Musawa : Jurnal Studi Gender dan Islam
Musãwa Journal of Gender and Islamic Studies was first published in March 2002 by PSW (Pusat Studi Wanita) Sunan Kalijaga Yogyakarta under contribution with the Royal Danish Embassy Jakarta. In 2008, published twice a year in collaboration with TAF (The Asia Foundation), namely January and July. Musãwa Journal is a study of gender and Islam especially on gender mainstreaming and child rights both in the study of texts in the Qur’an and Hadith, figures and thoughts, history and repertoire, classical and contemporary literature as well as socio-cultural studies. All concentrations are in the context of Indonesia and other countries in Southeast Asia within the framework of unified NKRI, based on Pancasila. Musãwa Journal has been published by PSW UIN Sunan Kalijaga Yogyakarta since 2002. Initiated by lecturers, gender activists and Islamic studies scholars of PTKI ( Higher Education of Islamic Religion) Musãwa has regularly published academic works and researches on gender and Islam for almost two decades. Now, the Journal extends its studies with Children and Human Rights (HAM). All studies are still in the context of gender and its mainstreaming. Through the studies hopefully, the Musawa journal can be part of the implementation of gender mainstreaming in the context of Indonesian society.

Abstract

The role of Indonesian women within the public sphere is heatedly discussed. The issuance of the Constitution No. 12/2003 is perceived by some people as a "warranty" for a wider opportunity for women in the political realm. Even though the 30 per cent quota for women in the parliament is only a suggestion and not a regulation, this has to be seen as a gateway for women's active role in the public sphere. After a long period of time, especially during the New Order era when women were only allowed to be active in the domestic sphere, this momentum brings a new hope for more freedom for women. This article is an attempt to examine the extent to which women are aware of this opportunity. This includes the examinations of women's readiness in dealing with the cultural barriers and gender bias perspectives on various issueswhich had confined them for quite some times.

Abstract

"No ... of a man and a woman except if their mahram, and no travellingfor a woman except with her mahram"This long sentence is now decoratingmany public space in Aceh, including on ther tree trunks in the city gardens where young unmarried couples might be interested in enjoying. This propaganda is based on the province Qanun (regulation) No 14/2003 about prohibition of kludwat (...). This paper will not deal with the Qanun per-se, rather with the underlying arguments used by the proponents of the articulation of the Qanun by local intellectuals. My discussion to the issue begins with the examination of the social context within which the hadits aboui mahram is conceptualized, then followed by a deep analysis on the formulation of Fiqh (Islamic law) as well as gender analysis on the impact of mahram concept to women's mobility. At the end present my recommendation in applying transformative understanding on the mahram concept.

Abstract

The revving up of narrow, 'Syari'ah' based revivalist movements is chaining down the movement of women as a whole. Thanks to a concept of Syari'ah that is decidedly misogynic in putting forth rules and legislations; containing quite a bit of hatred against women, rooted in a religious view that is negatively sexual, and aimed at the female body. This has lead to simplification, reduction and generally destructive confusion manifested in numerous acts of Jilbabisasi and one-sided clothing regulations. Trampling over diversity, and taking down long...standing traditional clothing that has created no previous moral problems, some of which has become rooted in the identities of a culture, as collateral damage.

Abstract

The future of a nation, including Indonesia, can be predicted from the current condition of its children. A nation may have a good vision of their future if children are living in a good life, in a good health whether physically or psychologically, and free from any violence. In contrast, if the current condition of children is bad, such as what we find in Indonesia which is among the eight most populous Muslim countries, we may be pesimistics over the future of our nation. Children experiencing violences one after another particularly in Muslim counries intrigues our conscience whether there is something wrong in our understanding over religious texts, hadits in this context. Hadits has been taken as a religious source for raising children, for education as well as development of children's future. Presumably incorrect understanding of hadits on children raising and education has provoked violence on them. This article seeks to present better understanding of several prophetic traditions on children issues, and to promote the messages of the Prophet Muhammad to rectify the quality of children.

Abstract

Abstract

In the interpretation of the verses of the Qur’an, gender has undergone considerable  and dynamic developments. The classical commentators tend to interpret verses textually – normatively, while feminists tend to interpret the verses contextually – sociologically. Along with the developments in the methods or approaches to the contemporary interpretation of the Qur’an, one of the methods or approaches used by feminists is hermeneutics. Through this method or approach, Amina Wadud tries to interpret verses related to the creation of women, women’s leadership, and the problems of polygamy. The result is that the origin of human beings, both males and females, came from a single nafs which is part of the system pairs (nafs itself and its zawj). The leadership clause should be understood in the context of society as a whole through the concept of “functionalist”. On polygamy, there is no direct evidence from the Koran about the permissibility of polygamous marriage, especially in regard to the three validations often cited by proponents, namely financial reasons, reasons of infertility, and the reason the fulfillment of lust or sexual needs.

Abstract

Discussion of the jilbab is truly very interesting. In several past studies, the concept of wearing the jilbab has  been seen as very controversial. There have been several contemporary Islamic scholars (ulama) with interesting perspectives on the jilbab. One of these Indonesian scholars is the Islamic interpretor (Mufassir) M. Quraish Shihab, who has written a book on the jilbab. Although the jilbab is not the area of concern of the author, using prior knowledge I will look at M. Quraish’s rationale in making the controversial decision to write on the jilbab and also at his research methodology. It is his research methodology on law-making that the author particularly focuses on in this paper.

This article is about the political resistance of NU women, which is carried out by raising thoughts and actions in order to free themselves from violence. Abstract

A child’s right to education within the family according to Imam Syafi’i and its significance for early childhood  education in Indonesia This research is based on library research on the rights of the child to education within the family from the viewpoint of Imam Shafi’i, and the impact of his teachings on early childhood education in Indonesia. The study is interesting because the first schools to appear in Indonesia were of the Syafi’i tradition. Imam Syafi’i jurists and ushuliyyin have collections of poems that express the need to develop education in early childhood. Despite this, the theory of children’s education in the school of Imam Syafi’i is under researched. This study examines three research questions. First, how does one undertake a  biography of the thought of Imam Syafi’i and Imam Syafi’i school of thought. Second, what is the concept of children’s rights in the family in the view of Imam Syafi’i. And third, is there reference to  early Childhood education that implies the concept of children’s rights to education in the view of Imam Syafi’i. This study concludes that Imam Syafi ‘i in scientific rihlah is purely academic. Imam Syafi’i also elicits several important ideas on a child’s rights within the family, the right to education and the right to self-expression. Imam Syafi’i schools are relevaant to early childhood education in Indonesia in which these (religious education) schools are widespread.
