Abstract

This article describes the legality of cash waqf, privileges, and its urgency in managing and developing waqf in the Islamic world in general, following fiqhiyah actual problems associated with the practice of cash waqf. Specifically article discusses the importance of cash waqf in managing and developing waqf assets in Indonesia.

Abstract

The purposes of this research are to discover establishment of the analogy from the Sahaabah (may Allah be pleased with them) on the issues of legacy and the judgement on it, the most famous of the Sahaabah creating the fatwa and ijtihad by using the analogy in these matters, and  the analogies created by the Sahaabah M.A.B.P.W.T also. The method used in this research is the qualitative, especially by the descriptive method. The results of this research are: 1) It revealed that tradition of using analogy among sahaabah has existed since the early of their period. It was found that the Sahaabah M.A.B.P.W.T used the analogy in their jurisprudence on their sayings and fatwas on legacies. 2) almost the Ulama in the period of the Sahaabah concerning on jurisprudence are expert on legacy, some of them are the rightly guided Caliphs, Abdullah bin Abbas, Zaid ibn Thabit, Abdullah ibn Mas'ud, Abbas ibn Abd al-Muttalib, Ubay ibn Ka'b, Mu'adh ibn Jabal and Abu Musa al-Ash'ari.

Abstract

The conclusion of this paper is that Islam rejects domestic violence as opposed to theprinciples of the Quran and Hadith. More over, the Quran and Hadith command thehusband to treat his wife kindly. The significance of this paper is the formulation of thetreatment proposed by the Quran and Hadits upon domestic violence. This paper usesthematic methodology, by exploring the Quran, Hadith and classical references thatbased on the critical reading.

Abstract

Zakat is a religious obligation, and one of the largest Islamic financial resources, organized since the second of hijriah.Zakat has been managed in Indonesia since before the independence era, but in colonial era zakat was declined, and began to stretch again after the independence of Indonesia.In Indonesia Zakat was initially managed by the Ministry of Religious Affairs of the Republic Indonesia, with issuing the Minister regulation in 1968, based on this and guided by 1945 Constituion which stated that Indonesia was founded on the One Godhead and freedom of whorship for every believer, than the government established Badan Amil Zakat Nasional (BAZNAS), and in 1999 the Government issued a special law on zakat management, wich later completed amended in 2011, pursuant to this special law government formed National Independent Zakat Authority.In terms of collecting an distributing Zakat managed by Badan Amil Zakat Nasional (BAZNAS) formed by the Government, and Lembaga Amil Zakat (LAZ) formed by the Islamic community based on applicable legal provisions, while the distribution carried out in two systems: distributing directly to mustahiq, and productive utilization.

Abstract

The issue of abortion in Indonesia has a strict and clear legal regulation. Formally, abortion is not justified in Indonesia, so anyone who has been proven to have an abortion will be treated with a criminal penalty in exchange for their actions which violate the law. The decision on the legality of abortion in Indonesia is only to protect morality and to try to evaluate the basic values of life. Therefore, how can a nation be considered civilized if immoral acts – such as abortion – are still scattered in different places. In fact, abortion and its law will only lead to an increase in the number of perpetrators, even will be done openly, and consequently anyone who wants to do an abortion will not hesitate because the law provides a guarantee.

Abstract

Feeling safe, secure and comfortable is a personal innate needs and human rights. It willgenerate good atmosphere and conclusive condition of worship, working environmentand competition for personal or others. The filling secure in Al Qur’an covers all sides ofthe human life world and the hereafter, as individuals and as a social being. Ayat-Ayat(Nash) Al Quran encourage people to create safety and comfortable atmosphere, indeed,if there is no guarantee it will have implications on community balancing, humangrowth and social welfare.

Abstract

E-transactions have become a phenomenon that cannot escape human life, transactions using electronic devices, especially the internet, appear because of the rapid development of technology. The purpose of this study is to find out the extent of the requirements and pillars in e-transactions according to the perspective of Islamic law and Indonesian law -act number 11 of 2008 on Information and Electronic, also, act number 19 of 2016 as Amendment of the act later. In addition, it was also to reveal the lack of material law explaining matters related to electronic transactions, so that it needed the addition of material on related issues. The results of this article are that electronic transactions are legitimate and permissible in Islamic law but with conditions that do not contradict and meet the provisions stipulated in Islamic Sharia. furthermore, As for the positive Indonesian law, it is not clearly stated about the terms and conditions of electronic transactions, except that there are some elements relating to electronic transactions along with their definitions and explanations.
