Abstract

Koperasi Jasa Keuangan Syariah Baitul Maal wat-Tamwil (KJKS BMT) is an organization that combines the concept of cooperatives and the concept of sharia. Both have the same spirit of kinship and mutual assistance (ta’awun). The concept is realized in the form of maal products and tamwil products, and accompanying activities, giving the product in question. Operational KJKS BMT based on the laws and regulations in the field of cooperatives.

Abstract

The  sea area of  Indonesia  reached 5.8 million  km2, with  a cluster of more  than 17,500  islands, promising a great  resource  in  facing  the ASEAN  single market. A  coastline  of  81,000  km which  is  actually  the  second longest  in  the world  after  Canada,  potentially,  become  a  storefront  variety  of  national  products which  are marketed around  the world.  But  the  single market  proposed  in  Asean  Economic Community  (AEC),  leaving homework, which  is  not  simple  in  the  ecological  sector.  The purpose  of  this writing  is  actually wanting  to show challenges  that must be faced when AEC creating  a single ASEAN market. Based on  the categorization of  legal  study analysis method,  the method  in use,  including method of dogmatic  research which developed legal  studies  as  a dogmatic  law  (Rechtsdogmatiek).  The  results  showed  that,  consciously or  not,  the Asean single market has brought a new myth called rationality efficiency of the commodity. Horkheimer and Adorno in  their  enlightment  dialectic  explained  that  in  the  field  of  economy,  efficiency  is  the  law  of  the market, substitutes  all  kinds of  feudal  and  religious  restrictions.  Then  rationality  equated with  efficiency. When  this efficiency is applied in the dynamics of the capitalist economy, what happens next is the entire field of human life will  become  a  commodity.  Then  came  the  so-called  reification,  that  is when  everything  becomes  acommodity,  people  no  longer  feel  enjoy  but  only  for  the  sake  of  consumption without  establishing  social relations  in  the  true  sense. At  this  situation,  the  ecological  damage  becomes  inevitable,  even  consideredreasonable  as  a price worth paying.  Law, which  in  essence  is  the  ethical  conversation  humans  to  produce justice,  easily  forgotten  because  of  greed.  In-depth  perspective  on  the  ecological  (deep  ecology), which essentially  is  in  the  interests  of  civilization,  began  excluded. But  all  such  reification  excesses  can  be  avoided when the law still pursued progressively, so the law must arrive at the radicality demolition on law assumptions. The  law  is not only  to  check  the  fairness,  but  it  should produce  justice, even  a new  kind of  justice,  namely justice  for the sake of  future generations  (intergeneration  justice).  It can be concluded  that the ocean  should not only being  taken  for  its wealth  resources  in  the  trap of  reification of  the ASEAN  single market, but also should be maintained,  its preservation  for  the  sake of our next generation  in  regard of  deep ecology.

Abstract

Criminal acts of sexual abuse under Article 82 of Law Protection of children, also under Article 292 of the Criminal Code, as general criminal law where criminal threats 5 years imprisonment, against the actions of sufficient age, who do obscene acts with other people the same sex, which known or reasonably should be expected, that was not old enough. These acts of abuse against people want castrated using chemicals. This paper provides an alternative in criminal policy for perpetrators of sexual disorder which criminal act of abuse by using medic rehabilitation and social rehabilitation, in Psychiatric Hospital or Psychiatric Therapy, considering the criminal act of abuse committed by perpetrators of sexual disorders like people whose souls disturbed because of illness, so that Article 44 can apply to cases.

Abstract

Due to pollution and environmental destruction that most feel  is  the victim. Most victims also suffered losses, both material  and  immaterial  losses,  therefore  it  is  natural  that  the  victims  should  receive protection.  The purpose of  this  research  is  to  analyze  about:  1)  the  resolution  of  environmental  cases which  occur  either through the courts or out of court; 2)  the implementation of legal protection for  the victims of pollution and environmental destruction; 3)  formulating  the  ideal model of legal protection for  the victims of pollution and environmental destruction by the corporation is based on the principles of restorative justice in the future. The research method  is used  the  socio-legal  research using primary and  secondary data. The  results  showed  that environmental cases can be  resolved through the court and outside the court. Ideal model of  legal protection for the  victims of pollution and  / or environmental destruction by the  corporation  is based on  the  restorative justice principle in the future.The offender in this case as the corporation will deal with victims of environmental pollution and the state  as a facilitator. The  Facilitator from  the state for this early stage could be  represented by a judge. In an agreement between  the perpetrator and the victim of the most important is the provision of compensation  from  the  offender  to  the  victim. Ideally  in  the  concept  forward  on major  and  compensation mechanism  is  stipulated  in  the  rules of  implementation.

Abstract

The Communal Right to Land (Hak Ulayat), both as the economic source and communal identity, should be empowered and be protected. This research studies the regulation of the utilization of Tanah Ulayat for the interest of investment and finds the root of its conflict in West Sumatera.  The result of the research concludes that there is no both horizontal and vertical synchronization in regulating of Tanah Ulayat. The regulations that have been enacted by DPRD and governor of West Sumatera are not in line with the Adat and Custom of Adat Community. Those regulations are also far from an ideal regulation and Syariah (Islamic Law), while the root of the conflict is the inconsistence between the regulation of Tanah Ulayat and its implementation which ignore the contract

Abstract

Nowadays, the refugees issue is becoming serious problem to the international community. The problems of refugees becomes increase day by day along with a man-made disaster or a nature disaster. The Rohingyas ethnic is one of examples for refugee who caused by man-made disaster. They, the Rohingyas, experienced a persecution done by the military junta of Myanmar, their own government. The government of Myanmar doesn’t recognized that the Rohingyas belong to the citizen of Myanmar. With this condition, the Rohingyas called as a stateless person. They have no citizenship status. So they have no protection from any countries because they are stateless. The persecution from the Myanmar’s government make them, the Rohingyas, fled to another countries to get an asylum. Sometimes the presence of refugees in the country of transit or destination countries were forcibly repatriated . Such treatment is clearly contrary to the principles of international law recognized by civilized nations.There are some regulations pertaining to the issue of refugees, which are guarantee the rights of refugee. The right to get an asylum as stated in Article 14 (1) Universal Declaration of Human Rights. But the fact, there are many violations in refugees treatment done by some countries. The study is normative legal research with Statute Approach and Case Approach. This study would analysis the Rohingyas asylum-seeker based on some international laws concerning this problem as for the 1951 Convention Relating to the Status of Refugees and its protocol. The result shows the international law relating to the refugees issu that applicable to the Rohingyas case.Keywords:

Abstract

Border dispute of Indonesia is not a new thing. Since Indonesia got its sovereignty, border had been becoming an unsolved problem until now. A problem that frequently happens is bordered disputes with neighboring countries that have a direct border with Indonesia either land or water borders. In addition, the Indonesian government should pay more attention to problems related to the welfare of people who live in the border. Development and facilities such as education, health, transportation, information and so on should be adequate. The Indonesian government should pay more attention to the needs of people in border areas, therefore they are not segregated from the external world. In accordance with that perspective, this paper would like to identify how the special autonomy of border areas could become the alternative solution to settle disputes in border areas. Generally, poverty and backwardness of people in border areas are the lack of their social and economic accessibility. Border areas have an important function since the complexity of problem that being faced. Border areas should be treated as a front yard, not the back yard of Republic of Indonesia. The treatment for border areas should be differentiated in accordance with the situation and condition of those areas. Therefore, metric decentralization should become the mindset of policy-making related to the relationship between the center and the region, especially related to the border areas and that is not reactive because of the demand of the region. Special autonomy in border areas is an option solution which is worth to be considered, to solve the complex problems in the border areas.

Abstract

This research aimed to evaluate and describe the political configuration of regional government and alignment of regional regulations which regulate the fulfillment of ecosoc rights of marginalized societies in West Kalimantan. By means of socio-legal approach, this research founds the fact of political configuration of Regional Government of West Kalimantan that is classified as democratic, does not automatically produces some regional regulation which stand up for (responsive) the fulfillment of ecosoc rights of marginalized societies. The Identification of its causes is regulatory problem due to the lack of unity of regulations which are synchronized and consistent, the low perception of both regional government and societies toward the existence of the fulfillment of ecosoc rights and the factor of absence of political will to regulate the regional regulations that based on alignment for marginalized societies. Ideally, the construction of regional regulations is not committed in discriminative and always accommodate the normative basic of human rights.

Abstract

This study is about interpretation of constitution, this study is based on the extent authority of the Constitutional Court on the  interpretation of  the constitution,  including various verdicts that are considered as controversial.The result of the study shows that Constitution 1945 giving authority of the constitution  interpretation of the Constitutional Court to evaluate the conflict of  legal norm, this could be meant that the Constitutional Court is “the guardian of  the constitution and the sole interpreting of constitution” and as the legitimate interpreter of  the constitution.  Some  interesting  in implementing  the  interpretation of  the constitution as a  standard  toevaluate  the conflict of  legal norm, consists of: First, essentially,  that the  interpretation of  the constitution  is one of the ways to elaborate understandings contained in constitution text. Second, related to the independence and the  freedom of judge in using an interpretation method which  is not  regulated by positive  law, therefore the judge is  free to use those interpretation methods which are appropriate with the conviction of the Justice. Justice  in  using  the  interpretation method  doesn’t  only  have  function  as  funnel of  the  act,  but  also  has functioned as the funnel of justice since a judge is required the value of the law and the sense of justice which exists in the society (substantial justice). Refer to  the theory of living constitution, therefore Constitution 1945 should be  understood  as  a  constitution which has  textual  and  contextual  dimention  Third,  the  restriction  in using the interpretation method, the constitutional judge couldn’t only focused into the originalism interpretation method which  only  based  to  original  intent  /  the  formulation  of  Constitution  1945  or  using  the  other interpretations  (non  originalist) which oppositely  those  interpretation  the 1945  Constitution doesn’t work according to system and/ or contended with  the main idea underlying the constitution itself entirely  related to the  purpo  se  that would  like  to be  realized.  Fourth,  the  use of  interpretation method  should  be  able  to  be accounted to  the publics, therefore the validity could be examined  in certain cases. This is very essential to dosince Constitutional Court has an extent interpretation authority so that it could keep justice of Constitutional Court  to avoid it from misuse of authority  in interpreting of 1945 Constitution.

Abstract

Boycott is one of violations in the competition law that eliminating the freedom of parties to enter the market. The aim of it no other than lessened fair competition. Theoretically, the issue related boycott discuss about the approach utilised by the authority to investigate and enforce boycott and its meaning: whether boycott is vertical or horizontal, or both; and what are the criteria of the violations? Given so few references on boycott, this paper attempts to reveal the regulation and the enforcement of it in the United States. It is aimed as reference to regulate and/or to settle the competition law cases of boycott in Indonesia in the future day. The United States does not specifically state boycott in the Antitrust Law. The United States includes boycott as concerted to deal and refuse to deal as ruled in the Section 1 of Sherman Act.
