Abstract

This case occurred between the United States and Nicaragua, where the problem between the two was a dispute that led to allegations of violation of international law, stemming from domestic governance problems that occurred in the Republic of Nicaragua. However, the United States is actively involved in these internal problems. Nicaragua considers that the interference by the United States has exacerbated the state of the Nicaraguan government and feels that the United States has acted in contravention of international law. One of the interventions was when America took steps to stop economic aid to Nicaragua because previously Nicaragua was against El Salvador, where El Salvador was known to have good diplomatic relations with America. Knowing this, America also carried out a kind of attack attempt by sending its military into the territory of Nicaragua and planting mines in the territorial sea and inland seas of Nicaragua, causing the ships passing by damaged or even destroyed. Then America also did its civil and military facilities in Nicaragua. Of course, this really bothered Nicaragua, because it did not make any efforts against America but was under attack for its case with El Salvador. The case was then reported to the ICJ who was the mediator and considered that the actions taken by America were wrong because they were too involved in matters that were not under its jurisdiction to participate in the case.

Abstract

The poisoning of Sergei Skripal in Britain by Russian military intelligence drew a lot of criticism from various countries in the world. This action violates state sovereignty and violates international law because the assassination attempt used chemical weapons, namely a neurotoxin from the Soviet-era called Novichok. Britain finally gave a strong response by designating 23 Russian ambassadors as Persona Non-Grata, which was in accordance with the provisions of the 1961 Vienna Convention on Diplomatic Relations. Persona Non-Grata is the exclusive right of every country that can be used as a sanction if there is a violation of international law, although there can be arbitrariness in its use because the Recipient Country is not obliged to provide valid reasons. Therefore, Persona Non-Grata in diplomatic law can be used as a warning or a means of interrupting a diplomatic relationship that is considered incompatible. This paper will discuss the incident in terms of Diplomatic and Consular International Law.

Abstract

The United Nations (UN) is a new international order organization that was formed after the failure of the League of Nations (LON) after the world war. Within the United Nations, there are important organs, one of which is the Security Council with five permanent members including the United States, Britain, Russia, France, and China. The five permanent members have the authority to issue Veto rights over the policies to be determined. Including one of them is the policy to issue a resolution to cases of armed conflict in Syria. This paper will discuss in more depth the resolution policy in terms of sources of international law and related theories. Including, in this case, the author criticizes the conception of Veto rights attached to the five permanent member states of the UN Security Council which should be aimed at and used to achieve world peace and not for specific interests.

Abstract

The law of the sea, which is a branch of international law, has developed a long time ago and has undergone very significant changes in its regulations. Moreover, the law of the sea plays a very important role in limiting the areas of the sea, land, and waters of a country. Which here the sea is a road that is very often used to connect one country to another for trade purposes and even for other interests. On the other hand, there is international maritime law to protect natural resources from being misused. The International Court of Justice is to resolve disputes between member countries. This institution also provides opinions or advice to official bodies and specialized agencies established by the United Nations. In carrying out its duties, the International Court of Justice refers to international conventions to determine cases recognized by countries in dispute. The ICJ is also guided by international customs which are evidence of common practice.

Abstract

Liberalism is a basic principle adhered to by the United States in all its policies, including trade policies. This principle is also carried out by the President of the United States, Donald Trump, in the form of orientation towards bilateral agreements. When viewed from the trade relationship between Indonesia and the United States, the Generalized System of Preference or GSP facility is the only bilateral relationship that Indonesia can carry out with the United States. GSP is the US policy in the form of exemption from import duty on imports of certain goods from developing countries, in which case Indonesia is one of them. However, it turns out that there is a policy to evaluate the implementation of the GSP for Indonesia looking at the trade balance and Indonesian economic policies that have an impact on the United States. This evaluation has the potential to reduce Indonesia's Bargaining Position in the GSP facility. If this unexpected condition arrives, it could be detrimental to Indonesia because of the increase in tariffs imposed on the export sector. The author intends to examine the reevaluation policy in terms of international law.

Abstract

Asgardia is an area that proves that the progress of human thinking is very visionary. It is an area in space that is called capable and will be a place to live for humans. The truth has not been fully proven, but efforts to regulate and implement it continues to be done. Because it has the support of various parties and communities that can be said to no longer want to live on earth. The way of recruitment is also unique, the Asgardia team has established an official website for registration to become prospective citizens in the region, the number is not small. However, it remains a concern for many to explore whether it is a hallucination or a reality. Meanwhile, regional consensus conferences are also underway, which can be witnessed and immortalized in videos uploaded via YouTube. They have also determined a kind of national emblem to the form of government, but the official status of "statehood" still does not have the legality that can make the public believe completely. Considering Asgardia is an area of formation inspired by a story in a world-class movie.

Abstract

The Law of the Sea divides the maritime territorial boundary of a country into several parts, one of which is the Exclusive Economic Zone or which is often referred to as EEZ. The Exclusive Economic Zone is a zone with a maximum distance of 200 miles in which resources can be utilized but cannot be controlled by a country due to purposes such as shipping and aviation navigation which are generally required. However, due to the nature of its free use, it can lead to conflicts between countries because this is like dominoes that have a correlation with one another. In this paper, it will be described in relation to examples of implementing EEZ conflict resolution in imaginary cases or fictional cases of the State of Amalea and the State of Ritania as a simulation of the settlement of the EEZ determination based on the UNCLOS 1982 sea law. This simulation has fictional factual dynamics that are interesting from a legal perspective with a settlement that is conventional namely the consensus of the parties. Referring to the 1982 UNCLOS, the use of marine aspects needs to be considered so as not to disturb other countries.

Abstract

Trade liberalization is the elimination or reduction of restrictions or barriers to the free exchange of goods between countries. On the other hand, the Protectionism policy of the United States (U.S.) to Chinese products led to a trade war between the two countries. The impact of the U.S.-China trade war has an impact on fluctuations in the value of JCI in Indonesia, so protectionism policies are needed in accordance with national and international legal instruments to stabilize the national investment climate and capitalize on the conditions of the U.S.-China trade war. In this paper, the author uses a statutory approach, conceptual approach, and historical approach, so that this research is classified as normative juridical research or also called doctrinal law research.

Abstract

The rapid development of technology allows humans to utilize natural resources that were previously difficult to reach even as resources contained in space. With these advances, the law also contributes through international law governing aspects related to the use of space often known as the Five United Nations Treaties on Outer Space. In 2017, the CEO of SpaceX (an American private aerospace company), Elon Musk, announced plans to use transportation previously used to move objects from Planet Earth to Space, rockets, to be used as public transportation used as a means of mobilization from one place to another on Planet Earth. This is interesting because the concept of using Space after planet Earth's air surface thus giving rise to new contemplation related to licensing and aspects of its legality. In this paper, the author intends to examine from the perspective of international law with international arrangements relating to the laws of air and space.

Abstract

In the case of Whaling in Antarctica proposed by the State of Australia, the ICJ is faced with a very technical problem relating to the interpretation and assessment of scientific elements. The court evaluated claims from Australia that Japan through a whaling program called JARPA II concealed commercial purposes behind false scientific research. This case then raised the world's attention in the international agenda, especially the correlation between law and science. On the other hand, the ICJ has also been criticized for handling cases of a technical nature, so questions arise regarding the jurisdiction of the International Court of Justice in dealing with the complexity of factual issues in a healthy and fair manner. Basically, the ICJ should avoid two main hurdles: limiting judgment only to legal aspects or becoming a science judge by conducting technical analsis and considering the position of previously handled cases. This interesting case will be analyzed by the author in relation to his studies in the perspective of international law.
