Abstract

Early marriage is the argreement of man’s or wonen’s physically and spiritually as husband or wife having goal to be family and it based on the God almighty. The study aims to know effect of the early marriage. The kind of the study is qualitative descriptive and to get informant will be done by purposive sampling, data collection technique uses the observation, interview and documentation. Then it is analyzed by reduction data, presentation data and verification data. The results of the study shown that the positive effect are: 1) to avoid free intercourse, 2) To enlighten family’s burden, 3) To learn how to responsible for the family. While the negative effects are 1) Biology (the damage of the woman’s sexual repreduction). 2) Psychology (long lasting trauma), 3) Sociology (unmature waf of thinking so that can damage family harmony), 4) Population (density of population) for couple of childbearing age.

Abstract

Abstract This research background by violations of human rights (Human Rights) in Indonesia, particularly womens rights violations in the health sector. Yet the fulfillment of the right to health for women is clearly reflected from ranking Human Development Index (HDI) and Gender-Related Development Index (GDI). One indication is the high maternal mortality rate (MMR) and infant mortality rate increased. In Indonesia, maternal mortality rate is very high in comparison with other countries, even higher than those of developing countries in Southeast Asia. Omission of the right to health is a human rights violation. Therefore, the new law required an effort of political justice and protection of the rights womens health in Indonesia. Moreover Indonesia country is "state of law", the concept of the rule of law is the protection of human rights. In addition, the legal protection of human rights politics in the health sector comes as the commitment of Indonesia in the international program MDG.s. Keywords: politics of law, womens health, rights and justice. Abstrak Penelitian ini dilatar belakangi oleh pelanggaran terhadap hak-hak asasi manusia (HAM) kaum perempuan di Indonesia khususnya pelanggaran terhadap hak-hak di bidang kesehatan. Belum terpenuhinya hak kesehatan bagi perempuan tercermin dengan jelas dari peringkat Human Development Index (HDI) dan Gender Related Developmen Index (GDI). Salah satu indikasinya adalah tingginya angka kematian ibu (AKI) serta meningkatnya angka kematian bayi. Di Indonesia, tingkat AKI sangat tinggi di bandingkan dengan negara-negara lain, bahkan lebih tinggi dibandingkan dengan negara-negara berkembang di Asia Tenggara. Pembiaran terhadap hak-hak kesehatan merupakan sebuah pelanggaran HAM. Oleh karena itu, diperlukan politik hukum baru sebagai upaya keadilan dan perlindungan hak-hak kesehatan perempan di Indonesia. Apalagi negara Indonesa adalah “negara hukum”, konsep negara hukum adalah adanya perlindungan terhadap HAM. Selain itu, politik hukum perlindungan HAM di bidang kesehatan ini sebagai upaya komitmen Indonesia dalam program Internasional yakni MDG.s. Abstract

The scientific by the fact injustice, discrimination, subordinated, depolitisasi and hak-hak violation of human rights ( HAM ) Women. This was caused by some of the articles in law . No. 1 in 1974 about the marriages ( UPP ). This study draw in terms of perspektif- approach philosophy islamic law ( FHI). Focus this writing: ( 1 ). How  raights women in philosophy UPP perspective islamic law ? (2). What are the injustice and human rights violations women perspective philosophy islamic law?. This research is research library, review of critical thinking normativ and sociological implications, by using the method diskriftif, critical analysis, progressive. Scientific conclusions writing this is women experienced form injustice and human rights violations and some article in UPP declared contrary to the purpose of Islamic law namely the principle of  maqasyid as-syari ah  (kemashlahatan, justice and the protection of human rights). His discoveries in this writing is that country had violated a commitment to an agreement the united nations, because indonesia did not practice principles which is in the convention cedaw. And indonesia ratified convention cedaw through law No. 7 1984 regarding the ratification of the removal of all forms of discrimination against women.

Abstract

The relationship between nash (text) and al-waqi (the fact) both are territories that if mated will bring up a deeper understanding of komprehensip. The pattern in the text read according to ash-Syatibi there are three i.e. qiraah salafiyyah qiraah, tawiliyyah, and maqashidiyyah qiraah. While in the area of al-waqi there are some disciplines that are used in understanding the phenomenon of social, political and other areas such as sociology, anthropology, and so on. Thus ideally when doing a reading of the text that is associated with the social phenomena should not leave the existing disciplines on the al-Waqi . If not then an understanding of the text is out of date, so no aplicable. Thus ijtihad should always digelorakan and the door of ijtihad never closed. In this context, the science of ijtihad raiseth Usul Fiqh is a standard methodology has proved its role by Islamic thinkers like the priest sect in Islamic law, and digging in the field to the other, from the original sources (Quran and as-Sunnah). But nowadays the Islamic fiqh is considered barren because of the role of the framework teoritik the science of Usul fiqh is considered less relevant again to respond to contemporary problems. Then simply grounded if it appears a lot of bids for a new methodology of contemporary Islamic scholars in an attempt to dig out the original source of Islamic law to be adapted to the dynamics of the times. This fact can not be denied because the phenomenon of the global arrogance of modernity and industrialization has been menghegemoni the whole line of the lives of human beings so as to trigger the dynamics of contemporary Islam by all perangkat-perangkatnya including methodology Usul Fiqh (qawaid ushuliyah) methodology and the understanding of Fiqh (Fiqhiyyahi al-qawaid). This is a big job to be done in order to build the Islamic ideals of self (self image of Islam) in the midst of modern life that is constantly changing and evolving. In Indonesia over the past decades has appeared the development thinking of Islamic law that is adapted to the real conditions of life in Indonesia. This is effected by the realization that classical fiqh with the device its methodology have been unable to answer the question.

Abstract

Life is derived by all humankind of any race or class without exception. These rights is the fundamental right of every human being in this world. Even in the medical world of medicine, there is a very famous oath, the oath Hiprokrates which states that any doctor would keep the lives of every human being, from birth to death the man. Here the medical profession spearhead the implementation of the oath, and every doctor should perform their duties based on the oath they say before they undergo the profession. Each physician is required to maintain the lives of patients - patients, should megupayakan various things in order to examine the patient lives of these patients can be saved. It can be concluded that every doctor should keep every persons life and can not be the God to end the life of his patient, whether intentionally or not, or the so-called euthanasia, the doctor puts a series of measures to end the lives of patients who are already in the terminal stages.

Abstract

Basically, politics is a human need. As social beings, humans need to regulate political life. In order to be run in accordance with a common goal, the ethics and morals is a necessity that must be juxtaposed in politics.                However, Machiavelli sense of ethics basing on two things, namely the Ancient Western ethics and Catholic ethics. He is holding on Western ethics derived from the Ancient Romans, whice based on the thinking that to retain power strength of spirit to fight to be the underdog. He stated that the Catholic ethics only make men weak because only orients his life on things that smelled hereafter. This thought does not give real contribution in political battles and power. As for foreign policy, Machiavelli emphasizes the shrewdness prince in terms of diplomacy. He stated that a prince in diplomacy must wear deception lion and the fox (deer).            The difference between Machiavellis political ethics is in stark contrast to what was formulated by al Mawardi. The difference is based on the basic beliefs between the two is also berbeda.Machiavelli leaned that ethics is not required in power when the condition of the people is unethical, because it was thought worth sia.Berbeda with al Mawardi, who rely on the Quran and Sunnah regardless of the conditions masyarakat. He always insisted that every ruler has always adhered to the ethical and moral values ​​that have been described in the Quran and as Sunnah. if thus, it can be concluded that, in truth Machiavelli does not provide solutions to community conditions and the improved of politis. Cause stability also what he says violates human nature when it agreed in shaping society, so that he saw the man was an enemy to the other man

Abstract

Privatization policy has been the trend, especially in developing countrie. The presence of international economic institutions such as the IMF and World Bank have a big impact that drives policy. Privatization is the ideology of neoliberalism that requires complete freedom of the free market, and encourage individual ownership of the public assets. Currently, Indonesia has become a part of the ideological hegemony of neoliberalism. Systemic Privatisation occurs. The impact is even more alarming: environmental degradation, land conflicts, poverty, and natural disasters.  Privatization is likely negative, can not be separated from the historical study of Islamic law. In Islamic law, privatization is not justified, because there are provisions in the Al-Quran and Al-Hadits which prohibits the individual ownership (privatization) of the treasures that are public.

Should endowments is one of the of various activities in economic system islamic.  Problems endowments is a problem that until recently was less were discussed in intensive.The outline there is concentrate on the discussion problems fiqih, about the manner of philosophy Syari’ah, interest, finance and banking about the manner of Syari’ah and so on.While discussion from the his theory and application still very rare. From the penghimpunan community funds so it can be seen that discussion centered at issue zakat. While other sectors has not yet received the beam sufficient.And economic system islamic terdpat a lot of activity can be done to gather community funds.These funds could actually collected did not of funds zakat but also from a source – other sources as sadaqah, infaq, endowments and so on.

Abstract

Business development to financial services syariah have made progress and development that was so advanced. Of a lot of syariah commercial banks standing, there were also a lot cooperatives syariah or the Baitul Maal Wattamwil (BMT) stand around the community in fact closer with the community. Bank syariah is a financial syariah that serves facilitate economy mechanism in the real sector through activity business activities (an investment , buying and selling or forth based on syariah principle , namely rules agreement islamic law based on the principle for the, fee ,ujroh and the margin. This research is research library (library research),  by using the method descriptive qualitative. Conclusion this research is well murabahah products in perspective economic syariah namely products mutually beneficial between customers with the bank syariah or local BMT who use the murabahah. Fiqih an order of Hanafi, marghiani (w. 593 / 1197), confirming the validity of murabahah based on the terms of what is important to the validity of a trading is in murabahah, and also because people need it, faqih of madhzab Syafi’i, Nawawi (w. 676 / 1277) just say “ murabahah is may without no opposition in the least “. With the that product a large number of residents helped in advance business is by applying of the financing in a financial institutions such as bank about the manner of syari’ah and others.

Abstract

Undang-Undang Nomor 77 Tahun 2001 tentang irigasi, menyebutkan bahwa irigasi adalah usaha penyediaan dan pengaturan ait untuk menunjang pertanian. Penyediaan irigasi di Kota Metro sangat di butuhkan untuk memenuhi kebutuhan masyarakat petani khususnya dalam bidang persawahan dengan cara kerjasama. Kerjasama dilakukan untuk memperoleh keuntungan. Pihak petani memperoleh keuntungan  berupa kesediaan air dan pihak irigasi memperoleh upah dari hasil panen petani yaitu5 kg padi dan uang sebesar Rp.2500 dari ¼ bahu. Pelaksanaan akad jasa di Kota Metro terjadi secara lisan, tidak ada istilah surat perjanjian tertulis, akad jasa yang terjadi di Kota Metro hanya berdasarkan saling percaya antara kedua belah pihak. Oleh sebab itu banyak yang harus diteliti lebih lanjut mengenai akad jasa yang terjadi di Kota Metro tersebut, baik dari segi akad maupun dari segi teori hukum ekonomi syariah. Adapun yang menjadi permasalahannya adalah : bagaimana jika terjadi pelanggaran akad jasa yang dilakukan oleh salah satu pihak?. Rumusan masalah dalam penelitian ini adalah bagaimana proses terjadinya upah jasa pengairan di Kota Metro dan apakah akad jasa yang diterapkan di Kota Metro tersebut sudah sesuai dengan nilai-nilai muamalah Islam?. Tujuan dari penelitian ini untuk mengetahui dan menganalisis proses upah jasa pengairan sawah di Kota Metro dan untuk mengetahui pandangan Hukum Ekonomi Syariâ??ah tentang akad jasa di Kota Metro. Penelitian yang dilakukan oleh peneliti ini termasuk kedalam jenis penelitian lapangan. Penelitian lapangan adalah penelitian yang langsung dilakukan di lapangan atau langsung pada responden. Penelitian ini menggambarkan dan mendeskripsikan keadaan suatu obyek kemudian menganalisisnya. Sumber data yang digunakan adalah sumber data primer dan sumberdata sekunder. Metode pengumpulan datanya menggunakan wawancara, observasi dan dokumentasi. Analisis kualitatif merupakan teknik analisis data yang menggunakan sumber informasi yang sesuai untuk membantu dalam proses penelitian. Dalam penelitian ini penulis mengambil kesimpulan bahwa pelaksanaan akad jasa di Kota Metro merupakan salah satu bentuk kerjasama yang boleh dilakukan. Tersedianya air pada masyarakat petani dalam bercocok tanam dapat berpengaruh pada kelangsungan hidup masyarakat yang mayoritas berpenghasilan dari pertanian. Dengan pola pembayaran 5kg padi dan uang sebesar Rp.2500 dari ¼ bahu dan diberikan setelah petani menjual hasil panen tersebut. Pelaksanaan akad jasa yang terjadi di Kota Metro bila ditinjau dengan teori ijarah yaitu dengan persewaan tenaga untuk mengairi selama masa tanam sampai masa panen, tetapi dengan adanya pelanggaran akad yang dilakukan oleh salah satu pihak yang berakad  menyebabkan rukun ijarah menjadi tidak sempurna dan menjadi akad yang fasid.
