Musawa : Jurnal Studi Gender dan Islam
Musãwa Journal of Gender and Islamic Studies was first published in March 2002 by PSW (Pusat Studi Wanita) Sunan Kalijaga Yogyakarta under contribution with the Royal Danish Embassy Jakarta. In 2008, published twice a year in collaboration with TAF (The Asia Foundation), namely January and July. Musãwa Journal is a study of gender and Islam especially on gender mainstreaming and child rights both in the study of texts in the Qur’an and Hadith, figures and thoughts, history and repertoire, classical and contemporary literature as well as socio-cultural studies. All concentrations are in the context of Indonesia and other countries in Southeast Asia within the framework of unified NKRI, based on Pancasila. Musãwa Journal has been published by PSW UIN Sunan Kalijaga Yogyakarta since 2002. Initiated by lecturers, gender activists and Islamic studies scholars of PTKI ( Higher Education of Islamic Religion) Musãwa has regularly published academic works and researches on gender and Islam for almost two decades. Now, the Journal extends its studies with Children and Human Rights (HAM). All studies are still in the context of gender and its mainstreaming. Through the studies hopefully, the Musawa journal can be part of the implementation of gender mainstreaming in the context of Indonesian society.

Abstract

Pola penataan ruang dalam rumah orang rimba sangat terkait erat dengan konsep gender. Bentuk rumah, bagian-bagian rumah, serta posisi rumah menggambarkan konsep gender yang berlaku dalam adat orang rimba. Perilaku sosial yang terlihat dari aturan tempat tidur, aturan bertamu dan menerima tamu, serta aturan menginap juga menggambarkan kecenderungan-kecenderungan terhadap konsep gender dalam kehidupan orang rimba. Sistem kekerabatan orang rimba yang matrilineal sangat mempengaruhi kehidupan sehari-hari mereka. Perempuan memiliki kedudukan khusus dalam keluarga rimba dan kekuasaan dalam merancang rumah keluarga rimba. Mereka menentukan tata letak, ukuran, ikut mencari bahan dan ikut dalam proses pendirian rumah. Perempuan mempunyai peran sosial yang lebih besar dibanding laki-laki, maka bentuk rumahnya juga memiliki banyak ruang untuk menampung aktivitas ibu dan anak perempuannya. Ruang dan struktur organisasi ruang di sebuah rumah lebih mengakomodir kepentingan kaum perempuan.

Abstract

This article examines the agrarian conflict which caused the misery of farming families, particularly women in developing a livelihood in the village. Agrarian conflicts, as a result of customary land conversion to state land (negaranisasi tanah adat), should be solvable through the agrarian reform policies which is supported by the political momentum of decentralization and the issuance of the Village Act which gives village more opportunities to regain control of land assets. However, the practice in East Lombok showed that local government tends to give land occupation permits to private investors rather than implement agrarian reform policy that gives more justice to develop a more independent and prosperous. rural economy.

Abstract

A family are those people who play important parts in our loves. It is however, unfortunate, that due to ignorance or extreme cultures embedded, that harmful acts are imposed, in contravention to human rights and female reproductive rights. Among these practices are female circumcision, usually done at a young age (often toddlers) by cutting off the clitoris, based on religious or tradition, in order to “prevent” women becomingpromiscuous. This practice is still widespread in many areas including Kuntu, Kampar Regency, Riau Province. Carried out under the belief “adat basondi syara’, syra’ basondi kitabullah”, to be a muslim and a woman who is faithful to traditions and religion, they must be circumcised. Even when faced with the fact female circumcision is highly dangerous and is a aberration of women’s rights, many continue to engage in the practice. The family unit is a key part of this practice, as young women are under the control of their parents, which should have been a safe haven, perverted due to extreme taqlid. Consciously or not, this results in the deprivation the rights of women, who are yet to be aware of their very rights.

Abstract

This article intends to portray the idea that Islam came with the mission of returning for women’s right that have been looted and pillaged by men during the days of ignorance, in addition to showing that Islam elevate the dignity of women and give back rights that have been shattered and trampled by the domination of men and destroyed by the religious traditions and national fanaticism of a narrow group. With the specific terminology of family law concerning women’s right -a noble endeavor in itself- this article explains the relationship between maqasih sharia and human rights, with a special focus on the implementation of human rights. On the other hand this paper also analyses the implementation of women’s rights in Islamic family law.

Abstract

All households desire a happy life in this world and the next. This is built through commitments, agreed<p >between the partners to achieve physical and spiritual happiness based on traditions and Islamic teachings. Many challenges present themselves during the process and many become sources of conflict: economic disparity, differences of opinion, cheating on one’s partner, all cause domestic violence; this leads to the destruction of the commitments founded in happiness. These are all prevalent in the cases of domestic violence subject to this research: in the Merangin, Batanghari and Kota Jambi Regencies. This, in the face of Islam’s strict rules against violence, especially to women. Women have the same rights and obligations with men and should receive strong legal protect from the law, whether the central or local governments.

Abstract

This paper asserts that education is an important instrument in life. Specifically, this article describes the rationale for Muslim’s obligation to participate actively in education, and the roles they play in the implementation of a quality education. All will be assessed from the perspective of Islamic teachings, particularly the Qur’an and Hadith. In addition, to strengthen and complement this paper, the perspective of the International Covenant on Economic, Social and Cultural Rights (ICESCR), which confirms that the Islamic community is a unified living entity when it comes to fulfilling education (kiyan hayy wahid). Therefore, the cooperation of various parties in the administration of education in accordance with the principles of maqasid shariah and the ICESCR is part of the Qur’anic command to do good deeds and piety (ta’awun ‘ala al-birr wa at -taqwa). Cooperation should embodied in an effort to develop a culture of reading and writing, preparing facilities and infrastructure, to increase educational human resources and create an environment conducive to education. Contribution of the Muslim community in educational issues should be the expectation of all parties.

Abstract

Marriage gives material and immaterial rights to the wife in the household. But in social reality, many wives do not enjoy the rights of material and non-material, because the husband does not carry out his obligations responsibly. Therefore, forms of Islamic legal protection of the rights of the wife must be studied. The analysis focuses on advocacy for the rights of wives for dowry, living fulfillment, and a sense of security, in the perspective of Islamic law, to better protect the wife.

Abstract

This paper aims to explain the construction of the discourse of sexuality in Act No. 1 of 1974 on Marriage and the Compilation of Islamic Law. Discourse of sexuality is constructed, namely: the heterosexuality of marriage, polygamy, the rights and status of husband and wife, the status of the child, guardian, dowry, and matters relating to the relationship between men and women. The construction of the discourse of sexuality in the Marriage Act and the Compilation of Islamic Law cannot be separated from a conflict of interest, understanding gender, and the spirit of nationalism. The construction put women’s position under men. This has implications for discrimination and subordination of women’s sexuality and overrides the rights of the child. In addition, it also resulted in resistance against the Marriage Act and the Compilation of IslamicLaw, such as judicial review against them, and increased family problems that lead to divorce, in which women are more often than not the plaintiff.

Abstract

Family planning programs have a strategic, comprehensive and fundamental role in achieving a healthy and prosperous Indonesia. Efforts to deny pregnancy can be done by the use of contraceptives, but not all husbands agree to the use of contraceptives. What happens is drop outs of the acceptor. Women who are of productive and childbearing age, and the right to use contraceptives, as it is an important and necessary right. While it protects women’s health, contraceptives require the husband’s support to prevent dropouts and in selecting the proper contraceptive. Planned Parenthood service must be made through informed choice and consent of the couple, in order to avoid human rights violation, especially in the choice of contraceptives. The incidence of dropouts remains high for several reasons. This study was conducted to determine the role of husband support in incidents of dropouts in villages and the city. It is a descriptive research. The population in this study are acceptors drop out for 3 consecutive months, and are not pregnant. A sample of 100 people, and collection of data with a closed and open questionnaire, is presented descriptively. Husbands support the incidence of drop -out in the village and in the town due of the side effects at a rate of 38%, the husband does not support his wife KB 22 %, the other - the other 22 %, the husband does not receive contraceptive family planning in cities 82 % in rural 74 %, the husband asks stop KB in the city 48 % rural 60 %, the husband providing cost planning in the village 42 % in the city 34 %, the husband does not support the use of contraceptives in the city 38 % rural 38 %. In conclusion, increasing the support of her husband, improve mentoring and coaching acceptor drop out to be willing to use contraception again. Support includes acceptance of family planning services for the husband against wife in the city is higher than in the village.
