Abstract

This article discusses the concept of democracy and the Islamic rule of law. Democracy is the supreme sovereignty of the people hands. On the other hand,  Islam is considered to theocracy, the highest of power is Gods sovereignty. Both are different, but that there is an idea that  Islamology discourse ignores the contradictions between them, such as the concept of theo-democracy and concepts of Islam substantially. Both assume that Islam is relevant to democracy, such as tolerance, justice and equality. This ignores the formality of Islam, and does not emphasize a formal implementation of sharia. Islamic law (sharia), can be implemented in a modern state, especially in Indonesia, by following the procedures in the legal system and modern law. The steps which being taken are the formulation, socialization and political stages.

Abstract

The Fourth Summit of the Organization of Islamic Cooperation (OIC) at 1984 in Casablanca Morocco had issued Resolution 2/4-P(IS) which puts attention to the City of al-Quds. The resolution condemned Israeli government who destroyed religious sites in al-Aqsa Mosque complex, asked for reversion of the Palestinian sovereignty over al-Aqsa Mosque, and commanded the OIC members to make all necessary actions to impose sanctions against Israeli government politi¬cally, economically and culturally. Ineffectiveness of this resolu¬tion has been mainly caused by a number of factors, are: firstly, the level of colla¬¬bo¬ra¬tion and collectivity among the members of the OIC is low. Secondly, the resolution is highly vulnerable.Thirdly, there is no such rule in the OIC which ensures the implementation of the OIC’s resolu¬tions for its members. There is no a dominant state which becomes the leader of the OIC. This condition has been worsened by the lack of epistemic community roles in the drafting process of the OIC resolutions

Abstract

In the scheme of organization, Prosperous Justice Party (PKS) and Hizb Tahrir Indonesia (HTI) are historically and ideologically bound in a solid emotional relationship. The two organizations are basically rooted in a transnational Islamic movement although in later devel- opment they ultimately develop their movements in different spheres; PKS focuses at the level of intra parliamentary with a formal political label whereas HTI concentrates at the level of extra parliamentary as a non-formal organizational movement. HTI, which openly refuses the system of democracy, as a matter of fact benefits significantly from de- mocracy in Indonesia as a “political blessing.” HTI strongly criticizes the system of democracy in Indonesia and as a substitute proposes the system of Khilafah. Ironically, HTI gains freedom to perform its move- ment, to speak, and to campaign as Indonesia applies democracy.
