Abstract

Sengketa konsumen yang tirnbul dari pengelabuhan konsumen melalui iklan membebankan tanggung gugat periklanan kepada pelaku usaba periklanan, sedangkan tanggung gugat baru ditujukan kepada pelaku usaha pengiklan kalau konsumen dirugikan setelah mengkonsumsi produk itu. Ini merupakan konsekuensi dari prinsip professional liability. Konstruksi yuridis "tanggung gugat renteng" bisa digunakan apabila dapat dibuktikan kerugian konsumen akibat kesalahan pelaku usaba pengiklan maupun pelaku usaha periklanan. Tanggung gugat pelaku usaha periklanan dapat beralih kepada pelaku usaba pengiklan dengan menggunakan prinsip beban pembuktian terbalik.

Abstract

These technological advances have caused enormous changes to business people who will indirectly use modern technological advances. This development will undoubtedly bring changes to the Notary duties and authorities' implementation as public official authorized to do authentic deeds. A new dynamic of society changes due to globalization and developments in information technology that require Notary services in carrying out existing legal actions, facilitated by current information technology. However, Notaries are still hampered by the absence of legal instruments that protect and regulate Notaries in carrying out these actions. This is a challenge for the Notary profession in responding to globalization in information technology, meaning that the Notary's duties as public officials develop along with the times. This research is normative research with a statutory approach. The results obtained from this research are that the Notary Public must involve a third party called the Certification Authority, to secure and legitimize documents into electronic transactions. The Notary deed to be used remains an authentic deed and has perfect evidentiary power. Still, suppose the process does not involve the party. In that case, the Notary deed is classified as an underhand deed, and has the power of proof as to the deed underhand, even though it is made and signed either directly or digitally by the Notary.Keywords: Notary, Electronic Transaction, Notary Deeds

Abstract

Diversion Efforts can only be carried out in cases of Children in conflict with laws that threaten their crimes under 7 (seven) years and do not constitute a repeat of a criminal act. In contrast, the juvenile justice system requires deprivation of liberty principle and punishment related to the latest findings. This research uses the normative legal research method, using the law method, research method, and comparative method. From this research, we know that diversion in the juvenile justice system cannot be done in every child's case; it can only be done in the case of children who meet the requirements of a case protected under 7 (seven) and not a repeat of follow up. Not all cases of children go through a process of diversion. Children who have a conflict with the law are directly threatened with criminal punishment. However, there has been a reconciliation between the perpetrators and the victims, so that the deprivation of liberty principle, and criminalization, is the latest result, which is not successful. Therefore, diversion shall not be used again to protect children.Keywords: Diversion, Children, Liberty

Abstract

One of the alternatives that can be used as a residence is an apartment. This study aims to know and analyze how the apartment buyers' dispute settlement is experiencing changes in the apartment location without prior notification and approval. This is normative legal research that will explore the legislation's contents. Based on the study results, the sale and purchase of apartments done by ordering then made a Sale and Purchase Agreement (PPJB) that ensures the apartment will not be sold to others and delivered according to the time specified. Besides, it also regulated in Law Number 8 the Year 1999 concerning Consumer Protection and Law Number 20 the Year 2011 on Flats. Therefore, in case of misuse in the sale and purchase of an apartment, the consumer may initiate legal action based on the existing PPJB and Consumer Protection Law.Keywords: PPJB, Apartment, Consumer

Abstract

This study discusses the Marriage Age Limit Provisions According to Law Number 1 of 1974 concerning Marriage (Case Study in the Gresik Religious Court), this research is based on the number of divorce cases in the Gresik Religious Court, which are still dominated by productive age, Seeing the phenomenon, those who generally immature, not adequately prepared to enter the world of marriage, the marriage dispensation granted in a religious court on the lives of those who are married has both positive and negative effects. The positive impact of preventing adultery is that the opposing side is prone to disputes because those relatively young certainly have different thoughts from those who have grown up. This study examines and analyses the age limit's application for marriage and analyses the judges' considerations in examining and determining marital dispensation cases in the Gresik Religious Court. To answer the problem, the writer uses socio-legal research methods. The data used were sourced from legislation, literature study, and scholars' opinions and data obtained from the Gresik Religious Court. The study results show that applying the age limit for marriage is less practical or cannot be fully used to the people in the Gresik Religious Court's jurisdiction. This is indicated by the high number of marriage dispensation requests in the Gresik Religious Court. Secondly, the Judge's consideration in examining the case for a marriage dispensation request at the Gresik Religious Court was under the procedures set out in Perma Number 5/2019. Abstract

Economic globalization in the last decade is developing very fast, the business world is always moving dynamically, business people are always looking for breakthroughs in growing their businesses one of which is a franchise system with the principles contained in the franchise agreement, but many companies are stalled due to co-19 virus pandemic so entrepreneurs must innovate and restructure to support the business. This is empirical legal research. The result of this paper is that principle of franchising is a pillar in a franchise agreement, and the parties in the franchise agreement have adhered to this agreement so that both parties need to fulfil these principles, due to the law that occurs due to a pandemic is a corporate restructuring and temporary agreement changes. The franchisor must think of regulations that benefit the franchisee with little risk. In restructuring the company and agreements, the franchisor must accurately measure the impact of the covid-19 pandemic on the franchisees' outlets.Keywords: franchising, principles, restructuring

Abstract

Indonesia sebagai negara hukum, harus menjunjung tinggi supremasi hukum. Pada kenyataannya hukum sering diabaikan, khususnya hukum pidana. Hukum pidana sebagai hukum publik mempunyai sifat memaksa. Penegakan hukum dalam perspektif hukum pidana terkait dengan kebijakannya, terutama kebijakan dalam sistem peradilan pidana. Kebijakan hukum pidana tidak bisa lepas dari tiga kekuasaan eksekutif, kekuasaan yudikatif, dan kekuasaan legislatif, sehingga dalam pelaksanaan supremasi hukum harus diperhatikan masing-masing kekuasaan tersebut.

Abstract

Electricity is essential for our daily needs and community and businesses because it can run their products. Recently the community and we depend on electricity, so the usage of electricity is getting an increase. All our hardware and software tools use electricity because electricity changes our style in daily life. So, the management of electricity which the State gives to PT. Perusahaan Listrik Negara (PLN) is a "State-Owned Enterprise" as we were known (BUMN). The electricity distributed to the consumers are still frequently blackout, therefore people and community fell loss with the outage, and make lawsuits to PT. PLN (Persero). This study uses a normative juridical approach, which analyzes data Referring to norms in the applicable law and regulations. The benefit of this research to contribute to the development of legal science, specifically the rule regarding consumer protection for electricity users. This research suggested that PT. PLN (Persero) commits to make a quick response when there is a blackout and give good service to the users. The consumers have to get a copy of the Power Purchase Agreement at the beginning of the installation. It is essential for the consumers as evidence to do a lawsuit when PT. Abstract

Pajak penerangan jalan haruslah berdasarkan UU, hal ini dapat dipahami karena pajak merupakan beban kewajiban rakyat, sehingga benar-benar dari dan untuk kesejahteraan rakyat termasuk pelanggan/konsumen listrik. Pelanggan/konsumen listrik wajib membayar pajak penerangan jalan setiap bulannnya bersamaan dengan pelaksanaan pembayaran rekening listrik PLN dengan besar nilai pajak ditentukan paling tinggi sebesar 10% berdasarkan UU No. 34 Tahun 2000 dan PP Nomor 65 Tahun 2001.
