Abstract

Syariah menjadi kajian unik bukan hanya dimaknai sebagai entitas wajib patuh, namun juga karena posisi yuridisinya yang dilematis dalam hukum nasional. Tulisan ini berusaha untuk menganalisis implementasi perda syariah dalam otonomi daerah di Indonesia. Keberadaan perda syariah selama ini masih dilematis baik dari segi konsep maupun implementasi. Banyak kalangan menilai bahwa perda syariah sendiri dipandang tidak perlu, namun ada juga yang menilai bahwa perda syariah sendiri penting dalam menjaga moral masyarakat. Meskipun demikian, secara yuridis formal perda syariah tidak berlaku secara konstitusional, namun keberadaan perda syariah masih dipertahankan hingga kini. Bahkan perda syariah sendiri cenderung terpolitisasi daripada menegakkan ketertiban. Tulisan ini akan mengelaborasi lebih lanjut bagaimana kedudukan perda syariah dalam otonomi daerah di Indonesia, apakah ia hanya sebagai alat politik untuk menarik dukungan masyarakat bagi partai politiknya atau memang murni aspirasi masyarakat.

Abstract

AbstractThis article aims to analyze relation between local wisdom within religion conflictsresolution in post conflict divided society of Maluku. In the case of Maluku conflictreligion was not core sources, but rivalry among societal element to compete forbureaucracy position and economic-politic resources. Religion is only becomingsupporting conflict which provides moral legitimation and politic identity to strikeothers. The history of Maluku conflict indicated by subordination and dominationrelations that resulted discrimination and marginalization amidst society. Thefallacy of the new order regime in 1999 can be said conflict escalation in Maluku thatmurdered million innocent peoples. Maluku conflict had resolved by Malino peacetreaty in 2002 and 2003, however potency of conflict in grassroots can be reduced bylocal wisdom values. Pela gandong as local wisdom had a pivotal role inreconciliation process to recapitalize social capital which cracked during conflict. Inaddition to local wisdom, representation in bureaucracy also hold role player toreducing social gap between society elemental in Maluku.***Tulisan ini bertujuan untuk menganalisis kearifan lokal sebagai resolusi konflikkeagamaan di masyarakat pasca konflik Maluku. Dalam kasus konflik Maluku,agama bukanlah sumber utama, namun rivalitas antar elemen masyarakat dalammemperebutkan sumber daya ekonomi-politik dan birokrasi yang menjadi permasalahannya.Agama hanya menjadi faktor pendukung yang menyediakan adanyalegitimasi moral dan identitas politik untuk melakukan kekerasan terhadaporang lain. Sejarah konflik Maluku ditandai dengan relasi subordinasi dan dominasiyang menghasilkan adanya diskriminasi dan marjinalisasi di tengah masyarakat.Jatuhnya rezim Orde Baru tahun 1999 dapat dikatakan sebagai puncakkonflik Maluku yang telah membunuh jutaan nyawa manusia tidak bersalah.Konflik Maluku telah diselesaikan melalui perjanjian damai Malino tahun 2002dan 2003, namun demikian potensi konflik di akar masyarakat dapat dikurangimelalui nilai-nilai kearifan lokal. Pela gandong sebagai kearifan lokal mempunyaiperan penting dalam rekonsiliasi dengan menyatukan kembali solidaritas masyarakatyang terpecah selama konflik. Selain halnya kearifan lokal, representasidalam birokrasi juga memegang peran utama dalam mereduksi kesenjangansosial antara elemen masyarakat di Maluku.Keywords: kearifan lokal, pela gandong, resolusi konflik, konflik Maluku

Abstract

This article aims to analyze comparatively towards the status and position of temporary employees in Act of 43/1999 and government employees with contract agreements in Act of 5/2014. Analysis has focused on the main duties and functions of state / country and its standings in state employee management. The results of this study indicate that there is evolution in analyzing non-permanent employees form theLaw No. 43/1999 and the latest replacement rules which is Act of 5/2014. The lack of clarity regarding the status, position, and the fate of temporary employees,which has not previously accommodated in Employment Act, has been clarified in the Act of 5/2014.Keywords : Temporary Employee, Civil Services, Merit System, Bureaucracy SystemArtikel ini bertujuan untuk menganalisis tentang status dan kedudukan pegawai tidak tetap baik dalam Undang-Undang Nomor 43 Tahun 1999 dan Undang-Undang Nomor 5 Tahun 2014. Analisa yang ditampilkan berlokus kepada tugas pokok fungsi maupun status/kedudukannya dalam manajemen kepegawaian negara. Hasil penelitian ini menunjukkan bahwa terjadi evolusi dalam menganalisis pegawai tidak tetap dari Undang-Undang Nomor 43 Tahun 1999 hingga yang terbarukan dalam Undang-Undang Nomor 43 Tahun 1999. Ketidakjelasan mengenai status, kedudukan, nasib yang selama ini belum diakomodir dalam Undang-Undang Kepegawaian sebelumnya, kini sudah diperjelas semuanya dalam Undang-Undang ASN 2014 ini.Kata Kunci : Pegawai Tidak Tetap, Pegawai Negeri Sipil, Sistem Merit

Abstract

Paradigm shift in public services to be more transparent, accountable, and participatory encountered many obstacles at its implementation. Constraints are not only coming from the government officials but also from the people who do not fully believe in the improvement efforts being taken by the government. Taking the example of One Stop Service (Samsat) in the city of Yogyakarta, this paper presents a portrait of public service delivery that is still full of practices that are inconsistent with the principles of new public management.

Abstract

This article aims to analyze the comparative study of the liberation theologyperspective. The notion of liberation theology is a form of transformative theologythat concerned within issues of equality and social justice. The relationship amidstreligion and politics is reciprocal due to there are conflicts of interest betweenboth entities. Emergence of liberation theology itself arises because of thepoliticization of religion has become more acute and chronic so it needs to betransformed. The thought of liberation theology is basically grown in the famouscase of Latin America with the spirit church of the poor. However, within Islam, italso found a similar essence that Islam also teaches that there egalitarianism,equality, and social justice. Article will elaborate about this comparison ofliberation theology.***Artikel ini bertujuan untuk menganalisis studi perbandingan perspektif teologipembebasan. Gagasan teologi pembebasan adalah suatu bentuk teologi transformatifyang bersangkutan dalam isu-isu kesetaraan dan keadilan sosial.Hubungan di tengah-tengah agama dan politik adalah timbal balik karena adakonflik kepentingan antara kedua entitas. Munculnya teologi pembebasan itusendiri timbul karena adanya politisasi agama telah menjadi lebih akut dan kronissehingga perlu diubah. Pikiran teologi pembebasan pada dasarnya tumbuh dalamkasus terkenal Amerika Latin dengan semangat gereja kaum miskin. Namun,dalam Islam, itu juga menemukan esensi yang sama bahwa Islam jugamengajarkan bahwa ada egalitarianisme, kesetaraan, dan keadilan sosial. Abstract

The discussion about concept of celebrity politics is a new study in the social sciences and politicallandscape in the new Indonesian electoral democracy post-1999. Phenomenon of celebrity into therealm of practical politics itself actually comes as a vote getter nature every political campaign. Theexistence of massive publicity in the media as well as a performance appears to attract public sympathy.However, the pattern of these celebrities also performed by politicians to show any aspect of theirdaily life to become material for public consumption. The implication is that creating any sympathyand empathy from the public to candidate or party. Political journalism plays a major role in creatingboth the presence of the news by creating better and vice versa, creating a presence of construction tocandidates or parties. This paper will elaborate more on this celebrity political perspective.

Abstract

This article aims to analyze historicity of political participation and representation of women in the political landscape in Indonesia. This paper used the perspective of feminism theory as core analysis in reviewing its issue. Periodicity of Indonesian womens political participation is very volatile and depends on the political situation contemporary. Indonesian womens political participation in the era of colonialism experienced domestication, revivalism in the Sukarno era, stigmatization in the New Order era, and is now experiencing ambiguity in the Reformation era. Abstract

This article aims to analyze genealogies of Muslim middle class in Indonesia. It can be traced from three primary sources such as bourgeoisies, pilgrimage trip (h}ajj) to Mecca and Medina, and education. These three sources have intertwined each other to build up Muslim middle class in social strata system that branch off in two model; bourguoises class and intellectual class. In this section, bourguoises tends to form trade alliance against Chinese domaniance and western traders who had been given privilieges from colonial regime. Meanwhile, intellectual class had focused to form ideal state for umat in Indonesia. Both classes are united altogether to form Islamic state as ultimate goals. High tension of political constellation in post colonial period had resulted in nationalist group as regulator class in Indonesia. Regarding political negotiation from nationalist, Indonesian Muslim middle class focused to establish Muslim society according to Medinan principles. Modern influence based on western style has affected Islamic values in grass roots level, and this resulted in the rise of modern Muslim society that embraced western style of life.

Abstract

Tulisan ini menganalisis korelasi bonus demografi dengan pertumbuhan ekonomi di Indonesia. Bonus demografi diasumsikan dapat mendongkrak perekonomian nasional melalui pertumbuhan tenaga kerja produktif. Dalam kasus Indonesia, bonus demografi belum dioptimalkan secara maksimal karena kebijakan pemerintah yang masih setengah hati. Ekonomi Indonesia tumbuh melalui konsumsi kelas menengah yang didapat dari bonus demografi. Namun konsumsi perlu diimbangi dengan produktivitas sehingga Indonesia terhindar dari jebakan negara berpenghasilan menengah. Tulisan ini akan mengelaborasi lebih lanjut bonus demografi dalam konteks perekonomian Indonesia.

Abstract

This article traces to endeavor the concept of public services in the practice of inclusive citizenship. Contextualization of citizens should be important to be argued in order state effort to fulfilling its citizen basic needs. There are three major schools of public service regime; the liberal, social democratic, and social investment wherein each paradigm gives a different sense of the citizens. Liberal regime defines citizen guaranteed to choose their public service pattern, amidst state or market. Social democratic regime emphasizes obligatory state in terms of public services for its citizens. Meanwhile, the social investment act rationally in providing services to its citizens. The paradigm of Inclusive citizenship emerges as a form of alternative response of the third paradigm in providing public services and comprehensive democratic to every citizen. Implementation of inclusive citizenship toward public service reform is urging and significant to recommend how far and beyond state posited citizen as their client who must be served vice versa. This article will elaborate more on the meaning of inclusive citizenship in the public service.
