds throughconference video, in law of civil procedure, is legal evidence since it has met material andformal requirements.Keywords: Notary, Technology, Conference Video

When a defendant is on trial and is found not guilty and set free from any prosecution, he has the right to get rehabilitation from the court. The research problems are how about the implementation of the execution in judicial review on a Notary?s good name when he is found not guilty and how about the position of a Notarial deed in the post-verdic of judicial review. The research used juridicial normative method with descriptive analytic approach. The data were gathered by conducting library research and field research methods. A defendant who is set free from any prosecution, does not sue for compensation, and is not imprisoned, can make a request to the Panel of Judges to rehabilitate his good name through newspapers or other printed media and make civil complaint and file a claim. It is recommended that to get compensation and rehabilitation for good name on a defendant who is found not guilty, not file a complaint to the court.Keywords : Notary, Judicial Review, Rehabilitation for Good Name

Dr. Jelly Leviza, SH, MHumGeographical indication is a sign indicating the origin of goods and/or products due to their geographical environments including the nature, man, or the combination of both which contribute to reputation, quality and particular characteristics of the goods and or products produced. The goals of the protection for geographical indication are to protect the specialization from replicating or misusing, to provide a chance and protection for local people to produce typical products to obtain maximum advantage, to benefit the consumers because the quality of products is guaranteed. This is an empirical normative judicial research with analytical descriptive. The result demonstrates that there are some agricultural products which are potentialto be regiostered as geographical indications in Aceh Province. The causative factor of why potential products for geographical indications are not yet registered is because the local people do not have a legal awareness, minimum fund, nonexistent of forum for society who care to protect and register the commodities, lack of requirements for geographical indication, and lack of cooperation among local people producing the products to be registered. Government of Aceh Province keeps on providing legal protection to protect the existing agriculutural products either the ones which indicate potential to be registered as geographical indication or the ones which have been registered.Keyword: Agricultural Product, Geographical Indication

Prof. Dr. Madiasa Ablizar, SH, MSNotary is a general official authorized to make authentic deeds as stipulated in the format and content based on the prevailing laws and regulations in the field of authentic deed making in general and authentic notary deeds in particular. The type of research used in this study is normative legal research. The nature of this research is analytical descriptiv. The results of the discussion of the problems that arise in this study is the arrangement of the regional notary honorary assembly in providing answers to approval at the request of investigators, public prosecutors and judges in the judicial process as stipulated in the Regulation of the Minister of Law and Human Rights Number 7 of 2016 concerning Notary Honorary Assembly. Conduct self defense where in the examination conducted by the examining body formed by the notary regional council chairman and the notary can make other legal remedies by filing an objection to the request of the investigator in the judicial process that is given by the notary honor council to the local State Administrative Court.Keywords : Honorary Council of Notaries, Investigators, Public Prosecutors and Justice

Abdul Rahim Lubis, SH, MKnLand as God?s blessing for the Indonesian people has social function and its use should be able to increase people?s welfare. The right of management is mostly used by the government or legal entities to carry out their tasks and social affairs in economic field; but, since it is not its scope, it needs cooperation with the third party because the land of the Right of Management can be given to the third party for regional development so that the right of ownership, The research used descriptive analytic with juridical empirical method which analyzed, explained, and described the implementation of the burden of hypothecation on the right of management. The research used legal and conceptual approach in order to find out the legality and obstacles in burdening hypothecation on building rights on the right of management. Building rights on the right of management can be used as the collateral for debt by doing the burden of hypothecation on building rights as it is regulated in Article 4, paragraph 1 of Law No. 4/1996 on Hypothecation on land and everything which is related to it.. The holder of building rights files a request for the extension to the Land Office, and he has to fulfill the requirements for the extension of building rights in order to obtain permit as the holder of the right of management in the burden of hypothecation in building rights on the right of management.Keywords: Hypothecation, Building Rights, Right of Management

In consequence, allof a deceased person?s property will automatically goes down to the heirs.Usually, inheritance is distributed in cash; but in this case, the inheritance is inthe form of loan as it is stipulated in the Verdict No. 46/Pdt.G/2015/PN.Mdn.The thesis used juridical normative and descriptive analytic method.Secondary data were gathered by conducting library research and analyzedqualitatively, while the conclusion was drawn deductively.The result of the research shows that debt and credit among heirs towardinheritance collected physically or calculated before it can be distributed to heirs.Priority is given to zul furudl heir since his right is clearly described in the Koran.Some methods in settling loan inheritance due to one of the heirs? default areSulhu, Ibra, and Hajr. In this case, sulhu is the most appropriate method insettling the dispute by negotiation to avoid prolonged dispute and to make thefamily tries between defendant and the plaintiff harmonious. The Panel of Judgesstate that the Deferndant is required to pay off his debts to the Plaintiff based onpromissory note ad since the Defendant does not have evidence which will stateon reverse.Keywords: Inheritance, Debt and Credit, Default, Heirs
