Abstract

Kontrak merupakan hubungan interpersonal hak dasar manusia.  Apakah  hukum kontrak Indonesia melindungi hak dasar manusia, dan apa ratio pembedaan batal relatif dan absolut suatu kontrak,  karena ada pendapat dalam praktik pengadilan pembedaan itu tidak ada gunanya. Tujuan artikel ini mengkaji hak dasar manusia yang dilindungi oleh hukum kontrak  dan ratio pembedaan pembatalan kontrak. Artikel ini suatu studi kepustakaan merupakan kajian yuridis normatif analitik. Metode yang digunakan hermeneutik hukum, Data yang digunakan data sekunder yaitu bahan hukum primer, sekunder dan tertier. Data dianalisis secara kualitatif. Pembahasan meliputi hak dasar dalam hukum kontrak dan dasar pembedaan batal relatif dan absolut suatu kontrak. Kesimpulannya  hukum kontrak Indonesia melindungi hak hidup, kebebasan dan milik sebagai hak dasar manusia. Ratio batal relatif suatu kontrak untuk melindungi kedaulatan individu, batal absolut melindungi kepentingan perseorangan dan kepentingan umum. Hakim dalam menyelesaikan sengketa kontrak hendaknya melindungi dan menghormati hak dasar manusia sebagai hak hukum. Pembedaan pembatalan kontrak yang ada perlu dipertahankan dalam pembaharuan hukum kontrak Indonesia.

Abstract

The idea the President election directly by the fpeople is not validated because it contra dicts with the basic political principles (ideal principles, Pancasila) and formal judical principle as expressed on Paragraph 1 article (2) Constitution 1945. In the frame of strengthen for law supremacy it will bee any clash between the political will and the,law desires about President election directly by the People. -

Abstract

The aim of this study was to measure the effectiveness of English "Shock Day" to improve university students' speaking ability. It employed a quantitative method using the pre-experimental design. The subject of the research was the fourth-semester students in one of the private universities in South Sulawesi, Indonesia, in the academic year of 2018/2019. The total population of this research was 76 students. The total number of the sample was 25 students were taken by cluster sampling technique. The instrument was a speaking test to obtain data on the students' speaking achievement through the implementation of English shock day. The data analysis found that the students' mean score in English speaking was significantly improved. The students' mean score in the pretest was 58.36, while their mean score in the posttest was 70.68. The t-table was also lower than the t-test, that is 2.093 < 6.650. Based on the result, the researchers concluded that the implementation of English shock day improved students' ability to speak.
