Abstract

Polygamy allowed but with strict conditions. In this paper, I argue that the legal culture of polygamous marriage perpetrators is not solely influenced by the tight laws on polygamy but also other non legal factors, diverse legal cultures which directly affect on the diverse legal status of the perpetrators and children born in the marriage. Therefore, the paper scrutinized why the actors? legal culture in carrying out their polygamy marriage were negative and how the legal status and implications of the polygamous marriages to the marriages held by themselves and their children. The research method of social legal studies was used as the approach. The findings and analysis show how hard the actors met the requirements of the legal provisions on polygamy which are only one reason to justify it. In other hand, it was found that the non-legal dimensions were very complex and also influential so that the legal culture was negative. Consequently, polygamous marriage in siri was a political choice of their lives. It has the implications on the legal status of polygamous marriages and the perpetrators. The marital status is deemed to exist when the marriage is performed officially; and it is considered non-existent when the marriage is performed in siri. Polygamous marriage also has an impact on the legal status of the husband, his second wife, and their children in the family.

Abstract

The difference in views that often arises and becomes the latest issue in the context of family law is polygamy. Polygamy is misunderstood as something that is frightening for some people so it needs to be shunned.  This paper aims to explain various views about polygamy according to the Qur'anic text, hadith text and bible text. The method used is library research with a sociological-historical approach. The results of this study found several things, namely: polygamy in the text of the Koran and the hadith of the Prophet there are similarities and no differences were found, even the hadith of the Prophet became a reinforcement of the Koran about the limits of permissibility of polygamy with conditions apply fairly. Whereas polygamy in the text of the Bible is permitted without limitation on the number of women being polygamy and not being fair, even though Christians forbid polygamy.

Abstract

Thailand is a Moslem minority country with most of Moslem community centered at the plateu of its South area. As the minority, they can not perfrom shariah laws formally under official acknowledgment. Therefore, in dealing with any law practice, particularly marriage settlement, they rely on the rules of fiqh school followed by each local Datok Imam Masjid. The Datok himself exists in every village even subvillage and is a delegation from the Commitee of Islam at Province serving to deal with any religious affairs. However, The Commitee does not arrange particular rules in the marriage settlement so the practice is fully guided and handled by the Datok. On the basis of that, this research would like to use a qualitative approach through descriptive method. The data was compiled through interviews and documentation. Meanwhile, the respondents consist of the mosque staffs, the children of Datok Imam Masjid, local public figures and local people. It is found that the principles and requirements of marriage settlement are in line with common Islamic laws as stated in the Qur?an and hadith. Most of the Datok in the South Thailand serving as staffs of marriage settlement affiliate to Shafi?i school. However, as each datok has different views and beliefs on certain issues, the rules become too flexible such as in the matter of minimum age for the brides and bridegrooms or the existence of wali (Islamic guardian mainly from family line) as the marriage requirement. Additionally, the marriage settlement with a newly converted Moslem and ?free? polygamy also become big issues as there found no exact rule governing all the details. The settlement is also often hard to hold due to the expensive request of mahar (dowry) which cause the high number of eloping cases as the consequence. (Minoritas Muslim di Thailand Selatan Dataran Tinggi merupakan wilayah yang tidak mendapat kesempatan untuk melaksanakan hukum syari?ah secara resmi yang dapat diakui oleh negara. Oleh karenanya, pelaksanaan pernikahan bagi minoritas Muslim di Thailand Selatan ini masih menggunakan peraturan sesuai dengan mazhab masing-masing yang diurus oleh Datok Imam Masjid disetiap kampung. Datok Imam Masjid tersebut merupakan utusan dari Komite Islam Provinsiyang berwenang mengurus segala bentuk urusan keagamaan khususnya Islam. Walaupun begitu, Komite Islam di Thailand tidak memiliki aturan yang pasti tentang pelaksanaan perikahan sehingga aturan dari pelaksanaan pernikahan tersebut diserahkan sepenuhnya kepada Datok Imam Masjid. Berdasarkan hal tersebut, maka tujuan dari penelitian ini adalah untuk mengetahui bagaimana pelaksanaan pernikahan bagi minoritas Muslim di Thailand Selatan dan kajian hukum Islam tentang pelaksanaan pernikahan tersebut. Penelitian ini menggunakan pendekatan kualitatif dengan jenis deskriptif. Sumber data diperoleh melalui wawancara dan dokumentasi. Informan dalam penelitian ini yaitu pengurus masjid, anak Datok Imam masjid, tokoh masyarakat, dan masyarakat. Dari hasil penelitian didapatkan bahwa, rukun dalam pelaksanaan pernikahan sudah sesuai dengan hukum Islam. Pada umumnya Datok Imam Masjid di Thailand Selatan yang menjadi juru nikah menggunakan mazhab Syafi?i, namun adanya perbedaan pengetahuan agama pada setiap Datok Imam Masjid menyebabkan longgarnya aturan-aturan yang digunakan dalam pelaksanaan pernikahan, seperti halnya syarat usia calon mempelai dan penggunaan wali hakim dalam pernikahan, pernikahan dengan muallaf tanpa adanya perhatian khusus serta maraknya pernikahan poligami tanpa adanya batasan-batasan tertentu. Selain itu, pelaksanaan pernikahan seringkali terhambat oleh adanya permintaan jumlah mahar yang tinggi dari pihak perempuan yang menyebabkan banyaknya kasus kawin lari. Islam menganjurkan adanya pendewasaan diri sebelum menikah, menggunakan wali hakim sesuai dengan kondisi yang diperbolehkan, dan adanya batasan-batasan dalam melaksanakan pernikahan poligami. Mahar merupakan pemberian wajib namun tidak dibenarkan jika dapat menghambat dari pelaksanaan pernikahan. Pernikahan dengan para muallaf hendaknya diberikan pelatihan khusus sebelum melakukan pernikahan agar seseorang yang baru masuk Islam tidak kembali ke agama asalnya)

Abstract

This paper departs from the problem of why the government of Saudi Arabia changed its policy on women's rights in the public sphere by using case study No. Royal Decree No. M / 134 of 2019 concerning the lifting of the ban on women traveling without a mahram. This is interesting because Saudi Arabia is a country that is notorious for not allowing women to travel without male relatives. This is due to the social conditions of Saudi Arabia's society which are very closely related to the culture of the Patriarchy which constructs the thought of the division of roles between women and men. Seeing this fact, a comprehensive explanation is needed to explain the reasons behind the Saudi government's decision in the current situation. This research explores the factors that hold up the decision made using the feminism approach and analyzes the relationship between social change theory and legal reform. The main factor of women's freedom to travel without mahram is undeniably driven by the influence of economic and social changes. This is because the Saudis want their 2030 Vision to be achieved.

Abstract

Dalam persidangan cerai talak terkadang istri bersikap diam dan hanya pasrah dan  kemungkinan tidak mengetahui tentang  hak-hak yang dapat dituntut pada suami misalnya nafkah anak, nafkah iddah, mut?ah ataupun harta bersama sehingga jika prinsip hakim pasif tersebut digunakan secara penuh maka istri dapat kehilangan hak-haknya karena hakim tidak boleh memutus lebih. Dalam perkembangannya terdapat perubahan yaitu hakim perlu menggunakan prinsip hakim aktif sehingga putusan  akan memberikan nilai keadilan terhadap istri. Hasil penelitian menunjukan bahwa Pertama, hakim di Pengadilan Agama wilayah Madura menerima prinsip hakim aktif  dalam perkara cerai talak  walaupun penggunaannya secara terbatas mengingat pada dasarnya dalam hukum acara perdata menggunakan prinsip hakim pasif.  Dasar akseptabilitas prinsip tersebut didasarkan pada  peraturan perundangan-undangan yang memberikan hak ex officio, yang bertujuan  memberikan perlindungan terhadap hak-hak istri. Kedua, implementasi prinsip hakim aktif dalam perkara cerai talak untuk pemenuhan hak-hak istri di Pengadilan Agama wilayah Madura adalah memberikan penjelasan kepada istri tentang hak-hak istri pasca cerai yang dapat dituntut dari suami, menanyakan tentang keinginan-keinginan istri terutama yang berkait dengan hak-haknya ketika istri diam selama persidangan, selalu memberikan hak-hak istri dalam putusannya (ex officio) selama istri hadir di persidangan dan tidak dalam keadaan nusyuz serta menunda sidang ikrar talak maksimal enam bulan apabila  suami belum memenuhi hak-hak istri sebagaimana putusan pengadilan.

Abstract

This research was conducted in Kute Lintang Village, Blangkejeren Sub-district of Gayo Lues Regency, which discussed the poh roh assets, according to the Gayo Lues customary law, a discussion about the distribution of poh roh assets in the Gayo Lues community. This research applied descriptive method with a normative juridical approach to obtain secondary data, sociological juridical approach, and field research.  The distribution system of poh roh assets due to divorce can be done in 2 (two) ways, namely by consensus and carried out through jeuma opat. The conciliation process carried out by divorced husband and wife ussually carried out by way of deliberations involving family relatives from both huband and wife. Whereas dispute resolution through jeuma opat emphasizes family aspects through deliberations to reach consensus, so none from the husband or wife feels defeated or won and jeuma opat knows about the origin of the assets obtained during their marriages, which are inherited assets, where inheritance is obtained from heirs of husband and wife and where are the poh roh assets, then simplify jeuma opat in terms of dividing the poh roh assets if there is a divorce because it already knows the origin of the divorced husband and wife's assets. Legal Consequences if the poh roh assets not shared After the divorce in Gayo Lues is the status of the poh roh assets will be not clear, it means that the husband and wife can no longer separate which is inherited from poh roh assets, even between the inheritance and the poh roh assets has been mixed, so it is very it is difficult to determine the status of property in a marriage.

Abstract

Islamic banking and religious courts have a very close-knit network. Both Islamic banking serving as Islamic financial intermediation institution and religious courts as special courts with authority to resolve the dispute of  Islamic banking similarly stressed on applying the sharia principles in the operation. They are expected to sinergically rely on sharia principles. The philosophical basic of religious courts? authority  in dispute settlement of shariah banking  is to create a harmony between the execution of contract and material law based on the principles of sharia with religious courts as an institutiton for Moslem justice-seekers so that the disputes can be resolved wholly (kafa?ah) and consistently (istiqomah) through court rulings upholding the culture of law. The meeting of values of sharia and culture living in society produces harmony in terms of Islamic banking dispute settlement. (Keberadaan Perbankan Syariah dan Peradilan Agama memiliki keterkaitan yang sangat erat. Perbankan Syariah sebagai lembaga intermediasi keuangan syariah dan Peradilan Agama sebagai lembaga peradilan khusus yang mempunyai kewenangan ablosut menyelesaikan sengketa perbankan syariah sama-sama menekankan menerapkan prinsip-prinsip syariah dalam operasionalnya. Perbankan Syariah dan peradilan agama diharapkan dapat bersinergis dengan berpegang pada prinsip syariah. Dasar filosofis Kewenangan Peradilan Agama dalam Penyelesaian sengketa perbankan syari?ah adalah agar terciptanya keselarasan antara pelaksanaan akad dan hukum materiil yang berlandaskan prinsip-prinsip syariah dengan lembaga peradilan agama yang memang merupakan wadah bagi pencari keadilan yang beragama islam sehingga sengketa perbankan syariah dapat diselesaikan secara kafaah dan istiqomah melalui putusan pengadilan yang mengedepankan budaya hukum. Pertemuan nilai syariah dan budaya yang hidup dalam masyarakat menghasilkan harmoni dalam penyelesaian sengketa perbankan syariah)

Abstract

Karya di bidang hadits sangat kaya, baik dari segi kuantitas,ragam kajian maupun metodologi penyusunannya. Dengankarya yang demikian banyak, tentu tidak mudah untukmengkaji dan mengenal seluruhnya. Faktor ini membuatsebagian pengkaji ilmu keislaman kurang tepat dalambereferensi terhadap kitab-kitab hadits. Oleh karena itu, perluterdapat kajian mengenai ragam dan karakteristik kitab-kitabhadits untuk memudahkan melacak maupun mereferensipada setiap hadits yang diambil. Tulisan ini tidak mencakupseluruh kitab hadits, namun memfokuskan pada beberapamacam kitab hadits, seperti kitab-kitab induk hadits, kitabkitabsyarh, kitab-kitab penghimpunan dan kitab-kitab rijal.Kitab induk hadits merupakan kitab yang ditulis mukharrijhadits dengan sanad bersambung sampai ke nabi tanpamengutip dari kitab-kitab ulama yang lain. Kepada kitab-kitabinilah setiap penukilan hadits dirujuk. Kitab-kitab syarh haditsmerupakan penjelasan terhadap kitab-kitab induk tertentumengenai makna matn hadits maupun tentang sanad-nya.Kitab penghimpunan merupakan kumpulan hadits-hadits dariberbagai kitab induk hadits sesuai dengan tema yangdiinginkan penulis kitabnya. Kitab-kitab inilah yang seringdisalahartikan sebagai kitab induk hadits. Adapun kitab rijâlal-hadîts membicarakan mengenai para periwayat hadits,ditujukan untuk menilai validitas hadits dari sisi sanad, baikketersambungannya, atau cacat tidaknya seorang rawî.

Abstract

Abstract: Islamic law has been valid since a long time ago in Indonesia and it expriences dynamical effect since the era of ancient kingdom, colonialism, and post-independence. The population of Muslim is major, it reaches more  than 200 hundred millions people. This becomes sociological and functional considerations to the validity of Islamic law in Indonesia. For the shake of effectiveness, efficiency, and Muslim aspiration fulfillment, it seems feasible to adopt Islamic law as a part of public law. Indonesia is not a secular country, it is not necessary to seperate religious and statehood affairs. In advance, Islamic law has been partly adopted and it inspires the Indonesian legislation. Abstract

Pertentangan antara hadits-hadits tentang menangisi mayit seringkali berdampak langsung kepada masyarakat akar rumput, sehingga sekedar menitikkan air mata karena keluarganya meninggal akan membuat yang lain menghardik dengan alasan bahwa si mayit akan disiksa di dalam kubur ketika ada yang menangis atau si mayit akan menjadi hantu. Pertentangan dalam masalah ini akan coba penulis kaji dan selesaikan dengan metode Mukhtalif Hadits. Ilmu Mukhtalif Hadits merupakan ilmu yang membahas pertentangan hadits dengan hadits lain, dengan al-Qur’an, logika dan fakta, baik pertentangannya secara zhahir atau hakiki. Hal ini senada dengan cakupan pembahasan kitab-kitab tentang mukhtalif hadits, diantaranya Ta`wîl Mukhtalif al-Hadîts karya Abî Muhammad Abdullah ibn Muslim Qutaibah (213-276 H). Secara esensi, pertentangan antara satu hadits dengan yang lain hanyalah pada zhahirnya dan tidak bersifat hakiki, mengingat keseluruhannya bersumber dari Allah swt.
