Abstract

Lesbian, Gay, Bisexual and Transgender (LGBT) phenomena are a minority group that is asking for recognition to be legalized and wants to change the social order in which its existence uses human rights as its legal protection. But when viewed from the noble ideals of the Indonesian people, the legalization of the existence of LGBT cannot be justified. Because the human rights in force in Indonesia are particular human rights adopted from the noble ideals of this nation. Until now, LGBT actors have often corrected and campaigned for their wishes so that same-sex marriage would be legalized. As a country based on the One Godhead, the campaign and speech made by LGBT actors are unacceptable even though human rights regulate freedom of speech and opinion. The Indonesian perspective as the Pancasila Law State towards the existence of LGBT still views Pancasila as the source of all legal sources, even though the rules governing LGBT behavior are not clearly available to ensnare the perpetrators. The hope of the people in the Indonesian Government is that LGBT behavior can be ensnared by imprisonment because it is not in accordance with the principles of life of this nation. Abstract

This study is based on the high administrative and criminal violations in the elections in Indonesia, so an assessment is needed to strengthen the authority of Bawaslu in the implementation of elections, in order to improve the quality of elections, and create good electoral law enforcement practices in Indonesia. To study this matter, hence in this research a normative juridical research, using approach statute approach, historical, conseptual, case, and comparative approaches was employed. Then the collected legal materials were descriptively and qualitatively analyzed. The strengthening of this delicate authority is accomplished by accompanying improvement in some other vital aspects such as the regulatory improvements on the institutional and electoral arrangements that give Bawaslu a more assertiveness space that is more ideal in the electoral law enforcement. Abstract

Masalah yang diteli yakni disharmonisasi ketentuan pidana pembakaran hutan dan lahan dalam peraturan perundang-undangan. Tujuannya untuk menganalisis disharmonisasi ketentuan pidana pembakaran hutan dan lahan dalam peraturan perundang-undangan di Indonesia, serta menemukan konsep pengaturan ketentuan pidana yang ideal. Metode penelitian menggunakan jenis penelitian hukum normatif, pendekatan penelitian yang dilakukan adalah pendekatan perundang-undangan, pendekatan Konsep, dan pendekatan kasus. Hasil penelitian ini yaitu pertama terdapat ketidak konsistenan norma dalam pengaturan larangan pembakaran hutan dan lahan pada Undang Undang No. 32 Tahun 2009, disatu sisi melarang pembakaran hutan dan disisi yang lain tetap mengizinkan adanya pembakaran hutan dengan luasan maksimal adalah 2 hektar berbeda dengan Undang Undang No. 41 Tahun 1999 dan Undang-Undang Nomor 39 Tahun 2014. Akibat dari disharmonisasi adalah multitafsir penegak hukum dalam menindak pelakunya mengingat banyaknya tindakan tersebut hanya demi keuntungan ekonomis. Kedua tidak bisa dipungkiri hukum selalu tertinggal dalam dinamika kehidupan masyarakat sehingga harus selalu mengevaluasi guna pembaharuan demi tercitanya tujuan hukum yakni keadilan, kepastian dan kemanfaatan hukum bagi masyarakat. Harmonisasi yang diusulkan peneliti adalah mengikuti rumusan satu udang-undang saja. Kata Kunci: Disharmonisasi, Pembakaran hutan, ketentuan pidana

Abstract

That tax is a transfer from the private sector to the government sector with no direct repayment, so more than 70% of the State?s revenues are derived from tax collection. With a self-assessment system in which the taxpayer is given trust to calculate his own tax amount, some gaps occurs in terms of the amount of tax payable and this causes some disputes dealing with the amount of taxes paid either by fiscus (tax collector) with that of the taxpayer. Therefore, disputes arise bout the amount of outstanding taxes that outstanding. To settle the tax disputes a separate judicial body that will resolve the settlement of the tax dispute is required. The existence of the Tax Court occupies a special place in the structure of the judicial organization, although initially the presence of the tax court becomes a matter of whether the tax court can be classified as a judicial institution, considering that in the tax law court, the Law No.14 of 2002 on Tax Court does not contain and explain clearly the position of the tax court. However, the status of the Court of Taxation is special under the administrative court of the State as affirmed in Article 9 A of Law Number 51 Year 2009 on State Administrative Court. So it is quite clear that the tax court is one part of the judicial system in Indonesia. Keywords: Existence, Tax Court, Judicature.

Abstract

People in the archipelago view togetherness and harmony is a fundamental thing that sustains the existence of the community, both in the perspective of religiosity (ketauhidan), culture and economy. Society in the archipelago sees harmony is a grace as well as a mandate that must be maintained and kept. The role of local values in conflict resolutions can be modeled in many cases. An Anthropological approach is interesting to use, because Indonesians are culturally diverse, which can provide empirical explanations in social and community structures. The future of conflict resolutions can refer to the value of local community?s wisdom. With the principle of deliberation aims to involve or invite all parties to participate in community life, so that loyalty and adherence of the people to what is all agreed would be also maintained together, because the agreement is the fruit of thoughts and opinions in the nuances of kinship and ?saling satingi? (mutual respect). ?Saling satingi? is the noble value of society in Sumbawa can be used as a model, and the local wisdom in the archipelago can be utilized for resolving conficts in ethnic groups, religions, and races in maintaining unity, peace and community brotherhood. Abstract

Penelitian ini bertujuan untuk mengetahui bentuk Modifikasi Hukum Kewenangan Inspektorat Daerah Kabupaten/Kota dalam Mencegah Terjadinya Tindak Pidana Korupsi di Pemerintah Daerah Kabupaten/Kota. Dengan menggunakan metode penelitian hukum normatif yang bersifat deskriptif-analisis. Hasil menunjukkan bahwa kewenangan yang dimiliki Inspektorat Daerah Kabupaten/Kota sebagaimana diatur dalam beberapa peraturan perundang-undangan mendesak untuk dimodifikasi untuk memperkuat kewenangan Inspektorat Kabupaten/Kota dalam mencegah terjadinya tindak pidana korupsi di Pemerintah Daerah Kabupaten/Kota. Modifikasi dimaksud dilakukan dalam bentuk revisi/perubahan peraturan perundang-undangan, di mana saat ini kedudukan Inspektorat Kabupaten/Kota masih sejajar dengan Organisasi Perangkat Daerah, ke depan menjadi sejajar dengan Sekretaris Daerah. Modifikasi kedua dilakukan dalam bentuk reposisi Peran/Tugas Inspektorat Daerah Kabupaten/Kota dengan cara mendorong terwujudnya Good Governance dan Clean Government, Menumbuh kembangkan Sinergi Pengawasan, Mendukung Upaya Pemberantasan KKN, Mengoptimalkan Peningkatan Penerimaan Negara, Berperan dalam Pelaksanaan Otonomi Daerah. Sedangkan modifikasi ketiga yang dapat dilakukan dengan cara Pengembangan Kelembagaan melalui pengembangan struktur, Prosedur Kerja, dan Sumber Daya Manusia. Abstract

Up to the present, the Law on Employment has not regulated firmly and clearly the retirement age limit of workers/labors. Therefore, although the protection of the labors? rights have been regulated in such a way in the regulation, but it has not been able to give a complete protection to the workers/labors. The results of the present research are as follows: the legal protection to the workers/labors? rights, viewed from the Constitution, is that the state intends to provide welfare to its people, but in the context of the Law no. 13 year of 2003 no clear retirement age limit of workers/labors is clearly stated. At the levels of policies under the law such as PK, PP, or PKB, some do not regulated it further. Therefore, labor unions should play their roles to make further regulation about the matter. On the other hand, supervision over workers/labors is inadequate since it is done by the province. Due to this problem, the Law No. 13 Year of 1003 on Employment should be revised by including the determination of the retirement age limit in order to protect them. Abstract

After the Presidential Decree No. 165 year of 2014 on the Tasks Arrangement and Functions of the Working Cabinet was issued, there is a trade-off in the authority of the rural areas management between the Ministry of Domestic Affairs and the Ministry of Village, Underdeveloped Regions, and Transmigration. There was disharmony between the the Minister of Domestic Affairs and of Village, Underdeveloped Regions and Transmigration in terms of the governance arrangement of the authority of the village government and of any financial collection and the arrangement of the village fund. There have been four Legal efforts made to harmonize the two ministries: horizontal harmony, joint decision letters, repeal or cancelation by the related institutions or the institutions above them and executive or judicative reviews. Executive review is the testing rights adherent to the executive institution to test any legislation and to cancel it if it seems to be in contradiction with the higher legislation of with public interest. Judicative review is the testing of a legislation under the law by the Supreme Court. Abstract

ABSTRACT Pancasila is the ideology of Indonesia. One of the precepts of Pancasila is the principle of Social Justice for All Indonesians implies that all Indonesian people have the same position before the law. But nowdays, there have been many cases of injustice against the underprivileged people. Therefore, this research journal is the realization of social justice for the underprivileged people in the philosophy of law, especially based on the theory named Critical Legal Studies. Abstract

Social security is one of the constitutional rights of citizens, in accordance with article 28 H (3) of the 1945 Constitution of the Republic of Indonesia. The State of Indonesia has changed the social security model several times, ranging from Health Insurance (ASKES) to the latest, namely BPJS. The implementation of BPJS has not been able to solve the problems that arise. The state has a full authority to monopolize the social security with all sanctions that can be imposed if it is not incorporated therein. The question arises as to the idea of delegation of monopoly authority in the provision of social security from before BPJS to BPJS. The rationale is Article 33 verse (2) of the 1945 Constitution and Article 51 of Law Number 5 in the Year of 1999. Keywords: BPJS, Monopoly Authority, Social Security.
