Abstract

AbstractThe article discusses maritime security in South China Sea based on security concept by Barry Buzan. According to Buzan, analysis of security is divided into three levels: individual, national and international. In addition, security dimension consists of military security, politics, societal, economics and environment. Maritime security can be seen as the combination of preventive and responsive measures to protect the maritime domain against threats and intentional unlawful acts. With this concept, maritime security in South China Sea considers three level analyses and in same time involve multi dimension of security factors. Security in the area should put in correct perspective to get full understand of complexity this matter.Keywords: Maritime Security, South China Sea, Barry Buzan, Security Dimension AbstrakArtikel ini mendiskusikan tentang keamanan maritim di Laut Cina Selatan berdasarkan konsep keamanan oleh Barry Buzan. Menurut Buzan, analisis keamanan dibagi menjadi tiga tahap: individual, nasional dan internasional. Selain itu, dimensi keamanan terdiri dari keamanan militer, politik, sosial, ekonomi dan lingkungan. Keamanan Maritim dapat dilihat sebagai kombinasi dari tindakan preventif dan responsif untuk menjaga domain maritim dari ancaman dan tindakan pelanggaran hukum. Dengan konsep ini, keamanan maritim di Laut Cina Selatan mempertimbangkan tiga tahap analisis dan melibatkan faktor-faktor keamanan multi dimensi. Keamanan di daerah tersebut perlu dinilai dengan perspektif yang tepat untuk memahami kerumitan masalah ini.Kata Kunci: Keamanan Maritim, Laut Cina Selatan, Barry Buzan dan Dimensi Keamanan

Abstract

AbstractThis paper argues to push and open participative democratization space for citizens, particularly the destitute and marginalized, to actively participate in public decision making that implicate their future quality of life, including involvement in community policing or Polmas. Examples from all over the world identified from various studies show that the more expansive and intensive the participation involvement of citizens in a country governance, development continuity will be cheaper and easier to push towards.Keywords: participative democracy, community policing, Polmas and Forum Warga AbstrakTulisan ini mengundang perdebatan untuk mendorong dan membuka ruang demokratisasi partisipatif bagi warga negara, khususnya kelompok miskin dan marginal terlibat secara aktif dalam proses-proses pengambilan keputusan publik yang berimplikasi atas perbaikan kualitas hidupnya dimasa mendatang, termasuk keterlibatan dalam konsep community policing atau Polmas.  Contoh dari berbagai penjuru dunia yang telah diidentifikasi dari berbagai studi menunjukan bahwa makin luas dan intensif keterlibatan partisipasi warga dalam managemen tata kelola negara, makin murah dan mudah mendorong keberlangsungan pembangunan.Kata Kunci: demokrasi partisipatif, community policing, Polmas dan Forum Warga

Abstract

Discourse of Global Governance came along with globalization. This article will not showing reader about the debates among scholars regarding the wide definition of globalization, rather this article is a production of critical consciousness. Using Foucault?s governmentality in order to dismantle the technology of power this article explains how then globalization with the issues that came along with its discourse.In this case I raise human rights issue that becoming the political rationalization of protecting of migrant worker must be started from human rights discourse and take it as the regime of truth.

Abstract

Banyaknya kritikan tajam atas efektifitas pidana penjara yang ternyata tidak mampu menurunkan tingkat kriminalitas di suatu negara memerlukan alternatif penyelesaian lain dalam mengatasi hal ini. Selain itu, adanya penelitian yang menunjukkan bahwa hakim di Indonesia ternyata memiliki kecenderungan menjatuhkan putusan pemidanaan terhadap perbuatan pidana dengan ancaman pidana di bawah 5 (lima) tahun yang tergolong tindak pidana ringan. Konsep Pemaafan Hakim bersaman dengan Tujuan Pemidanaan yang akan diterapkan dalam Rancangan Kitab Undang-Undang Hukum Pidana (RKUHP) di Indonesia dan telah juga diterapkan di beberapa negara merupakan salah satu alternatif penjatuhan pidana penjara pendek dan koreksi yudisial terhadap asas legalitas, di mana pada akhirnya diharapkan konsep ini dapat menurunkan tingkat kriminalitas yang ada.

Abstract

Problem utama yang dikaji dalam tulisan ini adalah penegakan HAM dalam penanggulangan terorisme. Respon terhadap aksi terorisme disinyalir cenderung memperumit jalannya proses demokratisasi dan penegakan HAM di banyak negara, tidak ada keseimbangan di antara security dan liberty dalam kebijakan perang melawan terorisme. Perang terhadap terorisme telah menempatkan kebebasan bukan lagi hal yang utama untuk dilindungi negara. Untuk dan demi atas nama keamanan, kebebasan untuk sementara waktu sah hukumnya dibatasi bahkan di intervensi oleh negara. Pada titik ini penulis mengemukan pertanyaan apakah ?zaman hak? (the age of rights) sudah berakhir sejak 11 september 2001?, padahal salah satu tugas negara adalah memberikan perlindungan kebebasan dan keamanan terhadap warga negara. Demikian pula, HAM mendapatkan jaminannya dalam hukum internasional hak-hak asasi manusia dan diperintahkan oleh konstitusi setiap negara demokratik.

Abstract

Globalisasi migran merupakan hak migran untuk mencari peluang kehidupan yang lebih baik di daerah tujuan.Tidak selamanya tujuan migrasi sesuai harapan, terdapat fenomena kasus keimigrasian dan korban perdagangan manusia bagi buruh migran Indonesia di luar negeri yang berimplikasi terhadap kewibawaan pemerintah Republik Indonesia. Permasalahan terjadi karena adanya disharmoni hak migran yang dihadapkan pada dua pilihan yang belum terselesaikan antara pemahaman prinsip-prinsip Hak Asasi Manusia dengan prinsip-prinsip penegakan hukum keimigrasian. Melalui pemolisian diharapkan dapat mengatasi permasalahan dengan mengedepankan kemitraan antara masyarakat dan pemangku kepentingan untuk menciptakan keteraturan sosial.

Abstract

In 2002, The AKP (Partai Keadilan dan Pembangunan), which supported by Islamists, won elections in Turkey. Since then, the AKP has grown more in line with its harsh ideological position and adopted a more conservative approach and the full support of democracy. What factors could explain the AKP?s victory and the party?s change even further? In this book, M. Hasan Yavuz showed that an open and democratic political system has encouraged radically religious groups to moderate their political practices and ideologies, to win the election. It also sustained by good economic conditions and a healthy public space, which allows for the negotiation of various differences openly and peacefully. The AKP?s victory in 2007 elections further solidified this view: the common political reality will ultimately defeat the ideological and dogmatic rigidity that Islamic radical had before.

Abstract

The post 9/11 rehabilitation programs have become attention in various countries. The projects for terrorism rehabilitation planning programs are systematically and structured carried out in several countries, such as Saudi Arabia, Singapore, Pakistan, Malaysia, Egypt, Iraq and Uzbekistan. Whilst, this program are conducted through ad hoc institution in some countries, such as in Nigeria, China, Indonesia, Bangladesh, Denmark, Germany, Britain and Nepal. The terrorism rehabilitation program of the post 9/11 tragedy tended to be focused on terrorist groups that used Islamic symbols. This book consists of a series of case studies of different terrorist rehabilitation initiatives that have been attempted around the world. A rehabilitation programs in countries are critically analyzed to develop a good understanding of the significance of different approaches and strategies of terrorist rehabilitation in helping potential terrorists to integrate back into society. This book provides vital tools to address the challenges which faced by practitioners of terrorist rehabilitation programs.

The effort by Indonesia to exert their influence in the Southeast Asia region has been motivated by Indonesian leaders to develop a zone where solidarity is possible. The backdrop of post-colonial and Cold War context shaped this exertion into modest aspiration. Indonesia employs ASEAN into various dealings with regional affairs. The achievement of ASEAN has been its step-by-step arrangement which quite conforms its internal contrast of socio-cultural diferences among nation. This worked until the coming of globlisation which bring a various contest of interest, aspiration, and infuence. The proposition of employing UNCLOS in supporting and extending Indonesia?s exertion is not very prominent. However, UNCLOS, in significant part, reflects the history of ?Djuanda Declaration?. UNCLOS has potential in covering the width and complexity of the reality of archipelago. The case for UNCLOS is based on revisit into institutional framework of ?national security? and the rearticulation of provision of UNCLOS as important part of this framework.
